Who is the Hottest Chip? - Game of Skill PromotionThis document sets out the terms of participation “Terms and Conditions” in the Groupe Seb Australia ‘Who is the Hottest Chip?’ Promotion (“promotion”).

How to enterTo enter, eligible individuals must, between 11:00am on 01/11/2011 and 11:59pm on 22/01/2012, visit the Tefal Australia Facebook page (
http://www.facebook.com/tefalaustralia) (“Facebook Page”), “Like” the Facebook Page when prompted, agree to accept the ‘Hot Chip’ application (“Application”) by clicking “Allow” when prompted, using the tools provided on the Application, create their own ‘Hot Chip’ and enter the requested details including their first name, last name, email address and city of residence, and submit their entry.
Terms and conditions Information on how to enter, vote and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.

Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The Promoter reserves the right, at any time, to verify the validity of entries, votes and entrants (including an entrant's identity and place of residence) and to disqualify any individual who submits an entry/vote that is not in accordance with these Terms and Conditions or who tampers with the entry/voting process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete, indecipherable, or illegible entries or votes will be deemed invalid.
Multiple entries are permitted, subject to the following: (a) each entry must be substantially unique and contain a unique name; and (b) each entry must be submitted separately and in accordance with entry requirements and these Terms and Conditions.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Promotion commences at 11:00am on 01/11/2011, and entries close at 11:59pm on 22/01/2012 (“Promotional Period”). All times and dates are times and dates in Australian Eastern Standard Time. Any entry received after expiration of the Promotional Period will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected entries or votes.
Entering by submitting an entry to this promotion automatically signs an entrant up as a subscriber to receive Groupe Seb newsletters. Entrants must remain subscribers to the Groupe Seb newsletters for the entire Promotional Period.
This is a game of skill and chance plays no part in determining the winners.
All valid entries will be displayed on the Application and on Facebook for public viewing and voting. By entering this promotion, entrants consent to the Promoter publishing their entry on the Application and on Facebook.
Other Facebook users can vote for entries displayed on their Facebook ‘NewsFeeds’ by following the links in their Facebook ‘NewsFeed’ post, or by directly visiting the Application. Other Facebook users will have the ability to vote without having to “Allow” the Application.
Multiple votes are permitted, subject to the following: (a) other Facebook users will only be permitted to vote for each entry once; and (b) each vote must be submitted separately and in accordance with voting requirements and these Terms and Conditions. Votes will be automatically calculated through the Application.
The Promoter's decision is final and no correspondence will be entered into.
The Application will feature a leader board for entrants to view. Entrants should not rely on information featured on the leader board to confirm if they are a winner. The leader board may not be a true reflection of the results. All votes and entrants featured on a leader board are subject to verification by the Promoter.
The Promoter will undertake a weekly judgment. Each week on the dates listed below, for twelve (12) weeks, a judgment will take place at 9:00am at Circul8, The Trophy Room, Level 1 / 545 South Dowling St, Surry Hills, New South Wales, Australia, 2010. Eligible entrants will only be considered in the judgment for the promotional week in which they entered the promotion (as detailed in the table below), and entries will not roll-over to any subsequent promotional week. Each winner will be notified by email and their name published on the Tefal Australia Facebook Page within two (2) working days of the applicable judgment date (as detailed in the table below).

Entry with most number of votes overall. The entrant who submits the entry that receives the most public votes overall, subject to verification by the Promoter will win: one (1) Tefal ActiFry FZ7002 valued at AUD $349.95;
Entry with the second most number of votes overall. The entrant who submits the entry that receives the second most public votes overall, subject to verification by the Promoter will win: one (1) Tefal VitaCuisine Compact VS4003 Compact valued at AUD $139.95; and
Entry with the third most number of votes overall. The entrant who submits the entry that receives the third most public votes overall, subject to verification by the Promoter will win: one (1) Tefal Fresh Express MB750 valued at AUD $89.95.
In case of ties to determine the top three (3) voted entries, (same number of votes), entries will be individually judged by a panel of judges from Groupe Seb. This panel will judge the entries based on “which chip best suits its name” and creative merit of their entry creation.
The total prize pool value for each promotional week is AUD $579.85. The total prize pool value of all weekly prizes is AUD $6,958.20.
If a winner of a prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
If for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited and will not be redeemable for cash.
If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, as appropriate.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any individual; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter or vote repeatedly is prohibited and will render all entries or votes submitted by that individual invalid.
Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter.
