TERMS AND CONDITIONS


Terms and Conditions of Entry for the “Coke Personalised Can Cooler Offer" (Promotion)
1. These terms and condition of entry, including information on how to participate and prize details (Terms), apply to the Promotion and entry into the Promotion is deemed acceptance of these Terms.
2. The Promoter is Coca-Cola Amatil (Aust) Pty Ltd (ABN 68 076 594 119) of 40 Mount Street, North Sydney, New South Wales 2060 (Promoter).
3. The outlets participating in the Promotion are Coles, Bi-Lo and Pick n Pay outlets (Participating Outlets) as listed at www.CCAClubhouse.com/cokefootycancooler.
4. The Promotion will be open from 12:01am Australian Eastern Standard Time (AEST) on 1 September 2011 until the earlier of:
(a) 11:59pm AEDST on 31 October 2011; and
(b) the time and date when the stock of gifts runs out
(Promotion Period).
5. Entry in the Promotion is only open to Australian residents aged 18 years and over,
excluding:
(a) management, employees, directors and contractors of the Promoter, its related bodies corporate, the Participating Outlets and other agencies, firms or companies associated with the Promotion (including suppliers of prizes);
(b) a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 5(a) of these Terms;
(c) persons who have won a prize or prizes valued either individually or collectively at more than $5,000 (including GST) in any Promotion run by or on behalf of the Promoter, within the 12 months prior to the commencement of the Promotion Period;
(d) persons who have used or attempted to use any more than one name in order to qualify to win a promotion run by or on behalf of the Promoter (except in the case of a legal change of name); and
(e) persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter,
(Eligible Entrants). The persons referred to in paragraph 5(b) of these Terms includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion.
HOW TO ENTER
6. To be eligible to enter, Eligible Entrants must purchase a specially marked 30 x 375mL Coca-Cola, Coca-Cola Zero or diet Coca-Cola pack from a Participating Outlet during the Promotion Period, while stocks of specially marked products last, (Qualifying Purchase); and
7. To enter, Eligible Entrants must, during the Promotion Period:
(a) Sign up and become a member of CCA Clubhouse (Member) by:
(i) visiting http://www.ccaclubhouse.com/cokefootycancooler and following the links to the Promotion entry page (Registration Site); and
(ii) fully completing and submitting the online registration on the Registration Site (Registration Form), including:
(a) all details required on the Registration Form, including their First Name + Surname + Street Address + Suburb + State + Postcode + Daytime Phone + Mobile Phone + email + DOB + gender; and
(b) indicating their acceptance of these Terms;
(b) remain a Member of CCA Clubhouse for the duration of the Promotion Period, including at the time of claiming a gift;
(c) Fully complete and submit the online Promotion entry on the Online Entry Site (Online Entry Form), including:
(i) the full Eligible Product barcodes;
(ii) the full details of the Coles, Bi-Lo or Pick n Pay purchase receipt including receipt number, store number and date of the Qualifying Purchase;
(iii) all personal details required on the Online Entry Form, including their full name, address, contact telephone number & email address;
(iv) selecting their preferred Footy Can Cooler design (out of the designs available on the promotional website) and personalising with their name and team number. In the event that stocks of a particular can cooler design run out, Entrants will be required to select an alternative design; and
(v) indicating their acceptance of these Terms (Entry).
8. When an Eligible Entrant submits an Entry during the Promotional Period:
(a) which complies with these Terms, they will receive an onscreen notification confirming that their Entry is valid and has been received; or
(b) which does not comply with these Terms, they will receive an onscreen notification that their Entry is invalid,
whichever is applicable in the circumstances.
9. Stocks of gifts available for distribution are strictly limited to the quantities specified in clause 12 below.
GIFTS
10. The first 102,500 valid Entries received during the Promotional Period will be awarded a personalised Footy Can Cooler (featuring the design of the available AFL or the NRL team selected by the entrant at the point of entry), valued at $9.95 RRP (incl. GST). Footy Can Coolers will be personalised with the Eligible Entrant’s name and team number and will be the final design selected by the Eligible Entrant at the point of entry. Can cooler designs will reflect the AFL and NRL team style/design of the AFL/NRL Teams’ Jerseys/Guernseys, with the exception of the team style/design of the following NRL teams:
 Canterbury-Bankstown Bulldogs;
 Sydney Roosters;
 Cronulla Sharks;
 Melbourne Storm; and
 West Tigers;
where only the colours of the relevant teams (and not the style/design of the Jersey/Guernsey) will be used in the can cooler design.
11. No obscene or inappropriate material will be printed on the Can Cooler. All personalisation requests are subject to approval by the Promoter. Footy Can Coolers will be delivered to successful Eligible Entrants within 28 consecutive days of Entry submission.

13. Total value of all gifts is $1,019,875 RRP (incl. GST).
VERIFICATION
14. If requested by the Promoter, Eligible Entrants must produce, within the time requested by the Promoter at its absolute discretion:
(a) appropriate photo identification or other documentation, required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim a gift and compliance with these Terms; and
before the Promoter issues their gift. If the items required by the Promoter are not received or an Entry has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the Eligible Entrant’s Entry will be invalid and, at the Promoter's absolute discretion, all of the Eligible Entrant’s remaining Entries will be invalid. [Gifts will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction.
