Terms and Conditions By entering the RACO “taste for life” Consumer Promotion Game of Skill Competition (the “Competition”), you are agreeing to the following terms and conditions:
1. STANDARD TERMS 1.1. Information on how to enter forms part of the terms of entry.
2. WHO CAN ENTER? 2.1. Subject to clause 2.2, entry is open to all residents of Australia, who are 18 years of age or over. 2.2. Employees and their immediate families of Meyer Cookware Australia Pty. Ltd are not eligible to enter.
3. HOW TO ENTER 3.1. The Competition commences on Monday 13th June 2011 at 09:30 AEST and concludes on Sunday 3rd July 2011 at 23:59 AEDT (“Competition Period”). 3.2. To enter, entrants must register their entry as follows: a) Logon to
www.everydaygourmet.tv , or
www.raco.com.au, follow the prompts, and complete the entry fields required. b) The Entrant must leave their full name, address (including postcode), email address and daytime telephone number (including STD area code). Entrants must also answer, “In 25 words or less, tell us how cooking gives you a taste for life.” 3.3. All entrants in the Competition may enter as many times as they like but may not use “scripting” for multiple entries. These will be deemed invalid. The competition is a game of skill and chance plays no part in determining the winner. 3.4. All entries must be received by 23:59 AEDT on Sunday 3rd July 2011. 3.5. Entry details remain the property of the Promoter and Sponsor and will not be returned to the entrant. 3.6. The time of entry will in each case be the time indicated in the entry as received by the RACO Cookware website address. 3.7. Entry into the Competition is free with the exception of any costs the entrant may incur for access to an internet provider, or server, is the responsibility of the entrant.
4. PRIZES 4.1. There will be a total of twenty four (24) prize winners. This will consist of twenty one (21) daily prize winners (1 per day for the duration of the competition) and three (3) major prize winners (drawn at the end of the competition period.) The prize winners will receive the prize package, as set out in clause 4.2 below. 4.2. Combined Prize Value is: $3889.80 AUD (including GST). Prize value is correct as of 10/05/2011. The Promoter accepts no responsibility for any change in prize value and the winner will not be entitled to any cash or substitute prize should any discrepancy in price occur between the date of printing these terms and conditions and the date of accepting the prize. 4.4. The winning Entrants should seek independent financial advice about any tax implications that may arise from the prize winnings. 4.5. Any additional expenses not outlined in these terms and conditions will be the responsibility of the winner. 4.6. The prize is non-transferable, non-refundable, and may not be redeemed for cash. 4.7. The Promoters accept no responsibility for any variation in the prize value. Where a prize is unavailable for any reason, the Promoters may substitute for that prize another item of equal or higher value as determined by the Promoters, subject to the approval of the gaming authorities in each state and territory, where required. 4.8. Subject to state government legislation the Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing.
5. HOW TO WIN 5.1. For the daily prize, there will be twenty one (21) winners, one per day for the duration of the competition. These will be selected from all entries received up to 09:30 AEST each day with the first draw taking place on Tuesday 14th June 2011. Each entrant who has entered the Competition and complied with all entry requirements will be entered into the pool of entries. Entrants that have already won a daily prize on previous days will be exempt from winning further daily prizes, but will re- enter the draw for the major prize. Competition entries that do not contain the information required by clause 3.2 and 3.3, or that do not otherwise comply with these terms and conditions, may be deemed to be invalid at the Promoter’s absolute discretion. 5.2. For the Major prize, there will be three (3) winners. These will be selected from all entries received during the duration of the competition period. Each entrant who has entered the Competition within the opening and closing dates and complied with all entry requirements will be entered into the pool of entries. Competition entries that do not contain the information required by clause 3.2 and 3.3, or that do not otherwise comply with these terms and conditions, may be deemed to be invalid at the Promoter’s absolute discretion. 5.3. Entries for the daily prize will be judged on the most creative and original response. The entries will be judged by the Brand Coordinator at Meyer Cookware Australia Pty Ltd. The best entry received up to this day (other than those of previous daily prize winners, if they are deemed ‘best’) will receive the daily prize. 5.4. The judging for the daily prize will take place at Meyer Cookware Australia Pty Ltd, 1-19 Merrindale Drive Croydon South VIC 3136 from 09.30 AEST each day except Saturdays and Sundays. The daily prize for Saturdays and Sundays will be judged on the Monday after. Each day’s judging will be for the previous day’s prize and will include all entries received up to the time of judging, 09:30 AEST. 5.5. The judging for the major prize will take place at Meyer Cookware Australia Pty Ltd, 1-19 Merrindale Drive Croydon South VIC 3136 from 09:30 AEST on Monday 4th July, 2011. 5.6. Entries for the major prize will be judged on the most creative response that best fits the RACO brand profile of easy, practical, stylish, fun, affordable and modern. The winners will be judged by the Brand Coordinator at Meyer Cookware Australia Pty Ltd. 5.7. The winners will be notified by phone call or email within two (2) days of the draw, both for daily prizes and major prizes and a letter advising the winner of their prize and delivery timeframe will also be sent. Winners of the major prize (3 winners) will have their name published in The Australian newspaper. 5.8. The Promoter may in its absolute discretion deem entries invalid subsequently to a Winner being notified or a Winner’s name being announced if it is discovered that the winner did not enter the Competition in accordance with these terms and conditions. In these circumstances, an additional draw will be conducted. 5.9. The promoter’s decision is final and the promoter will not enter into correspondence regarding the result. 5.10. It is a condition of accepting the prize that the winner (and any companions) must comply with all conditions of use of the prize and also the prize supplier’s requirements. 5.11. Subject to relevant legislation, if any winner is not contactable an unclaimed prize draw will take place at Meyer Cookware Australia Pty Ltd, 1-19 Merrindale Drive Croydon South VIC 3136 from 09:30 AEDT on 3rd October 2011. The winner of any redraw will be notified by email and mail. The original winner will forfeit the prize and have no further claim as of this date.
6. NO LIABILITY 6.1. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions. 6.2. Meyer Cookware Australia Pty Ltd and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail. 6.3. Meyer Cookware Australia Pty Ltd. and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur: a) during the judging; b) as a consequence of late, lost or misdirected mail; c) due to the publication of any material, including any statements made by any compare, staff member, journalist, other entrants or any other person. d) in relation to failure of an entry message to be received by the Promoter on account of technical problems or traffic congestion; or e) arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this promotion.
