Terms and Conditions
 
1.   Information on how to enter this promotion and prizes form part of these Terms and Conditions of entry. Entry into the draw is deemed acceptance of these Terms and Conditions of entry.
 
2.   Entry into this promotion is open to all NSW and VIC residents aged 10 years and over. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter. Employees of MCM Media and their immediate families, associated agencies of MCM Media and companies associated with the promotion are not eligible to enter the promotion.
 
3.     The promotion will be advertised on the website www.thehothits.com and via email broadcast.
 
4.     To enter the promotion, Entrants are required to go the email URL http://www.surveymonkey.com/s/HHLFLATRAVEL, or go to www.thehothits.com and click through to “Travel Survey Promotion”. The Entrant must successfully complete the survey to qualify an entry.  The Entrant will then be asked to register their detail including e-mail address. One complete and valid registration will provide the Entrant one entry in the draw.
 
5.     Only one complete online registration per person will be accepted over the entire promotional period.
 
6.     Incomplete, incorrect and incomprehensible entries will be deemed invalid.
 
7.     To successfully enter the competition, an entrant must enter their own personal details into the competition.  If an entry is entered on behalf of the participant by a third party, then that entry will be invalidated.
 
8.   The Promoter accepts no responsibility for any internet entries not received or included into the draw for any reason beyond the reasonable control of the Promoter, including due to technical or other failure.
 
9.   The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider and the responsibility of the entrant.
 
10. The competition commences on Monday 5 September 2011 at 16:00 (AEST) and concludes on Monday 26 September 2011 at 23:59 (AEST).
 
11.  There will be one (1) x Prize Winner. The Prize Winner will receive $500.
 
12.  The total prize pool is valued at a maximum of $500.00
 
13. The draw will take place at the premises of Salmat IDR Pty Limited, Level 2, 116 Miller Street, North Sydney, NSW 2060 at 15:00 (AEST) on Tuesday 27 September 2011. The Prize Winner will be notified by phone and by e-mail within 2 days of this draw. The Prize Winner will have their details published in the public notices section of The Australian Newspaper on Tuesday 4 October 2011.
 
14.  The Promoter shall conduct such further draws as may be necessary at Salmat IDR, Level 2, 116 Miller Street, North Sydney, NSW 2060 at 15:00 (AEST) on Friday 6 January 2012 to distribute the Prize unclaimed by that date subject to State Regulation. The Unclaimed Prize Winner will be notified by phone and by e-mail immediately within 2 days of this draw. The Unclaimed Prize Winner will have their details published in the public notices section of The Australian Newspaper on Friday 13 January 2012.
 
15.  Prizes will be awarded to the person named in the entry. Prizes are not transferable.
 
16.  The Prize will be issued to the Prize Winner in the form of a cheque made payable to the Winner and crossed “not negotiable”.
 
17.  Unless expressly stated in these terms and conditions all other expenses (including any bank fees) become the responsibility of the winner.
 
18.  If any particular draw is scheduled on a public holiday, the draw will be conducted on the following business day.
 
19.  If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
 
20.  Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
 
21.  It is a condition of accepting a Prize that a Winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
 
22.  In consideration for the Promoter awarding the prize to a winner, each winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize (Works). Winners acknowledge that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.
 
23.  Judges decision is final and no correspondence will be entered into. All registrations are deemed to be received at the time of receipt into the Promoter’s database, and not at the time of transmission by the entrant.
 
24.  All prize values are in Australian dollars.
 
25.  MCM Media and each of their related bodies corporate, associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit. Once prizes have left Promoter's premises, the Promoter will not be responsible for any delay in delivery, or failure of safe delivery of prizes.
 
26.  The Promoter and each of their related bodies corporate, associated agencies and companies associated with this promotion will not be liable for (a) any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion; (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) if the Live at the Chapel event in Sydney is cancelled for any reason beyond the reasonable control of the Promoter; (e) any tax liability incurred by a winner or entrant; (f) or accepting or taking of prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
 
27. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
 
 
28. The Promoter reserves the right to request entrants and/or winners to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, age, residency and entry validity considered suitable for verification is at the discretion of the promoter. Where the winner is aged less than 18 years old, the Promoter reserves the right to request the winners to provide proof that they obtained the prior permission of a parent or guardian over the age of 18 to enter.  In the event that a winner cannot provide suitable proof, the winner will forfeit their prize in whole and no substitute will be offered.
 
29. All entries become the property of the Promoter. The Promoter collects personal information about the entrant to enable them to participate in this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) but no further use of this information will be made without prior consent.
 
30.  Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter.
 
31. If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the promotion, subject to state regulation.
 
32. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to state regulation.
 
33. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this promotion by any person who tampers with or benefits from any tampering with the entry process or with the operation of the promotion or acts in violation of these Terms and conditions of entry, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
