following terms and conditions:
1. GENERAL INFORMATION
1.1 Information on how to enter this competition forms part of the terms of entry.
1.2
The competition commences on Monday 20 June 2011 at 00:01 AEST and concludes Thursday 23
June 2011 at 15:00 AEST (the âPromotion Periodâ)1.3 The competition will be advertised on Network TEN during The Circle and on the TEN website
www.ten.com.au/thecircle.
2. ENTRY ELIGIBILITY
2.1
Entry is open to all residents of Australia 18 years old or over.2.2 Employees and their immediate families of Network Ten Pty Ltd and their associated agencies and
companies associated with the Promotion are not eligible to enter.
2.3 Entrants are required to register and log into
www.ten.com.au/thecircle in order to submit their entry.
Viewers may register to become a member of TEN via the website. It is free to become a member,
however the cost of accessing the promotional website is dependent on the entrantâs individual service
provider. These Terms and Conditions apply in conjunction with the TEN Members rules.
3. HOW TO ENTER
3.1 To enter, participants will be required to sign into
www.ten.com.au/thecircle and complete the online
entry form.
3.2 Entrants will be required to submit their details including (but not limited to) full name, full address,
phone number, email address, date of birth and answer the entry question correctly.
3.3
A limit of one online entry per day is permitted and all entries must be received within the PromotionPeriod.
3.4 The Promoter accepts no responsibility for any late, lost or misdirected entries including entries not
received by the Promoter or delays in the delivery of the entry due to technical disruptions, network
congestion or for any other reason.
3.5 Incomplete or incomprehensible entries will be deemed invalid.
4. GRAND PRIZE DETAILS4.1
The Grand Prize comprises of 1 x major winner receiving a trip for 2 adults to the Gold Coast
including:
- 2 x nights twin share accommodation in a luxe Lagoon View Suite at the Palazzo Versace hotel (5
stars) in Queensland maximum value $3,195
- 2 x premium economy return flights from winnerâs closest capital city to the Gold Coast maximum
value $2,000 (including flight taxes and surcharges)
- Airport transfer in the Gold Coast (included within accommodation value)
- An extended (1 hour) spa treatment for two (included within accommodation value)
- Champagne on arrival (included within accommodation value)
- Dinner for two with degustation menu and matching wines at Vanitas Restaurant valued at $500
- $500 AUD spending money
- 12 x bottles of Palmolive Heavenly Vanilla Body Butter Body Wash valued at $80
Total Grand Prize is valued at up to $6,275 (including GST) depending on the winnerâs point of
departure.4.2 The Grand Prize cannot be transferred nor exchanged and is not redeemable for cash.
4.3 If the winner resides around the Gold Coast then the flights do not form part of the prize and the
winner and their companion must make their way to the hotel.
4.4 The Grand prize winner and their companion must travel together on the same flights and stay
in their allocated accommodation.
4.5 The Grand prize winner and their companion may not use âFrequent Flyerâ points from any airline on
the travel prize and cannot upgrade any travel prize using âFrequent Flyerâ points.
4.6 It is the winnerâs responsibility to ensure that they have valid travel documentation which meet
the requirements of government authorities at every destination. Any fines, penalties, payments
or expenditures incurred as a result of such documents not meeting the requirements of those
authorities will be the sole responsibility of the travellers.
4.7 Unless otherwise stated, the winner (and their travelling companion) are responsible for all other
expenses including spending money, meals, transportation, drinks, transfers, accommodation
upgrades, meal upgrades, mini-bar, laundry charges, room service, telephone calls, travel insurance,
gratuities, service charges, activities (other than specified), incidentals and all other ancillary costs.
Travel insurance is highly recommended to protect against the additional costs incurred in the event of
unforeseen circumstances.
4.8 The winner must be available to take up this prize in whole by 31 December 2011 and is subject to
hotel and flight availability. Flights are for domestic travel only. The prize is not available during peak
times such as public holidays and school holidays and cannot be changed once the booking has been
made.
4.9 The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the
prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or
physical condition necessary to be able to safely participate in the prize.
4.10 A credit card imprint or cash deposit will be required from the winner at check-in into the hotel for any
incidental charges. Once accommodation is booked its non-changeable.
4.11 Legal aged consumers should be advised to consider the safe drinking levels recommended in the
National Health and Medical Research Council Australian Alcohol Guidelines that are available at:
http://www.alcohol.gov.au/4.12 If for any reason an element of the prize becomes unavailable, which is out of the Promoters control
then a similar prize to equal value will be awarded, subject to State Regulation.
4.13 In the event that for any reason whatsoever a winner does not take an element of the prize at the time
stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will
not be awarded in lieu of that element of the prize.
4.14 The winners and their companion agree they will not sell or otherwise provide their story and/or
photographs to any media or other organisation.
4.15 Network TEN and itâs associated agencies make no representation as to the safety, conditions or other
issues that may exist at any destination. International travel advice can be obtained from various
sources, including government, local consular offices and the web site of the Australian Department of
Foreign Affairs and Trade.
