Terms and Conditions
Information on how to enter forms part of the terms and conditions of entry. As a condition of participation and registration, the participant (‘Participant’) accepts these Terms and Conditions and any rules, policies or procedures that may be adopted by the Promoter from time to time.
The Promoter is The MOVIE NETWORK Channels Pty Ltd, Level 6, 39 Chandos Street, St Leonards NSW 2065, ABN 72 089 135 740.
The Promotion commences Monday August 1st 2011 at 12:30 (AEST) and closes on 14th Sunday August 2011 at 00:00 (AEST) (the “Promotional Period”).
Entry is open to all permanent residents of Australia,aged 18 years and over, who (i) are ‘fans’ of the Movie Network Channels Facebook page
www.facebook.com/mnctv ; (ii) are not (a) employees of, or contractors to, the Promoter or its related companies, or the Promoter’s distributors, external auditors and subscription television service providers FOXTEL, AUSTAR, OPTUS Television, SELECTV, Neighbourhood Cable, Telstra, Telstra Countrywide, including Beinteractive and their associated agencies and companies or (b) members of the immediate familyof such employees and contractors. "Immediate family" means spouse, defacto spouse, parent, natural or adopted child, and sibling (whether natural, or adopted by a parent), whether or not they live in the same household as the employee/contractor (each an “Eligible Person”).
In order to be deemed a Valid Participant and be eligible to win a prize in the August EDM Facebook Competition, entrants fan Movie Network Channels on Facebook
www.facebook.com/mnctv, click on the competition tab and register their details (including but not limited to) name, address, phone number, DOB, gender and subscription TV platform. Then answer this question in 25 words of less:
“What is the best movie you have ever seen and why?”
If a person is unable to submit their own entry or entries in the promotion due to physical disability or technical difficulties, they must notify the promoter in writing addressed to The Hangover Facebook Promotion, PO Box 107, St Leonards, NSW 2065 prior to the draw date and nominate another individual to submit the entries on their behalf. If notification is not received, and it is determined that an entrant did not submit their own entries in the competition their entries may be deemed invalid and ineligible.
There will be 1 prizes awarded for the competition. Prize is valued at $30.00 (total prize pool $35.00)
The Promoter reserves the right to request the winner to provide proof of identity, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, residency, and entry considered suitable for verification is at the discretion of the Promoter.
If the Promoter becomes aware of any Participant who supplies false or misleading information for registration or entry in the Promotion including under:
- an address which is not their permanent residence;
- an identity which is not their correct legal identity;
- multiple, differing email addresses
the entries awarded to that Participant will be cancelled and if they have received prizes, they will be recoverable by the Promoter on demand. The Promoter reserves the right to ask for any supporting documentation or evidence in order to determine the above. The Participant will not have any claim against the Promoter.
Should a Participant’s contact details change during the Promotional period, it is the Participant’s responsibility to notify the Promoter.
Each valid entry entitles the Participant to one (1) entry into the prize draw.
Only one prize per household will be awarded (SA residents are entitled to win more than one prize).
All valid entries will be judged at the Movie Network Channels premises on Monday 15th August 2011 at 14:00 (AEST) and will be posted on the Facebook page 17:00. Winners will be notified by post.
Judges’ decision is final and no correspondence will be entered into. Prizes cannot be transferred for other goods and services. Prizes cannot be redeemed for cash.
If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under the Lottery and Gaming Regulation 1993 (SA), and state permit regulation.
The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. Entries will be deemed to be accepted at the time of receipt by the Promoter. No responsibility will be taken for lost, late or misdirected entries. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
The Promoter is not liable for the cancellation of all or any part of the prizes (‘Prizes’), the Promoter reserves the right to change the Prizes at any time if the Prize or a component of the Prize becomes unavailable. The Promoter is not liable for the repair or replacement of Prizes, or components of Prizes which are defective, except for liability which cannot be excluded by law. In the case of South Australia, this condition is subject to the relevant South Australian legislation.
Incomplete, illegible or incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.
The prize is not transferable or redeemable for cash.
The Promoter accepts no responsibility for any variation in the value of the Prize. Prize values are the recommended retail value as provided by the supplier and are correct at time of printing. All prize values are in Australian dollars.
Prizes will be sent out to winners 4-6 weeks after the competition closes.
The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s, except for any liability which cannot be excluded by law.
The Promoter and its agencies and companies associated with this Promotion will take no responsibility for prizes damaged in transit.Once prizes have left the Promoter's premises, the Promoter will not be responsible for any delay in delivery, or failure of safe delivery of prizes.
This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. Entrants are providing their information to the Promoter and not to Facebook. The information provided will only be used for this Promotion.
Any questions, comments or complaints regarding this Promotion should be directed to the Promoter and not to Facebook.
The Eligible Entrant releases Facebook from any liability associated with the Promotion.
By accepting the Terms and Conditions and entering the Promotion, the Participant consents to the Promoter retaining and using the Participant’s Information for the purposes of promoting and marketing the Promoter.
By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages.
The promoter reserves the right to announce or publish the winner’s name and/or photograph for publicity purposes.
