COUNTRY MUSIC CHANNEL “JOHN WILLIAMSON” COMPETITION
TERMS AND CONDITIONS

ENTRY INTO THE COMPETITION

1. Entry into the Country Music Channel “JOHN WILLIAMSON” competition (the “Competition”) is open to all residents of Australia. The Promoter is XYZnetworks Pty Limited (ABN: 71 066 812 119) of Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 (the “Promoter”).  Information on how to enter forms part of the terms of entry.  Entry into the Competition is deemed acceptance of these terms and conditions.

2. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, FOXTEL, AUSTAR, Optus TV and their related bodies corporate are not eligible to enter.

3. Competition begins at 10.00am (AEST) on Monday 16 May 2011 and closes at 11.59pm (AEST) on Sunday 26 June 2011 (the “Competition Period”).

4. To enter the Competition and be eligible to win, entrants must:

a) register for membership online at www.countrymusicchannel.com.au;
b) complete the online entry form; and
c) in 25 words or less answer the following question “Which of John Williamson’s song touches your heart the most and why? (the “Competition Question”).

5. All entries must include the entrant’s name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth.  All entries must be original and must not incorporate material which has been previously published. Incomplete entries or those which, in the opinion of the Promoter, infringes the intellectual property rights of any third party, contains any objectionable content, profanity or is potentially insulting, inflammatory or defamatory will be ineligible to win the Prize. It is each entrant’s responsibility to inform the Promoter if his/her residential address, email address or phone number changes during the Competition Period.

6. Only one entry per person is permitted for this Competition. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify that entrant without notice.

PRIZE

7. There are 21 Prizes in total which consist of 1 x Major Prize and 20 x Minor Prizes in total.  The Major Prize and the Minor Prizes are together referred to as “the Prizes”.

a) The Major Prize, valued at $1410 maximum (inclusive of GST) consists of:

• Return economy airfare to Sydney, NSW for the Major Prize winner and a Guest from the Major Prize winner’s nearest capital city, valued at a maximum of $1000;
• One night’s twin-share accommodation in a 5 star hotel, valued at a maximum of $350;
• Attend a private meet-and-greet session with John Williamson, a money-can’t-buy experience; and 
• A John Williamson 3-CD pack, valued at a maximum of $60.

(the “Major Prize”) 

b) Each Minor Prize consists of a John Williamson 3-CD pack, valued at a maximum of $60.
 
(The “Minor Prizes”).

8. The dates of travel, accommodation and the meet-and-greet component of the Major Prize will be confirmed at a later date with the Major Prize winner and will be subject to the artist’s availability.

9. The total maximum Prize pool value is $2610.00 (1 x Major Prize valued at $1410.00 and 20 x Minor Prizes with a total value of $1200.00).The Prize values are the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed.  All Prize values are in Australian dollars.

10. It is a condition of accepting the Prizes that the Prize winners must comply with any conditions of use of the Prizes and the Prize supplier’s requirements.

11. The Prizes are not transferable or redeemable for cash. The Prizes or any element of the Prizes cannot be exchanged for any other Prizes. The contents of the Prizes will be at the Promoter’s sole discretion. The Prizes are subject to availability and the terms and conditions of the entities supplying the Prizes. (If there is a choice of prize include this sentence) The dates and venues selected by entrants can not be changed at a later date.

12. Only one Prize per person will be awarded.

JUDGING AND AWARD OF PRIZE

13. The Competition will be judged on the basis of creativity at Country Music Channel, Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 on Monday 27 June 2011 at 10am (AEST). Chance plays no part in the selection of the Prize winners. The Prize winners will be notified by phone or email on Tuesday 28 June 2011 and their names will be published on the Country Music Channel website from Tuesday 28 June 2011. The Prize must be claimed within 7 days of the publication of the Prize winners’ names.
14. If a Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize.

AGE

15. In the event that the Major Prize winner is less than 18 years of age, the Major Prize winner must be accompanied by his/her parent or a legal guardian over the age of 25. The parent or legal guardian must accompany the Major Prize winner at all times throughout the conduct of the Major Prize. The parent or legal guardian will be considered as the travelling companion (“Guest”) of the Major Prize winner (i.e. the Major Prize winner will only be able to bring their parent or legal guardian as their Guest).

TRAVEL

16. It is the sole responsibility of the Major Prize winners and his/her Guest to ensure that their personal documentation (including but not limited to passports, Visas etc) is valid. Any expenditure incurred as a result of not meeting such requirements is the sole responsibility of the Major Prize winner and his/her Guest. Travel insurance is advisable for the Major Prize winner and his/her Guest, though all such arrangements are the sole responsibility of the Major Prize winner and his/her Guest. 

