World Engineers' Convention 2011:Engineers Power The World - Facing The Global Energy Challenge

Participation

1. This competition ("Competition") is conducted by The Institution of Engineers Australia - National Office, ABN 63 020 415 510, trading as Engineers Australia, of Engineering House, 11 National Circuit, Barton ACT 2600 ("Promoter").

2. Entry to the Competition constitutes acceptance of these conditions.

3. The Competition is only open to Eligible Entrants. An "Eligible Entrant" is an individual who: (i) is a resident of Australia aged 18 years, or older, as at the time of entry; (ii) is a Member of Engineers Australia; and (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iii) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.

4. Competition entry opens at 8am on 9/5/11 and closes at 5pm on 30/6/11 ("Entry Period"). All and dates are times and dates in Sydney which may be AEST or AEDT depending on the date.

Entry

5. To enter, an Eligible Entrant must, during the Entry Period, use an Engineers Australia Card from American Express that has been issued to the entrant as the primary card holder to pay for the renewal of his/her Engineers Australia Membership during the 2011/2012 financial year. Where payment is made in person at an Engineers Australia office, that payment is deemed to have been made during the Entry Period provided the Member signs the card authorisation during the Entry Period.

6. All entries to the Competition may be subject to verification by the Promoter. The Promoter will reimburse an entrant for any reasonable costs incurred in complying with this condition. An entrant MUST deliver to the Promoter (by a means determined by the Promoter) copies of any documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document.

7. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Competition to the Promoter's reasonable satisfaction; or (ii) fails to produce items as required by condition 6 or produces items that, in the Promoter's reasonable opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's reasonable opinion, tampers with the entry process or benefits from such tampering; or (iv) in the Promoter's reasonable opinion, is awarded an entry which is not in accordance with these conditions.

Draw and Prize

8. The draw will be held at 3pm on 14/7/11 at Suite 205, 22 Mountain St, Ultimo NSW 2007.

9. The Eligible Entrant whose entry is the first valid entry drawn will win a trip to World Engineers Convention 2011 in Geneva (the "Prize"), valued at a maximum of A$23,000.

10. The Prize comprises, for its winner and, subject to condition 12, one guest of his/her choice:
(i) return business flights to Geneva from the Australian State or Territory capital city nearest to the winner's place of residence and return ground transfers between Geneva and the Accommodation;
(ii) 7 nights twin share accommodation at the Intercontinental Hotel (five star) in Geneva ("Accommodation");
(iii) buffet breakfast at the Accommodation;
(iv) a pass (for each of the winner and his/her guest) to enter the World Engineers Convention 2011 at The International Conference Centre, Geneva, from 4/9/11 to 9/9/11 ("Event");
(v) a two hour hot air balloon ride in central Switzerland ("Balloon Ride").

11. The winner and guest will depart Australia on 2/9/11 and return on 11/9/11.

12. All aspects of the Prize (including travel and accommodation) are for the winner and one guest travelling together. The winner of the Prize is free to select any person as a guest, provided that the Promoter may require the guest to confirm in writing that they agree to comply with the provisions of these conditions relating to guests (see condition 26).

13. Once tickets have been arranged by the Promoter, changes to the travel or accommodation arrangements are at the expense of the Prize winner.

14. All components of the Prize must be taken together as a single trip to be booked by the Promoter. Any part of the Prize that is not taken for any reason is forfeited.

15. The Prize does not (except as expressly stated) include:
(i) any transport between a traveller's residence and the departure airport;
(ii) any overnight accommodation while travelling to the departure airport or destination;
(iii) any other travel or accommodation;
(iv) any meals;
(v) any incidental hotel charges (such as mini-bar charges, telephone calls, in house movies, food and beverages);
(vi) any spending money;
(vii) any insurance (such as travel or health cover);
(viii) any costs associated with any passport, visa, health or other requirements for entry into any foreign country and return to Australia. (Departure taxes and other flight related taxes are included in the Prize);
(ix) any vaccinations or other medical or health related services;
(x) any other ancillary costs which may be incurred by the winner or his/her guest in relation to the Prize.

16. The Prize cannot be exchanged for other travel or accommodation at other destinations.

17. The winner of the Prize and his/her guest are responsible for compliance with any health, passport, visa and other requirements for entry into Switzerland, any country en-route and return to Australia and bear all risks associated with any refusal of entry into any country. No compensation will be payable if the winner or a guest is unable to use the Prize (or any part of it) as stated for whatever reason.

18. The Prize is valued as at 21/4/11. The Promoter takes no responsibility for any variations in value of the Prize.

19. If the Prize (or part of the Prize) is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if the Prize (or part of the Prize) is unavailable for any reason.

20. A right to receive the Prize is not transferable or exchangeable and cannot be taken as a monetary payment.

21. Unless expressly stated in these conditions, all expenses incurred in relation to enjoyment of the Prize are the responsibility of the winner.

22. The Balloon Ride is provided through a voucher that is redeemable through a third party. The Promoter excludes any liability if the voucher is lost, stolen, damaged or tampered with in any way. The redemption of the voucher is subject to the terms and conditions imposed by the issuer of the voucher from time to time.

Winner

23. The winner, whenever determined, will be notified by telephone, and in writing sent by post or email. The notification will include instructions as to how the winner is to claim the Prize and establish his/her entitlement to it.

24. The name of the winner will be published in The Australian on 21/7/11 and at www.engineersaustralia.org.au within 7 days of the draw for at least 1 week.

25. Subject, where relevant, to any directions given under the legislation regulating the Competition, if the Prize is not claimed by 27/7/11 the Prize will be awarded to another Eligible Entrant in a redraw commencing at 3pm on 28/7/11 at Suite 205, 22 Mountain St, Ultimo NSW 2007. If there is a redraw, the name of the winner in the redraw will be published in The Australian on 4/8/11 and at www.engineersaustralia.org.au within 7 days of the draw for at least 1 week.

26. In order to be entitled to any Prize, the winner (and the person accompanying the winner on the Prize trip must, if requested by the Promoter, agree to and sign and return:
(i) an eligibility form confirming their compliance with the Conditions and eligibility to accept the Prize and/or participate in the Prize; and
(ii) a liability release, waiver and/or indemnity in favour of the Promoter and/or any person or other entity associated with this Competition.

If the winner's guest on the Prize trip is under 18 years of age, the winner must ensure that a parent or guardian of any guest under 18 years of age agrees to and signs the documents referred to above (if requested by the Promoter). A winner will forfeit his/her Prize if he/she fails to ensure that all documents relating to that Prize (or participation in that Prize) are signed and returned in accordance with this condition, as and when required by the Promoter.

General

27. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.

28. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition.

29. All of the Promoter's decisions are final and no correspondence will be entered into.

30. The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Competition. Entrants should obtain independent tax and financial advice.

31. To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant or the winner's guest on the Prize trip in connection with the Competition or Prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify an entrant's rights under the Competition and Consumer Act 2010.

32. If any provision of these conditions is unenforceable for any reason, it will be severed and the remaining provisions will remain in full force and effect.

33. Entrants' personal information and that of any winner's guest on the Prize trip will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winner. The personal information of the winner and any winner's guest on the Prize trip may be provided to others assisting in the conduct of the Competition, including the Competition administrator, Prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter by post at the address stated in condition 1 or by calling 1300 653 113 during business hours to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a Prize.
