Terms & Conditions

 

1.Thank you for your interest in the Getting Aussie Business Online campaign. Google Inc (“Google”) and its affiliates have worked in collaboration with MYOB, to provide Getting Aussie Business Online campaign related tools and services posted at www.gettingbusinessonline.com.au (the Getting Aussie Business Online campaign site). We hope you enjoy using them. These terms and conditions are a contract between you and Google and apply to your use of the Getting Aussie Business Online campaign site. They do not apply to your use of any services offered by MYOB Australia E1 Pty Ltd (“MYOB”) or any other services provided by partners of Google.

2.These are the terms and conditions which govern your participation as a user of Getting Aussie Business Online campaign. You will be deemed to have accepted them if you use any of the services offered through the Getting Aussie Business Online campaign site.

3.The key service offered through Getting Aussie Business Online campaign by MYOB is the ability for you, if you are a business to:

a. set up a website for the use of your business; and

b. associate that website with a .com.au website address for free period of 24 months commencing from the date of your registration of the domain name  in accordance with MYOB’s terms and conditions

c. In each case, your use of services provided by MYOB will be solely governed by the terms and conditions of use of MYOB. Some of the services being provided directly by MYOB to you are set out here for ease of reference. Google is not responsible for providing these services to you, and you will need to check in each case that you are happy with the service and the terms and conditions of service of MYOB before using those services.

4.Free website creation, domain name and hosting

a. The domain name registration, website creation and  website hosting service is provided to you by MYOB, under an agreement between Google and MYOB.

b. To create a website, you will need to click on ‘create a website now’ and follow the sign up process. You will be redirected to MYOB’s site.

c. From MYOB, you will receive:

i.  a .com.au domain name for two years, in accordance with the MYOB Atlas terms of use and auDA eligibility criteria;

ii. free 10 MB site hosting for a period of 12 months commencing from the date of your registration of the domain name;

iii. free access to MYOB’s website creation tool known as MYOB Atlas for a period of 12 months commencing from the date you first access MYOB Atlas; and

iv. free access to the MYOB Atlas comprehensive online self-service help centre for a period of 12 months commencing from the date of your registration of the domain name.

d. After expiry of any free periods provided by MYOB, MYOB will offer you the ability to enter into a further contract for the services (subject to MYOB continuing to provide the services beyond the initial applicable free period and MYOB’s terms and conditions). MYOB is responsible for notifying you of any renewal fees that apply after the expiry of the relevant free periods and the consequences of non-renewal.

e. Google is not responsible for registering your domain name, creating your website, hosting your website or ensuring the continuance of the domain name in your name.

f. Your agreement with MYOB for the services they will provide is bound by their terms and conditions which can be found here: www.myobatlas.com/termsandconditions and http://www.myobatlas.com/termsofuse

g. You may also have the option to use services provided by Google such as Google Places, Google AdWords and Google Analytics. The use of those services will be governed by Google’s terms and conditions that apply to that particular service.

h. You may also have the option to use services provided by other partners. The use of those services will be governed by the partner’s applicable terms and conditions.

5.Restrictions

a. You agree not to:

i. Use the web site creation service or domain name registration service for any purpose other than to promote your business;

ii. Ask for more than one free domain name through the Getting Aussie Business Online site;

iii. Knowingly permit anyone to ask for a second domain name to promote the same business;

iv. Use your free domain name for any other purpose than to promote your business;

v. Sell your free domain name or the website created through the Getting Aussie Business Online service for money or money’s worth, except in the context of selling your business as a going concern.

vi. Use any services provided by Google in breach of any of the terms and conditions for the use of those services.

6.Data protection and privacy

a. Any data including personal data which:

i. you enter into a website run by Google (including www.gettingbusinessonline.com.au) will be held by Google subject to Google’s privacy policy (available here: http://www.google.com/intl/en/privacypolicy.html); and

ii. you enter into a website run by MYOB (includinghttp://gabopreauth.myob.net/ will be held by MYOB subject to MYOB’s privacy policy (available here http://www.myobatlas.com/privacy, http://www.myobatlas.com/publicprivacy.)

b. MYOB and Google may share this information with each other and trusted third parties involved in Getting Aussie Business Online, in accordance with their respective privacy policies, in order to provide the services offered under GABO (including the site you create and the domain name you acquire).

c. Google, MYOB and other trusted partners may, if you have given your consent in the sign up process, contact you to help you benefit from the service and provide information about other products and services that may be of interest to you. 

d. When you request a free domain name, MYOB is obliged to provide registrant details to Aus Registry (www.ausregistry.com.au/) a body which administers .au domains. Aus Registry will make those details available through a publicly accessible record called “WHOIS” record, which you can find here: http://ausregistry.com.au

7.Changes and third party services

a. Google, reserves the right, at  its sole discretion, to change, modify, add, or delete portions of these terms at any time without further notice. If Google does this, Google will inform you by posting the new terms on the Getting Aussie Business Online site. Your continued use of the site you have created via Getting Aussie Business Online, or the Getting Aussie Business Online site after any such changes constitutes your acceptance of the new terms.

b. Google, may change the Getting Aussie Business Online site and the services offered through it from time to time without liability to you.

c. Google does not accept responsibility for or endorse any third party services offered through the Getting Aussie Business Online site.

8.Withdrawal of services.

a. If you use the Getting Aussie Business Online site or any of the services offered through the Getting Aussie Business Online site in contravention of these terms, the service terms of the specific service/product, or applicable law, the services you are being provided under this Agreement or the relevant product/service may be withdrawn from you.

b. Google and MYOB may end or suspend Getting Aussie Business Online or the Getting Aussie Business Online site at any time at their sole discretion without any liability to you. This will not affect the existence of your site.

9.  Disclaimers and Limitation of Liability.

a. To the maximum extent permitted by law,

i. but subject to 10(b) below, Google excludes all warranties, conditions, terms, representations and undertakings, other than expressly set out in this Agreement, including any implied warranty of merchantability, fitness for a particular purpose, and non infringement;

ii. Google will not be liable to you for any lost revenues, profit, or indirect, special, incidental, consequential, exemplary or punitive damages;

iii. Google’s maximum aggregate liability for any direct claim arising out of or related to this Agreement will not exceed USD$1000.

b. Certain laws of the jurisdiction in which you reside may confer rights and remedies and imply terms into this Agreement that cannot be excluded. Those rights, remedies, and implied terms are not excluded by this Agreement. To the extent that the relevant laws permit Google to limit their operation, Google’s liability under those laws will be limited at its option, to the supply of the services again, or payment of the cost of having the services supplied again.
