By entering the Drill’N’Grill Prize Pack Promotion, entrants agree to be bound to following the terms and conditions.

1. Key dates and information
1.1 Commencement time and date: 09.00am Thursday 01 September 2011

1.2 Closing time and date: 11:59pm Tuesday 01 November 2011

Dates/Times:
(All times are references to Eastern Standard Time E.S.T.)

1.3 Draw details: 02:00pm Friday 04 November 2011 at address 54 Alexander Street, Crows Nest, NSW, 2065.

1.4 For prizes valued over $250, the winners will be published in The Australian newspaper on Wednesday 09 November 2011.

1.5 Authorised under NSW Permit No. LTPS/11/06852; ACT Permit No. TP 11/03061; SA Lic No. T11/1583 and VIC Permit No. 11/1579.

Unclaimed Prize
1.6 If a prize remains unclaimed by 15 February 2012, provided that the Promoter has made reasonable attempts to contact the winner, an unclaimed prize draw will be held 17 February 2012 at the same time and place as previous draws. The winners will be notified by telephone and mail within 2 days of the draw (including method of claiming the prize). Details of the winners will be published in The Australian newspaper on Wednesday 22 February 2012. In the event of a second prize draw and after reasonable attempts to contact the winners, there will not be another prize draw and the competition will be considered finished.

2. Promoter
The Promoter is Cbus’ Trustee; United Super Pty Ltd ABN 46 006 261 623 and will be referred to as ‘Cbus’ throughout this document. Address: L28 Casselden Place, 2 Lonsdale Street, Melbourne, VIC, 3000.

3. Duration of promotion
This competition commences on Thursday 1st September 2011 at 9:00am E.S.T. and closes on Tuesday 1st November 2011 at 11:59pm E.S.T. Entries must be received by Cbus during the competition period.

4. Who may enter the competition
The only persons who may enter and be awarded prizes are residents of Australia, who are (A) members of Cbus; (B) are not (i) directors or employees of, or contractors to Cbus or any of the agencies or related companies involved with this competition, or (ii) members of the immediate family of such directors, employees and contractors. "Immediate family" means spouse, defacto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director/employee/contractor; and (C) a Cbus member at the time of the official prize draw. A member of Cbus is a natural person who has an open account in the fund and has been assigned a membership number for that account.

5. Method of entry
Entry available on the internet:

Entrants must (i) log into the Cbus campaign landing page via the website (www.cbussuper.com.au/drillngrill); (ii) update their contact details, supplying their email address is mandatory; or confirm their existing contact details are correct and (iii) read and agree to these conditions by ticking the box “I have read and agree to the terms and conditions” (link available to access terms and conditions: www.cbus.com.au/drillngrill/terms) and (iv) they will need to verify their email address. This will then give them three entries into the competition.

Entry available via mail:

Entrants must (i) fill out the competition mailer enclosed in the annual statement pack or downloadable from the landing page online via www.cbussuper.com.au/drillngrill; (ii) update their contact details; and (iii) read and agree to these terms and conditions. This must then be mailed back to Cbus at address Cbus, Locked Bag 999, Carlton South, VIC 3053 and received by the closing date of Tuesday 1st November 2011 to receive one entry into the competition.

6. Limitations on entry
Competition entries are limited to three entries per member who supplies their details online and a limit of one entry for members who supply their details via mail. Only one submission (one entry for mail or three entries for online) to the competition is permitted per member number.

7. Selection of winners
Winners will be independently drawn by a third party operator. The draw will take place on Friday 4th November 2011, 2.00pm E.S.T., at address Phone Australia, Level 2, 54 Alexander Street, Crows Nest, NSW, 2065. The first valid entry randomly drawn from all entries received will win a prize as specified in section 8 of the terms and conditions. Entries not fully complying with the terms and conditions of entry may be deemed invalid at Cbus’ discretion. If at the time of draw the winning entry is deemed not to comply with the terms and conditions of entry, the entry will be discarded and a new winner of that prize will be determined by the next valid entry drawn. Cbus’ decision is final and no correspondence will be entered into. If a prize is not accepted or claimed by Wednesday 15 February 2012, the relevant winner’s entry will be deemed invalid and a further draw will be held on Friday 17 February 2012, at the same time and place as original draw.

