2. Participation in the Promotion constitutes acceptance of these terms and conditions. All claim instructions and offer information published by the Promoter form part of these terms and conditions.
3. The Promotion is only open to eligible claimants. An eligible claimant is an individual who is an Australian resident aged 18 years or older as at time of claim submission, excluding any: (i) employee of the Promoter or any of its related corporations or any of their agencies associated with the Promotion; (ii) spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an excluded employee; and (iii) person who the Promoter has previously notified is not permitted to enter or submit a claim in the Promoter’s promotions.
4. The Promotion commences at 00:01hrs AEDST on 629/101/2011 and closes at 23.59hrs AEDST on 19/11/2011, or once stocks of Finish Quantum Twin-Pack Samples run out, whichever is first to occur (“Promotion Period”). There will be a total of 20,000 Finish Quantum Twin-Pack Sample available for redemption in this Promotion. All times are stated using the 24 hour clock. 00:01hrs is the start of a day and 24:00hrs is the end of the day.
5. To claim a free Finish Quantum Twin-Pack Sample, eligible claimants must, during the Promotion Period, visit www.messymeals.com.au, follow the prompts to the promotion claim page, enter their details and vote for their favourite finalist in the Finish Quantum We Love Messy Meals Promotion. There is a strict limit of one vote per household and one Finish Quantum Twin-Pack Sample per household. 6. The Finish Quantum Twin-Pack Sample Packs will be delivered within 28 days of the successful eligible claimant voting and registering their details on
www.messymeals.com.au. The Finish Quantum Twin-Pack Sample Pack will be sent to the Australian address provided by the eligible claimant at the time of claim submission.
7. The first 20,000 valid claims received will each receive a Finish Quantum Twin-Pack Sample valued at RRP $1.35 (AU). Total value of all Samples available for redemption is $27,000.
8. Finish Quantum Twin-Pack Samples are not redeemable for cash and are not transferable or exchangeable.
9. The Promoter reserves the right, at any time, to verify the validity of claims and eligible claimants (including an eligible claimant’s identity, age and place of residence) and to disqualify any eligible claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
10. The Promoter reserves the right, at any time, to invalidate any votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or votes that have been submitted through the use of multiple identities, email addresses or accounts.
11. Incomplete or indecipherable claims will be deemed invalid.
12. If there is a dispute as to the identity of an eligible claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the eligible claimant.
13. Successful eligible claimants will be notified immediately online.
14. The Promoter’s decision is final and no correspondence will be entered into.
15. If for any reason beyond the reasonable control of the Promoter, Finish Quantum Twin-Pack Samples become unavailable, the Promoter, in its discretion, reserves the right to substitute the Finish Quantum Twin-Pack Samples with a reward to the equal value and/or specification, subject to any written directions from a regulatory authority.
16. Eligible claimants consent to the Promoter using their name, likeness, image and/or voice in the event they are a successful claimant (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
17. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
18. Any cost associated with accessing the promotional website is the eligible claimant’s responsibility and is dependent on the Internet service provider used.
19. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in reward value to that stated in these Terms and Conditions; (e) any tax liability incurred by an eligible claimant; or (f) use of the Finish Quantum Twin-Pack Sample.
21. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, reward suppliers and as required, to Australian regulatory authorities. Claims are conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the eligible claimant. Eligible claimants should direct any request to opt out, access, update or correct information to the Promoter. All claims become the property of the Promoter.
