Terms and Conditions
1.This document is known as the Fathers Day Gift Card Giveaway (Promotion) Terms and Conditions (Terms and Conditions).
How to Enter
2.Information regarding how to enter forms part of these Terms and Conditions. Entry into this Promotion is deemed to be acceptance of these Terms and Conditions. The Promoters’ decision not to enforce a specific restriction does not constitute a waiver of that restriction or of the Terms and Conditions generally.
3.Entry into this Promotion is open to all Australian residents who are aged 18 years or over, other than employees and their immediate families of the Promoter and its agencies associated with this Promotion (each an ‘entrant’). ‘Immediate Family’ means spouse, defacto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the employee.
4.Only individuals may enter the Promotion. Only one entry per household is permitted.
5.The Promotion begins at 9.00am (AEST) on 26/08/2011 and closes at 11.59am (AEST) on 26/08/2011 (Promotional Period).
6.To participate in the Promotion and be eligible to receive a AUD$10 Home Timber and Hardware Gift Card an entrant must complete the registration process during the Promotional Period by logging onto
www.homehardware.com.au (Promotion Website), clicking on the promotional banner on the Promotion Website, entering the entrant’s details online and clicking the submit button on the Promotion Website.
7.The first 10,000 people to register online by following the process described in paragraph 6 will be entitled to receive a AUD$10 Home Timber and Hardware Gift Card. Entries for the Promotion are deemed to be received at the time of receipt into the Promoter’s database, not at the time of transmission.
8.Incomplete registration forms received in accordance with paragraph 7 may be determined as a valid entry by the Promoter, at its sole discretion.

After the end of the Promotional Period, the successful entrants will be notified by mail and the Home Timber and Hardware Gift Cards will be mailed to the postal address of the successful entrants as specified in the entrants’ online registration.
10.Recipients should allow up to 10 days for delivery of their Home Timber and Hardware Gift Card after the end of the Promotional Period.
11.Gift Cards are valid for 3 months only. For full terms of use relating to the Home Timber and Hardware Gift Card, please visit www.homehardware.com.au. 12.The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in the Promotion by, any person who tampers with, or benefits from any tampering with the entry process or with the operation of the Promotion or acts in violation of these Terms and Conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten, or harass any other person.
13.The number of Home Timber and Hardware Gift Cards to be given away during this Promotion is 10,000 valued at AUD$10.00 each, with the total prize pool valued at AUD$100,000.00.
14.The Home Timber and Hardware Gift Card is not transferable or exchangeable and cannot be taken as cash.
15.The Promoter may require Home Timber and Hardware Gift Card recipients to provide proof of identify, proof of age and proof of residency at the nominated delivery address and/or the Home Timber and Hardware store at which the Gift Card is redeemed may ask for this information at the time of redemption. Identification considered suitable for verification is at the Promoter’s discretion.
16.If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries, subject to the approval of the gaming authorities in each state and territory, where required.
17.The Promoter accepts no responsibility for any late, lost, incomplete, misdirected, incorrectly submitted, delayed or illegible entries, claims or correspondence whether due to error, omission, alteration, tampering, theft, deletion, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over the Internet networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.
18.The Promoter and its associated agencies and companies will not be liable for any loss (including without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death (whether or not arising from any person’s negligence) arising from or in connection with:a.this Promotion (or the cancellation or suspension thereof);
b.any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
c.any theft, unauthorised access or third party interference;
d.any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter);
e.the acceptance or use (or the attempted use) of the Home Timber and Hardware Gift Card; and/or
f.the use (or the attempted use) of any product or service purchased using the Home Timber and Hardware Gift Card;
except for any liability which cannot be excluded by the law (in which case that liability is limited to the minimum allowable by law).
19.Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage in transit to the Home Timber and Hardware Gift Card.
20.Any tax, liability or duty arising from an individual’s participation in the Promotion, is the responsibility of the participant.
21.All entries will be the property of the Promoter. The Promoter may disclose the entrant’s personal information to its contractors and agents to assist in conducting this Promotion. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the following address John Danks and Son Pty Ltd, PO BOX 156, Mordialloc, VIC 3195. The Promoter reserves the right to alter or amend these Terms and Conditions without prior notice and at the Promoter’s absolute discretion, subject to the approval of the gaming authorities in each state and territory, where required.
22.All entries will be entered into the Promoter’s database and the Promoter may use entrants’ names and addresses for future promotional, marketing and publicity purposes, if consented to by entrants on the online registration form.
23.No alteration, amendment or termination of the Promotion will affect any Gift Cards that have been issued at the time of any alterations, amendment or termination of the Promotion. The Promoter will attempt to notify members of any changes but shall not be liable in any way for failure to do so.
24.A notice shall be deemed to be given by the Promoter to the participant if it is sent to the postal or email address of the entrant appearing in the Promoter’s database.

www.homehardware.com.au26.The Promoter’s decision in relation to any aspect of the Promotion is final and binding on every person who participates, and no correspondence will be entered into.