8. Details of prizes and prize values
There is one major prize and 100 minor prizes.

The major prize will be delivered within Australia one week after the winner has accepted the prize.

The minor prizes are one hundred individual gift cards of $100 (incl GST) each (100 x $100). Gift Cards cannot be used in conjunction with any other offer or sale item, and is not redeemable for cash. Gift Cards can be redeemed in store at any Bunnings Warehouse. Gift Cards are valid at Bunnings Warehouse stores only and Gift Cards don’t have an expiry date. Gift Cards are only available in Australian Dollars (no local currencies). Gift Cards are subject to any conditions specified by the supplier, Bunnings Warehouse.

Cbus takes no responsibility for any variation in prize value. Total prize pool for the minor prize is: $10,000.00 (incl. GST).

The total combined prize value for the major and minor prize is $23,668.97 (inc. GST).

Prizes are not transferable, exchangeable or redeemable for cash. In the event that a prize is unavailable, Cbus reserves the right to substitute a prize of equal or greater value.

Cbus accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

All prizes will be sent to the relevant winner’s address as recorded to the members Cbus account. Cbus will not take responsibility for any lost or undelivered prizes if a winner’s address details are incorrect. All members can update their details by logging into the Cbus section of the site (www.cbussuper.com.au) and clicking onto the “Account Login” link. If a prize is returned to the Cbus address, the winner will be notified by e-mail or alternatively by phone, and can claim the prize by providing their correct postal address. Cbus and its associated agencies and related companies will not be liable for any damage in transit to prizes.

9. Winner notification and publication
All winners will be personally notified in writing within one week after the draw date. Winners consent to the use of their name, suburb of residence and image for promotional and marketing purposes and agree to participate in all promotional activities (such as publicity and photography) free of charge as requested by Cbus. In the event of a re-draw the major winner will be published in The Australian newspaper on Wednesday 22 February 2012, same time and place as original draw.

10. Ownership of entries
All entries become and remain the property of Cbus.

11. Exclusion of liability
Cbus makes no representations or warranties as to the quality, suitability or merchantability of any of the goods or services offered as prizes. To the extent permitted by law, Cbus will not be liable for any loss, expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize. This clause does not affect, and is not intended to affect, any rights a consumer might have which are not able to be excluded under applicable Australian consumer protection laws. To the fullest extent permitted by law, any liability of Cbus or its servant or agents for breach of any such rights is limited to the minimum allowable by law.

12. Internet
If for any reason any aspect of this competition is not capable of running as planned, including by reason of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of Cbus which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, Cbus may, in its sole discretion, cancel, terminate, modify or suspend the competition or invalidate any affected entries, subject to the approval of the gaming authorities in each state and territory, where required. Cbus may disqualify all entries from, and prohibit further participation in this competition by, any individual who tampers with, or benefits from any tampering with, the entry process, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

Cbus accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, transmission interruption or delay, deletion, defect, communications line failure, theft, destruction, unauthorised access to, or alteration of, entries or otherwise. Cbus is not responsible for telephone network or lines, computer online systems, servers, providers, computer equipment or software and accepts no responsibility for any problems associated with them, whether due to technical problems, traffic congestion or otherwise.

13. Privacy
The information entrants provide is collected and used by Cbus in accordance with the Cbus privacy policy. Cbus may disclose entrants' personal information to its contractors to assist in conducting this competition or communicating with entrants. Entrants may opt in to receive marketing material from third party providers as part of this promotion. Cbus is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information that Cbus holds about them by contacting Cbus at the address below.

The headings in these Terms & Conditions are for convenience only and do not affect interpretation.

15. Permits
The permits issued for the conduct of this competition are set out in condition 1.5.

16. Why is Cbus running this promotion?
Cbus aim to ensure the most current member data is recorded for the purpose of helping members get information and access to all of their benefit entitlements in the fund including any special offers or helpful information, and by providing the right products and services to suit members’ needs in compliance with the purpose for which the fund is maintained under the “sole purpose test” as applied under section 62 of the Superannuation Industry (Supervision) Act 1993. Cbus has partnered with companies who have volunteered to provide prizes for this promotion, which encourages members to update their details so that Cbus can improve services provided to them directly.