17. In the event that the Major Prize winner is a resident of Sydney, NSW, (which shall be determined in the absolute discretion of the Promoter), the flight component of the Major Prize will be forfeited in full and no substitute will be offered.

18. All ancillary costs incurred in taking and using the Major Prize (including but not limited to transfers to and from the airport in the Major Prize Winner’s capital city, meals, mini bar, spending money, insurance and taxes) are the responsibility of the Major Prize winner and their Guest. Unless expressly stated as being part of the Major Prize, all other expenses are the sole responsibility of the Major Prize winner and his/her Guest.

19. All Prize winners are advised that Tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.

20. The Promoter reserves the right to refuse to allow the Major Prize winner or his or her Guest to take part in any or all aspects of the Major Prize, if the Promoter determines, in its absolute discretion, that a Major Prize winner or his or her guest are not in the mental or physical condition necessary to be able safely to participate in the Major Prize.

21. It is a condition of accepting the Major Prize that the Major Prize winner and his/her Guest agree to sign a legal release in a form determined by the Promoter in its absolute discretion, if requested by the Promoter.

GENERAL
       
22. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that a Prize winner cannot provide suitable proof, that Prize winner will forfeit the Prize in whole and no substitute will be offered.

23. By entering the Competition, each entrant warrants that their entry is their own original work, and that they own all rights (including copyright) in their entry. Each entrant indemnifies the Promoter for any costs or loss incurred by the Promoter as a result of this warranty being false or incorrect.

24. No responsibility will be taken by the Promoter, the Country Music Channel, FOXTEL, AUSTAR or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winners from winning the Prizes.

25. The Promoter reserves the right, in its absolute discretion, to disqualify:
a) any entry which, in the opinion of the Promoter, includes any objectionable content, profanity or is potentially insulting, inflammatory or defamatory; or
b) any individual who tampers with the entry process, submits an entry that is not in accordance with these Terms and Conditions or who has in the opinion of the Promoter, engaged in unlawful or improper conduct that is designed to jeopardise the fair and proper conduct of the Competition or is generally damaging to the goodwill or reputation of the Promoter.

26. The Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prizes to cancel or vary the Competition or to vary or cancel the award of the Prizes including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion):
a) a Prize winner does not satisfy the Competition entry requirements; or
b) the Promoter cannot conduct the Competition or award the Prize/s for any reason beyond its control.
27. In the event that the Promoter cancels or varies the Competition or varies or withdraws any of the Prizes it shall not:
a) be liable to any person for any costs, loss or damage (including costs, loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; or
b) be required to conduct the Competition at any other time.
28. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.

29. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.

30. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Prize or entering the Competition.

31. The Promoter collects entrants’ personal information (as that term is defined in the Privacy Act 1988 (Cth)) for the purpose of conducting and promoting this Competition (including, but not limited to, determining and notifying winners). Entrants are advised that their personal information may be disclosed to State and Territory lottery departments and their names as the winner may be published as required under the relevant lottery legislation. Entrants are also advised that from time to time, the Promoter may disclose your personal information to third parties (including, but not limited to, third party prize providers) for the purpose of administering prizes or for other purposes contemplated in these Terms and Conditions.

32. By entering the Competition, all entrants agree that their name, image, biography and entries (including, but not limited to, any written answers, photographs/images and audio-visual recordings) may be reproduced, published, communicated, broadcast or shown to the public by the Promoter in any media for its promotional purposes, without compensation to the entrants, subject to the Promoter’s privacy policy which is available at www.countrymusicchannel.com.au; for this purpose, each entrant grants to the Promoter a non-exclusive, perpetual, worldwide, and royalty-free licence in any such written answers, photographs /images and audio-visual recordings. Each entrant consents to any act or omission by the Promoter which may infringe any of the entrant’s moral rights (within the meaning of the Copyright Act 1968 (Cth)), including: i) failing to attribute (or correctly attribute) the entrant’s authorship of the entry; or ii) making any modification, variation or amendment of any nature to the entry, whether or not it results in a material distortion or derogatory treatment of the entry.

33. In addition to the consent set out above, If you are selected as a Prize winner, you grant to the Promoter an exclusive, irrevocable, perpetual, worldwide, transferable, and royalty-free licence to your winning entry (including, but not limited to, any written answers, photographs/images and audio-visual recordings) for the Promoter’s use for all purpose without restriction and in any media (now known or devised in the future). The only exception to the Promoter’s exclusive right to use the entry is for your own private (i.e. no public communication), personal, and non-commercial use.

I keep getting an error message when I try to submit my form and have notified them of this.
