BACARDI LION 'PERSONAL TOGETHERNISER' PROMOTION
These Terms and Conditions apply to Bacardi Lion's Personal Togetherniser Promotion ("this Competition"). Information on how to enter and the prizes form part of these Terms and Conditions. Information on how to enter this Competition may be downloaded from http://bacarditogetherniser.com.au//terms/. By entering this Competition, you accept and agree to be bound to the following Terms and Conditions:

   1. This Competition is only open to Australian residents aged 18 years and over. This Competition is not open to the employees (and their immediate family members) of the Promoter and its agencies associated with this Competition are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. No purchase or admission fee is required to participate in this Competition. The period for entry into this Competition commences at 09:00am AEST 24th September 2011 and closes at 11:59pm AEDST 23rd October 2011 ("Promotional Period").


   2. To enter this Competition, participants must go to the Bacardi Facebook page at http://www.facebook.com/bacardi, 'Like' the Bacardi Facebook page, click on the competition tab, input the requested details including an answer to the question "What keeps you and your mates apart?" in 25 words or less and submit the fully completed entry during the Promotional Period. All entries must be submitted in the English language.


   3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.


   4. Multiple entries permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements.


   5. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.


   6. This is a game of skill. Chance plays no part in determining the winner. Each entry will be individually judged, based upon literary and creative merit of the answer provided to the promotional question "What keeps you and your mates apart?".


   7. All entries must be the original creation of the entrant and must not infringe upon any third party's rights.


   8. The judging will take place at Level 8, 201 Kent Street, Sydney NSW 2000.


   9. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.


  10. The winner will be notified by email or phone. The winner will be announced on the 26th October 2011. Winner must respond by 3pm Friday 28th October 2011or the next best entry, as determined by the judges and selected as a reserve winner, will be awarded the prize.


  11. The best valid entry, as determined by the judges, will win an evening out for the winner and up to five (5) invited guests in their nearest city up to the maximum value of $1,500.00 (excluding GST). The major prize package must be taken within ninety (90) days of the winner announcement. The date of the major prize and the itinerary of the evening is to be determined by the Promoter in agreement with the winner, but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary in its discretion. The Promoter will provide a dedicated Personal Planner up to the value of $1,500 depending on the winners place of residence. The Personal Planner will, in agreement with the Promoter and the winner, make all the necessary arrangements to ensure the itinerary is fulfilled up to the maximum value of the prize, including but not limited to transfers, ticket purchases, arrangement of bar tabs at nominated establishments and restaurant bookings. The Promoter will endeavor to fulfill all reasonable requests of the winner. The winner acknowledges that the Promoter maintains the right to deem the events nominated in the winner's itinerary as unreasonable and some events may be unavailable. In the instance that the Promoter deems a nominated event as unreasonable or unavailable, the Promoter, or the Personal Planner, shall contact the winner to arrange an alternate event. For the purposes of the Terms and Conditions of this Competition, an unreasonable event is defined as (a) an event that cannot be achieved within the time frame of the winner announcement and the event date as determined by the winner; (b) if the event value exceeds the maximum value of the prize; (c) if the event is in breach of governing Laws and Regulations. Should the Promoter not be able to fulfill a request of the winner, the Promoter will contact the winner to agree on a second choice; (d) not reflecting Barcardi brand values; or (e) dangerous.. The winner acknowledges that the Promoter must adhere to governing Laws and Regulations in the acquisition of all events nominated in the winners itinerary The prize , or any unused portion of the prize, is not transferable, refundable, exchangeable or replaceable and cannot be taken as cash.

      The Personal Planner will be selected by the promoter in its absolute discretion.Prize is subject to the standard terms and conditions of individual prize and service providers. Subject to the terms and conditions of the participating prize provider(s), if for any reason the winner does not, once the prize has been booked, take the prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.


  12. If for any reason the winner does not take the prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.


  13. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, or suspend or modify a prize.


  14. The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au/publications/synopses/ds10syn.htm. Entry and continued participation in this promotion is subject to the licensee's liquor serving policy. The Promoter reserves the right to limit the amount of alcohol or bar tab that may be included in the prize.


  15. Any and all ancillary costs outside of the major prize including but not limited to insurance, travel, transfers, accommodation, meals, drinks, taxes and any and all other expenses howsoever arising are the sole responsibility of the winner.


  16. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner as a result of the conduct of the organisers.


  17. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.


  18. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible or liable for: (a) inaccurate / incorrect transcription of entry information; (b) purported entries that are not received for whatever reason, including without limitation lost, misdirected or stolen entries, or if entries are received late, illegible, incomplete, or sent other than as directed in the entry instructions; (c) any problems or technical failures of any kind, including malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software; (d) the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website; (e) any theft, unauthorised access, unauthorised human intervention or third party interference in any part of this Competition; (f) electronic or human error which may occur in the administration of this Competition; (g) any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, its servants or agents, in connection with this Competition, the arrangement for supply, or the supply, of any goods or services by the Promoter, its servants or agent to the winner and, where applicable, to any family/persons accompanying the winner; (h) any injury or damage to persons or property, including to the participant's or any other person's computer related to, or resulting from, participation or downloading any materials in this Competition; or (i) any tax liability incurred by a winner or entrant.


  19. If this Competition is interfered with in any way or for any reason is not capable of running as reasonably anticipated due to any reason beyond the reasonable control of the Promoter,, including but not limited to, without limitation, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion and without any liability, to the fullest extent permitted by law, to disqualify any individual, and/or to cancel, terminate, modify or suspend this Competition , as appropriate.


  20. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof.


  21. The judges' decision is final and no correspondence will be entertained.


  22. The Promoter reserves the right to use for whatever purpose the content of your entry and may or may not display your name.


  23. Entrants agree that they are fully responsible for the materials they submit via the Competition, including comments, recordings and images ("Content"). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem contains profanity, nudity, depictions of violence, threatening language or actions, offensive, improper or prohibited matter, are otherwise inappropriate, indecent, harmful, abusive, harassing, discriminatory, obscene, defamatory, derogatory, pornographic, sexually inappropriate, or infringe any third party's intellectual property rights or are abusive of another person's rights of privacy or publicity, race, origin, gender, custom, culture and/or religion, not suitable for children aged under 15, or otherwise unsuitable for publication (as determined by the Promoter at its sole discretion); (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems. Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above warranties. Entrants who breach any of the above terms shall be automatically disqualified and will not be notified of any such disqualification.


  24. When an entrant submits any Content, the entrant, unless the Promoter advises otherwise, licenses and automatically grants the Promoter, its affiliates and sub-licensees jointly and severally, a world-wide, perpetual, royalty-free, exclusive license, assignable and sub-licensable right and license to use, reproduce, have reproduced, modify, have modified, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights. The grant of rights shall be free of charge and irrevocable.


  25. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.


  26. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.


  27. The use of any automated entry or voting software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.


  28. As a condition of accepting the prize, the winner (and his/her companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.


  29. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.


  30. Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.


  31. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.


  32. The Promoter is not responsible for any travel or miscellaneous costs associated with the prizing.
