BREAKA "LIKE US FOR OUR MONEY" PROMOTIONHOW TO ENTER
I. To be eligible to enter, individuals must be subscribed to the Facebook social network and be a fan
of the Breaka flavoured milk page.
II. To enter, individuals must:
a) Visit the Breaka Facebook Page (
http://www.facebook.com/Breaka.Flavoured.Milk) during the Promotion period
and select the ‘like’ button (if not already a fan of the Page);
b) Complete the online entry form, and then invite as many friends as they choose to enter, via either:
i) Posting of a specially-generated URL unique to that individual, to the individual’s wall.
Or
ii) Sharing of a specially-generated URL, unique to that individual, on other selected friends’ walls.
III.
Every ten (10) unique entries received from an individual’s URL, will generate a reward of a $10Breaka EFTPOS card. EFTPOS cards will only be rewarded for increments of ten (10) friends entering
the promotion.
TERMS AND CONDITIONS1. Information on how to enter forms part of these Terms and Conditions. Participation in this promotion
is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents who are subscribed as a member of the Facebook social
network.
3. Entrants between 13 and 17 years old must have parental/guardian approval to enter and further,
the parent/guardian of the entrant must read and consent to these Terms and Conditions.
Parents/guardians may be required by the Promoter to enter into a further agreement as evidence
of consent to the minor entering this promotion.
4. Promotion commences on 30th June 2011 and ends when the $10,000 pool of prizes has been
reached or otherwise on a date to be determined by the Promoter, which will be indicated on the
Breaka Facebook Page (‘Promotion Period’).
5. Breaka EFTPOS cards will be issued to entrants within 3 weeks of the ending of the Promotion Period
and mailed to the entrant’s mailing address as nominated on the online entry form. EFTPOS cards
will be issued based on the number of friends entered as at the close of the Promotion Period.
EFTPOS cards will only be issued for increments of ten (10) friends entering the promotion (for
example, if ten (10) friends have entered using the individual’s uniquely-generated URL, 1 x $10
Breaka EFTPOS card will be issued. if twenty (20) friends have entered, 1 x $20 Breaka EFTPOS card
will be issued, and so forth). Where the number of friends entered is not an increment of ten, the
next lowest increment will be counted for that individual’s EFTPOS card value. There is up to $10,000
worth of EFTPOS cards to be won. EFTPOS cards cannot be used to withdraw cash.
6. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner (even if
caused by negligence) as a result of accepting and/or using the prize, except for any liability which
cannot be excluded by law.
7. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate
information, or for any loss, damage or injury, as a result of technical or telecommunications
problems, including security breaches. If such problems arise, then the Promoter may (where
necessary) modify, cancel, terminate or suspend the promotion.
8. Only one entry permitted per Facebook account.
9. The Promoter’s decision is final and no correspondence will be entered into.
10. Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach
of the above terms.
11. If this promotion is interfered with in any way or is not capable of being conducted as reasonably
anticipated due to any reason beyond the reasonable control of the Promoter, including but not
limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in
its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify,
suspend, terminate or cancel the promotion, as appropriate.
12. Any cost associated with accessing the Breaka Facebook Page website is the entrant’s responsibility
and is dependent on the Internet service provider used.
13. The Promoter accepts no responsibility for any taxation implications that may arise from the prize
winnings. Independent financial advice should be sought.
14. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or
modify the statutory consumer guarantees as provided under the Competition and Consumer Act,
as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the
States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot
by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its
respective officers, employees and agents) excludes all liability (including negligence), for any
personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect,
special or consequential, arising in any way out of the promotion.
15. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,
the Promoter (including its respective officers, employees and agents) is not responsible for and
excludes all liability (including negligence), for any personal injury; or any loss or damage (including
loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a)
any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
(b) any theft, unauthorised access or third party interference; or (c) any entry that is late, lost,
altered or misdirected (whether or not after their receipt by the Promoter) due to any reason
beyond the reasonable control of the Promoter.
16. The Promoter collects personal information in order to conduct the promotion and may, for this
purpose, disclose such information to third parties, including but not limited to agents, contractors
and service providers. Entry is conditional on providing this information. Excluding Facebook, the
Promoter may, during and immediately after the Promotion, unless otherwise advised, use the
information for promotional, marketing, publicity, research and profiling purposes, including sending
electronic messages or telephoning the entrant. Entrants should direct any request to access,
update or correct information to the Promoter. All entries become the property of the Promoter.

17. By entering the Promotion, Entrants are deemed to have consented to the Promoter contacting
them via Facebook for an indefinite period in accordance with the terms and conditions of
Facebook.
18. Entry and continued participation in the promotion is dependent on entrants following and acting in
accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at
www.facebook.com/terms.php.
19. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.
Entrants understand that they are providing their information to the Promoter and not to Facebook.
The information an entrant provides will only be used for the purposes outlined in these Terms and
Conditions. Any questions, comments or complaints about this promotion must be directed to the
Promoter and not to Facebook.
