Terms and Conditions1. WHO CAN ENTER
1.1 Subject to clause 1.2, 1.3, entry is open to all residents of Australia.
1.2 Directors, management, employees and their immediate families of Paramount Pictures, News Ticketing Pty Ltd and News Digital Media Pty Ltd and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
1.3 This competition is open to people 18 years and older and subject to film classification restrictions.
2. HOW TO ENTER
2.1 The competition commences on Monday, 1 August 2011 at 9:00AM (AEST) and concludes on Wednesday, 17 August 2011 at 5:00PM (AEST) ("the Competition Period").
2.2 To enter the competition, entrants must ‘Like’ the moshtix Facebook page and email
winners@moshtix.com.au telling us in 25 words or less what has happened to Daniel Craig that caused him to lose his memory along with their full name, address and phone number.
2.3 This competition is a game of skill, with the 5 most creative and original answers to the question receiving one laser keyboard each. Secondary prizes are 1 of 20 in season double passes to see the film.
2.4 Entrants (including winners) in the competition may enter as many times as they like, however only the most creative and original answer will be counted.
2.5 Entry to the competition is free, except for internet connection costs at the expense of the entrant.
2.6 The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries.
2.7 Incomprehensible and incomplete entries will be deemed invalid.
3. HOW TO WIN
3.1 Each entrant who has entered the competition over the Competition Period and registered all details in accordance with clauses 2 and 3 will be entered into the prize draw. All draws will take place at News Digital Media, Level 24, 175 Liverpool Street, Sydney NSW 2000 on Thursday 18 Audgust 2011 at 16:00 (AEST).
3.2 Five primary winners and 20 secondary winners will be selected from all valid entries received during the Competition Period.
3.3 The prize winners will be notified by phone and email.
3.4 The Promoter’s decision in relation to any aspects of the competition is final and the Promoter will not enter into any correspondence regarding the result.
3.5 It is a condition of accepting the prize that the winners may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
3.6 Entries not completed in accordance with these terms and conditions will not be considered valid and will not be included in the draw. Indecipherable or incomplete entries will be deemed invalid.
3.7 The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bills) in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
3.8 The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions or entry, or who has, in the opinion of the Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
3.9 Subject to any written directions given under regulation 37 of the Lottery and Gaming Regulation 1993 (SA), an unclaimed prize draw will take place at News Digital Media Pty Ltd, Level 24 175 Liverpool St, Sydney, NSW, 2000 on Mondays 29 August 2011 at 10:00 (AEST) and the winner will be notified via email.
4. PRIZES
4.1 5 x primary prizes consisting of 1 Celluon Magic Cube Laser Keyboard valued at RRP $150 each.
4.2 20 x secondary prize winners will receive an in season double pass to Cowboys & Aliens RRP $34 each.
4.3 All prizes are non-transferable, exchangeable or redeemable for cash.
4.4 The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
4.5 Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
Total prize pool is valued at AUD$1,430 (including GST).
5. TERMS OF USE OF THE PRIZE ARE:
5.1 Unless expressly stated in these terms and conditions, all other expenses included in use of the prize are not included.
5.2 All components of the prize must be taken together.
5.3 The winner must abide by the terms and conditions of any third parties. Any breach of such terms and conditions may affect the ability to receive benefits of the prize. In that case, such benefits will be forfeited.
5.4 Prizes cannot be transferred, exchanged or redeemed for cash. In the event that the winner does not take the prize in the time stipulated, then the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize. Prizes must be taken as offered and cannot be varied. Any unused portion of the prize is not-transferrable, non-refundable and non-redeemable for other goods or services and cannot be taken to cash.
5.5 The Promoter accepts no responsibility for any variations in the value of the prize as quoted in these terms and conditions and the ultimate travel date.
5.6 In participating in the prizes, the winner agrees to participate and co-operate as required in all editorial activities relating to the promotion, including but not limited to being interviewed and photographed. The winner grants the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winner (and their travelling companions) will not be entitled to any fee for such use.
5.7 The winner agrees that they will not sell or otherwise provide their story and/or photographs to any media or other organisation.
5.8 The winner must, on request by the Promoter, be able to provide evidence which, to the reasonable satisfaction of the Promoter, demonstrates that the winner is an eligible entrant (as per clauses 1.1, 1.2 and 1.3) and has complied with these terms and conditions.
6. NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to State Legislation.
6.2 moshtix (News Digital Media) and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
6.3 moshtix (News Digital Media) and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
a) During the draw;
b) Whilst undertaking any travel won on or connected with their entry into the draw;
or
c) In the participation in any prize;
d) As a consequence of late, lost or misdirected mail;
e) Due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
f) In relation to failure of an online entry to be received by the promoter on account of technical problems or traffic congestion;
g) Due to circumstances outside the Promoter's reasonable control.
6.4 moshtix (News Digital Media) and its affiliates assume no responsibility for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries, and reserves the right to take any action that may be available.
6.5 If, for any reason, this competition is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to State Legislation.
6.6 All entries become the property of the moshtix. moshtix collects personal information about you to enable you to participate in this promotion. moshtix is committed to maintaining your privacy.
6.7 Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.
