“Thank You” Facebook Promotion – Commonwealth Bank of Australia
TERMS AND CONDITIONS
1. Information on how to enter and gift details set out in all communications regarding the Commonwealth Bank of Australia “Thank You” Promotion (the “Promotion”) form part of these Conditions of Entry (Conditions). Any entry not complying with these Conditions is invalid and will not be considered for a gift.
2. Acceptance of these Conditions is a condition of entry into the Promotion and by entering the Promotion you confirm that you have read and accept these Conditions.
3. Please note this Promotion is no way sponsored, endorsed, administered by or associated with Facebook and by entering this Promotion you agree:
a. not to make any claim against Facebook; and
b. to release Facebook from any liability in regard to the Promotion.
4. The Promoter is the Commonwealth Bank of Australia ABN 48 123 123 124 of 201 Sussex Street, Sydney, NSW 2000. Telephone 13 22 21 (the “Promoter”).
5. Any enquiries in relation to the promotion should be directed to
info@commbankthankyou.com.au 6. The Promotion commences at 12pm AEDST on 31/10/2011 and closes at Midnight AEDST on 14/11/2011 (the “Promotion Period”) or earlier if 20,000 eligible entries are received before Midnight AEDST on 07/11/2011.
7. To enter, individuals must visit the Commonwealth Bank Facebook page at
www.facebook.com/commonwealthbank, and click through to the landing page of the “Thank You” promotion application. The Promotion is limited to the first 20,000 eligible entries.
8. To be eligible, entrants must satisfy the following eligibility requirements (“Eligibility Requirements”):
a. be a permanent resident of Australia
b. be either aged 18 years or over, or if not, have the express permission of their parent / guardian
c. Provide permission for the Promotion to access and utilise their Facebook ID, their full name and the email address they use on Facebook; by accepting the pop up that appears when they arrive at the application page;
d. confirm they have read (and accepted by ticking a box) these Conditions which are available via a link on the bottom of the Promotion page;
e. not be employees of the Promoter, its Related Bodies Corporate (as that term is defined in the Corporations Act 2001 (Cth) or its associated agencies and companies; and
f. not be immediate family members of an employee of the Promoter or the Promoter’s Related Bodies Corporate or its associated agencies and companies.
9. The Promoter will monitor the eligibility of individuals who enter the Promotion and may at its absolute discretion exclude or prohibit persons from entering the Promotion if the Promoter considers that an individual or an entry has not met the Eligibility Requirements for the Promotion
10. Prior to the individual confirming their acceptance of these Conditions and having provided permission per 7.c they will be able to select from one only, of three gift alternatives:
A Cinema Saver movie voucher – valued at $10AUD and valid for 12 months from the date of despatch
b. A 5 song music download voucher from InSong (EMI) – valued at $10AUD and valid for 12 months from the date of despatch
c. A voucher for a coffee and a chocolate raspberry tart from Gloria Jeans – valued at $9.95AUD and valid until the 31st of December
each a “Gift”.
11. The total value of the Gift pool for the Promotion is a maximum of $200,000AUD. Each individual Gift does not exceed $10.00AUD in value.
12. An individual is only eligible to enter the Promotion once and only an individual’s first eligible Promotion will be accepted by the Promoter. In the case of multiple entries having been received from an individual, the individual’s Gift selection submitted with their first received eligible entry will be deemed to be their only Gift selection.
13. The first 20,000 entries received during the Promotion Period from entrants that meet the Eligibility Requirements will be awarded a Gift. If any Gift is unavailable, the Promoter reserves the right to substitute the Gift with one of the other Gifts that are on offer under this Promotion. The Promoter accepts no responsibility for any variation in the value of any Gift, or any loss, theft or misuse of Gifts. Any redemption of ancillary costs associated with redeeming a Gift are the sole responsibility of the recipient and the Bank accepts no responsibility if a Gift cannot be redeemed, has expired or is not recognised.
14. Eligible recipients will receive their Gift in the form of a voucher via email within 2 business days of the conclusion of the Promotion.
15. Gifts are not negotiable, transferable, changeable or redeemable for cash.
16. The recipient accepts the Gift ‘as is’ and acknowledges that the Promoter accepts no responsibility for any tax implications (if any) that may arise from the Gift.
17. The Promoter’s decision is final and no correspondence will be entered into regarding recipients, an entry or the provision of the Gifts.
18. The Promoter will arrange for delivery of the Gifts to recipients at the email address supplied in the recipient’s entry only.
19. Incomplete, incomprehensible or undeliverable email addresses will be deemed invalid and the Gift will be forfeited by the intended recipient and no further Gift will be awarded.
20. In the event that a recipient supplies an incorrect email address and the Gift is successfully delivered to it, the Gift will be forfeited by the intended recipient and no further Gift will be awarded.
21. The Promoter reserves the right to request that recipients demonstrate that they meet the Eligibility Requirements as a condition of receipt of a Gift. Identification considered suitable for verification is at the discretion of the Promoter. If the Promoter, acting reasonably, does not consider a recipient meets the Eligibility Requirements, the Promoter may refuse to award the Gift to the entrant.
22. If for any reason this Promotion is not capable of running as planned (including, but not limited to) infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may take any action that may be available including cancelling, terminating, modifying or suspending the Promotion, subject to any requirements the promoter must comply with at law.
23. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or the Promotion. You may not use any equipment or software that may interrupt or disrupt the Promotion or that tampers with the Promotion or the awarding of the Gifts, including but not limited to using any spider or any other web trawler or web crawler software to enter the Promotion.
24. The Promoter is not responsible for any problems or technical malfunctions of any telephone or telecommunications network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website, or any combination thereof (including, but not limited to) any injury or damage to entrants or any other person’s computer related to or related to or resulting from participation in or downloading any materials in this Promotion.
25. Entrants are responsible for any costs associated with entering the Promotion and enter the Promotion at their own risk. To the extent permitted by law, the Promoter will not be liable for any interruption, delay in operation or transmission, virus, communications failure, Internet or Facebook access difficulties, or malfunction in equipment or software as a consequence of the entrant entering the Promotion or the Promoter awarding the Gift (if any).
26. Nothing in these Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
27. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Gift redemption that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use of or non-acceptance of the Gift.
28. All entries become the sole property of the Promoter. The Promoter collects your personal information so that it may process your entry, administer this Promotion and deliver Gifts to the recipients. The Promoter may communicate personal information to external providers and organisations to which it may outsource certain functions in running the Promotion.
29. The Promoter will retain and deal with any personal information you disclose in accordance with the Privacy Act 1988 (Cth) and agrees not to use your personal information for any other purpose other than for the purposes of the Promotion. Please note that the personal information you disclose is being disclosed to and collected by the Promoter and not to Facebook.
30. You may access and correct any of your personal information that the Promoter may collect in the course of the Promotion by contacting the Privacy Officer, Customer Relations, Commonwealth Bank Group, Reply Paid 41, NSW 2001, by calling the Promoter on 13 2221 or by visiting any branch of the Promoter.
31. These Conditions of Entry shall be governed by the laws of New South Wales, Australia and each entrant agrees to submit to the non-exclusive jurisdiction of Australia.