GENERAL
15. The following limits on entry are applicable:
(a) each Qualifying Purchase counts towards one Entry only.
(b) a maximum of two (2) Entries per purchase receipt are permitted, regardless of the number of Eligible Products (in excess of two (2)) purchased on that receipt; and
(c) a maximum of six (6) claims are permitted per household; and
(d) Stocks of gifts are strictly limited (as specified in clause 12 above).
Each Eligible Entry must be submitted separately and in accordance with these Terms.
16. Eligible Entrants can only enter the Promotion in their own name.
17. Gifts are not transferable, exchangeable or redeemable for cash. Gifts must be taken as offered and may not be varied.
18. The Promoter shall not be liable for gifts being lost, stolen, damaged or tampered with in any way before they reach the Eligible Entrants.
19. If the Promoter is unable to provide the nominated gift, the Promoter reserves the right to supply an alternative gift of similar monetary value to the nominated gift, subject to approval by the relevant regulatory authorities.
20. The Promoter accepts no responsibility for any Entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected Entries. The Promoter does not warrant that the entry mechanism will be available, or the Participating Outlets will be open, at all times during the Promotion Period.
21. If, for any reason, the Promotion is not capable of being run as planned, including due to infection by infection by computer virus, bugs, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, including cancelling, terminating, modifying or suspending the Promotion, subject to approval by the relevant regulatory authorities.
22. Any Eligible Entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to receive a gift.
23. Incomplete, illegible, indecipherable or incorrect Entries will be invalid.
24. The Promoter reserves the right to disqualify Entries in the event of non-compliance with these Terms. The Promoter's decisions in relation to all aspects of the Promotion are final and binding on each Eligible Entrant and no correspondence will be entered into.
25. The Promoter collects (and the Participating Outlets collects on the Promoter's behalf) personal information about entrants to include entrants in the Promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant cannot participate in the Promotion. By participating in the Promotion, each Eligible Entrant consents to the Participating Outlets disclosing their personal information to the Promoter and the Promoter using, and disclosing their personal information to the Promoter's related entities, the Promoter's agencies and other third parties engaged to provide services in connection with the Promotion (including suppliers of gifts for use for, the following purposes:
(a) contacting the entrant in relation to the Promotion;
(b) improving the Promoter's or the Promoter's related entities' goods and services; and
(c) in the Promoter's and its agencies case, the purposes set out in the Promoter's privacy policy (available by writing to the Promoter at the address set out in paragraph 2 of these Terms).
The Eligible Entrant provides this consent until such a time as they withdraw their consent by giving notice to the Promoter. Eligible Entrants can also gain access to, update or correct any personal information held by the Participating Outlets by contacting the Participating Outlets. All personal information will be stored at the office of the Promoter and/or the Participating as the case may be.
26. By entering the Promotion, entrants agree and acknowledge:
(a) they may be contacted by the Promoter (or an agent of the Promoter) to provide comments about the Promotion and the Promoter (or an agent of the Promoter) may take photos or recordings of them;
(b) the Promoter may use any comments obtained from them, their name, and/or likeness and any photos or recordings taken of them (the Materials) for the Promoter's future promotional and marketing purposes without further reference or compensation to them;
(c) the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at anytime, anywhere, and by any means (including communicating them to the public in any media, including media not yet in existence). The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
(d) they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose it determines;
(e) they unconditionally and irrevocably:
(i) consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given (Moral Rights); and
(ii) waive all Moral Rights in the Materials that arise outside Australia; and
(f) they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.
27. Eligible Entrants may, at the time of entering the Promotion, consent to receive commercial electronic messages and CCA Marketing Communications (as defined in this clause) from the Promoter by checking the tick box next to the following message: "I would like to sign up to receive information on special offers, exclusive competitions, and more from the Coca-Cola Amatil group of companies, Pacific Beverages Pty Limited and its related entities " (Express Consent). Where an Eligible Entrant provides Express Consent, the Promoter will use the information provided by the Eligible Entrant on the Entry Form to send the Eligible Entrant further communications in relation to special offers, exclusive competitions, news and event information in relation to the Promoter's product range (CCA Marketing Communications). Eligible Entrants who do not provide Express Consent will not receive CCA Marketing Communications. Eligible Entrants may unsubscribe from the CCA Marketing Communications at anytime. For the avoidance of doubt, an Eligible Entrant does not have to provide Express Consent in order to enter the Promotion.
28. The:
(a) Promoter, the Promoter's related entities, the Participating Outlets, and all agencies associated with the Promotion; and
(b) the employees, agents, directors and contractors, of all entities referred to in paragraph 28(a),
shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of, or participation
in, gifts, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
29. The Promoter accepts no responsibility for any tax liabilities that may arise from receiving the benefit of a gift.
30. Eligible Entrants agree and acknowledge that all Entries and any intellectual property rights subsisting in their Entries become and remain the property of the Promoter.
31. Each entrant acknowledges and agrees that it is a condition of participation in the Promotion that the entrant be capable of agreeing to these Terms and giving the consents contained herein.
