OFFER CONDITIONS
Information on how to enter, how to claim and Samples form part of these Offer Conditions. Participation in this Offer is deemed acceptance of these Offer Conditions. Claims are via Internet only.
Offer is only open to residents of Australia aged 15 years or older (Claimants). The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of this Offer are ineligible to participate.
Claimants aged under 18 years must obtain the consent of their parent or legal guardian to enter the promotion and provide personal information about themselves. All claims of Claimants who are under the age of 18 years and enter the promotion without disclosing (or attempting to conceal) their age (as and where required) and/or do not provide the required parental or guardian consent (as and where required) will be deemed invalid. These Offer Conditions will bind the Claimants and any parent or legal guardian who gives their consent (for Claimants aged under 18 years). If successful Claimant is aged under 18 years, the Samples will be awarded to the parent or legal guardian who consented to the Claimant participating in this offer on behalf of the Claimant, at the discretion of the Promoter.
The Offer starts at 12:01am (AEST) on 7/9/2011 and ends at 11:59pm (AEDT) on 19/10/2011 (Offer Period). The Promotional Period will be divided into forty-two (42) days for the purposes of claiming Samples in this offer (Promotional Days). Each Promotional Day will commence at 12:01am (AEST/AEDT) and close at midnight (AEST/AEDT) on the same day during the Promotional Period. Claims must be received by 11:59pm (AEST/AEDT) on each Promotional Day or by the time that fifty (50) valid claims have been received on that Promotional Day, whichever is first to occur. Offer is strictly limited to the first fifty (50) valid claims received on each Promotional Day.
To participate in the Offer, Claimants must, during the Offer Period:
log onto the Casa Barilla page on Facebook (
www.facebook.com/CasaBarilla) (Casa Barilla Page);
'like' the Casa Barilla Page. Claimants who have 'liked' the Casa Barilla Page prior to the start of the Offer Period will not be required to complete this step;
access the 'Mi Piace - That's Italian for I 'like' this' application (Application) made available on a tab of the Casa Barilla Page; and follow the prompts of the Application in the manner required to fully and correctly complete the Application's claim form, including providing the Claimant's full name, residential address, current and valid email address, phone number and mobile phone number.
Limit of one (1) claim per person permitted. Any subsequent claim after the first valid claim is received will be deemed invalid. Maximum of two (2) claims per Household. "Household" in these Offer Conditions means the residential address of the Claimant.
Facebook membership, the "liking" of Facebook pages, Facebook pages and use of Facebook generally is subject to the Facebook prevailing terms and conditions of use available at
www.facebook.com. This Offer is in no way sponsored, endorsed or administered by, or associated with, Facebook. Claimants understand that they are providing their information to the Promoter and not to Facebook. Claimants are solely responsible and liable for the content of their entries and any other information they transmit to other Internet users. To the extent permitted by law, each Claimant agrees to indemnify, defend and forever hold harmless, Facebook and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an Claimant in respect of the Claimant's participation in this Offer. Any questions, comments or complaints about this Offer must be directed to the Promoter and not to Facebook.
Claims will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Claims received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible claims will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected claims.
Costs associated with accessing the Casa Barilla Page remain a Claimant's responsibility and may vary depending on the Internet service provider used. Contact details entered incorrectly on the Casa Barilla Page by a Claimant may deem a claim invalid.
The use of any automated claim software or any mechanical, electronic or other means that allows a Claimant to automatically claim repeatedly is prohibited and will render all claims submitted by that Claimant invalid.
The first fifty (50) valid claims received by the Promoter during each Promotional Day will each be awarded one (1) Barilla product sample, which will be either: (a) one (1) 400g Barilla pasta sauce product sample (Arrabbiata, Ricotta, Basilico, Napoletana, Olive, Puttanesca, or Mozzarella & Ricotta), valued at $3.50 each; OR (b) one (1) 190g Barilla pesto product sample (Pesto Genovese, Pomodori Secchi Pesto, Pomodori e Cipolla Rossa Pesto, Siciliana Pesto, Pesto Rosso, or Calabrese Pesto), valued at $5.00 each (Samples). The choice of Sample awarded to the Claimant is in the Promoter's sole discretion.
On each Promotional Day, once a Claimant submits their claim and the Promoter receives and confirms their claim has been successfully received, a message will appear on the Claimant's screen informing the Claimant as to whether or not they are one (1) of the first fifty (50) for that Promotional Day eligible to be awarded a Sample. Successful Claimants will be notified in writing. Samples will be mailed to the residential address specified by the Claimant in their claim form. Successful Claimants should allow 28 days for their Sample to be delivered.
Total of up to 2,100 Samples to be awarded in this promotion. Total Sample pool value is up to $10,500.00. Samples are not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). Samples must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any variation in Sample value. All Sample values are the recommended retail price including GST.
The Promoter's decision is final and binding on all matters and no correspondence will be entered into.
Claimants can only enter in their own name. Claimants who provide incorrect, misleading or fraudulent information are ineligible to participate in the Offer and all claims of a Claimant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Claimant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction, at its sole discretion) in order to confirm the Claimant's identity, age, residential address, eligibility to enter and claim a Sample, and any information submitted by the Claimant in participating in the Offer, before issuing a Sample. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or a Claimant or claim has not been verified or validated to the Promoter's satisfaction then all the claims of that Claimant will be ineligible and deemed invalid.
The Promoter reserves the right to verify the validity of any and all claims and reserves the right to disqualify any Claimant for: (a) tampering with the claim process; (b) submitting a claim which is not in accordance with these Offer Conditions; or (c) if the Claimant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Offer. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
A Sample will only be awarded where the Claimant fulfils all of the requirements of the Promoter's validation and verification tests and procedures. The validation and verification tests and procedures shall be determined by the Promoter in its absolute discretion.
If this Offer is not capable of running as planned for any reason, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Offer, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Offer and/or, if necessary, to provide an alternative sample or gift to the same value as the original Sample, subject to any written directions made under applicable State legislation.
The Promoter, its associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law, for any direct or indirect injury, loss and/or damage arising in any way out of the Offer. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this Offer and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Offer as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged claims, Sample claims or Samples; and/or (iv) acceptance and/or use of any Sample.
Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Casa Barilla Page or the information on the Casa Barilla Page, or to otherwise undermine the legitimate operation of this Offer may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Offer Conditions or any other legal obligation by a Claimant, the Claimant agrees to indemnify the Promoter for those losses, damages and costs.
If a Sample becomes unavailable, for any reason beyond the Promoter's reasonable control, then a comparable sample or gift of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State legislation.
As a condition of participating in this Offer, a Claimant consents to, in the event they are successful Claimant, the Promoter using the Claimant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Offer (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter.
A claim and any copyright subsisting in a claim irrevocably becomes, at time of claim, the property of the Promoter. The Promoter collects personal information about a Claimant to include the Claimant in the Offer and, where appropriate, award Samples. If the personal information requested is not provided, the Claimant cannot participate in the Offer and is deemed ineligible. A Claimant can gain access to, update or correct any personal information held by the Promoter by contacting Customer Services on (02) 8585 3900. All personal information will be stored at the office of the Promoter. A copy of the Promoter's Privacy Policy in relation to the treatment of personal information collected may be obtained by visiting

By participating in the Offer, a Claimant also acknowledges that a further primary purpose for collection of the Claimant's personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the Claimant in the future with information on special offers or to provide the Claimant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its promotional partners. By participating in the Offer, a Claimant acknowledges and agrees that the Promoter may use the Claimant's personal information in the manner set out in this condition.