4.16 Once prizes have left the Promoterâs premises, the Promoter takes no responsibility for prizes
damaged, delayed or lost in transit.
4.17 Prize values are based upon the full fare price at the time of printing in the relevant brochure (inclusive
of GST). The Promoter accepts no responsibility for change in prize value between now and the
ultimate prize redemption date.
4.18 Independent financial advice should be sought as tax implications may arise as a result of accepting
the prize.
5. PRIZE DRAW
5.1 Each valid entrant who has entered the competition over the duration of the Promotional Period will be
entered into the draw. One valid entrant will be drawn at random to become the major winner.
5.2 The major prize draw will take place at the premises of Be.interactive Pty Ltd, Level 2, 116 Miller
Street, North Sydney NSW 2060 on Thursday 23 June 2011 at 15:30 AEST.
5.3 The winner will be notified within 2 days of the draw. The winner will be notified of their prize in writing.
The major winnerâs details will be published in the public notes section of The Australian on Monday
27 June 2011.
5.4 The Promoter reserves the right to request winners to provide proof of identity, proof of residency at
the nominated prize delivery address and/or proof of entry validity (including phone) in order to claim a
prize. Proof of identification, residency and entry considered suitable for verification is at the discretion
of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the
prize in whole and no substitute will be offered.
5.5 The prize will be awarded to the person named in the entry. Should an entrantâs contact details
change during the Promotion Period, it is the entrant's responsibility to notify the Promoter. A request
to access or modify any information provided in an entry should be directed to Promoter.
5.6 The Promoter will try to contact the major winner but if the prize remains unclaimed then subject to any
direction given under relevant State legislation, an unclaimed prize draw will be conducted at the
premises of Be.interactive Pty Ltd, Level 2, 116 Miller Street, North Sydney NSW 2060 on Monday 10
October 2011 at 10:00 AEDT.The winner will be notifed in writing within 2 days of the draw and
published in The Australian Monday 17 October 2011.
5.7 The Promoterâs decision is final and the Promoter will not enter into correspondence regarding the
Competition result.
6. STANDARD TERMS
6.1 The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the
opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or
defamatory statements, disqualify any entrant who tampers with the entry process, who submits an
entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of
Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or
generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter
reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the
winnerâs entry are of a type described in this clause.
6.2 It is a condition of accepting the Grand Prize that the winner must comply with all the conditions of use
of the prize and the prize supplierâs requirements. It is also a condition of accepting the prize that the
winner may be required to sign a legal release in a form determined by the Promoter in its absolute
discretion
6.3 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders
the Promoterâs ability to proceed with the competition on the dates and in the manner described in
these terms and conditions, including but not limited to vandalism, power failures, tempests, natural
disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute
discretion cancel the competition and recommence it from the start on the same conditions, subject to
any written directions given under State Regulation.
6.4 Network Ten Pty Ltd and the prize sponsor or provider shall not be liable for any loss or damage
whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any
personal injury suffered or sustained in connection with any prize/s except for any liability which
cannot be excluded by law. The Promoter and itâs sponsor is not responsible for any incorrect or
inaccurate information, either caused by the entrant or for any of the equipment or programming
associated with or utilised in this competition, or for any technical error, or any combination thereof
that may occur in the course of the administration of this competition including any omission,
interruption, deletion, defect, delay in operation or transmission, communications line or telephone,
mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
6.5 The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has
reason to believe has breached any of these conditions, or engaged in any unlawful or other improper
misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoterâs legal
rights to recover damages or other compensation from such an offender are reserved.
6.6 Network Ten Pty Ltd and their associated agencies , companies and sponsor assume no responsibility
for any error, omission, interruption, deletion, defect, delay in operation or transmission;
communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and
reserve the right to take any action that may be available.
6.7 If for any reason this competition is not capable of running as planned, including due to infection by
computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes
beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or
integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to
disqualify any individual who tampers with the entry process, take any action that may be available,
and to cancel, terminate, modify or suspend the competition, subject to any written direction given
under State Regulation.
6.8 All entries become the property of The Promoter. The Promoter collects personal information about
you to enable you to participate in this promotion but no further use of this information will be made
without prior consent
6.9 Entrants may choose opt-in to receive further information from the Promoter, and their associated
agencies and companies if they check the appropriate check box on the competition form. All opt-in
entries will be entered into a database and The Promoter may use the entrantâs names, addresses
and telephone numbers for future promotional, marketing and publicity purposes in any media
worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By
opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer
consent to their details being used for future marketing purposes, the entrant should contact The
Promoter on their details set out below. Any request to update, modify or delete the entrantâs details
should be directed to The Promoter.
6.10 The Promoter, is collecting the entrant's personal information for the purpose of conducting and
promoting this competition (including but not limited to determining and notifying winner). The entrant's
personal information may be disclosed to Beinteractive for this purpose. If you are not willing for this to
occur you cannot participate in the Promotion.
6.11 Entrantsâ personal information may be disclosed to State and Territory lottery departments and
winnersâ names published as required under the relevant lottery legislation. A request to access,
update or correct any information should be directed to the Promoter.
