COMPETITION
The British Paints InOne Sentence Competition opens at 9 am AEDST on 31 October 2011 and closes at 5 pm AEDST 2 December 2011. Entry is open to Australian residents only. To enter, entrants must enter via the British Paints website (www.britishpaints.com.au), provide contact details, name and address and tell the promoter “InOne sentence (50 words or less) what you’ll do with the time you’ll save” by using British Paints InOne. Each entry will be individually judged based on originality, humour and creative merit (the Competition). One winner from each state/ territory will be awarded the dedicated prize. (States segmentation is as follows: VIC/TAS, QLD, WA, SA/NT, NSW/ACT.)
Information on how to enter the Competition and prizes form part of these Terms and Conditions. Participation in the Competition is deemed acceptance of these Terms and Conditions.
PROMOTER
The Promoter is Dulux Australia a division of DuluxGroup (Australia) Pty Ltd (ABN 67 000 049 427) of 1956 Dandenong Road, Clayton 3168, Victoria, Australia.
ELIGIBILITIY AND ENTRY
Entry to the Competition opens at 9 am AEDST on 31 October 2011 and closes at 5 pm AEDST 2 December 2011 (Promotion Period).
To be eligible to enter the Competition entrants must: (i) be a resident of Australia; and (ii) be 18 years of age or over (Entrant).
Entrants may enter the Competition by completing a competition entry form online at www.britishpaints.com.au. Entrants must provide the following personal details when submitting their entry into the Competition: full name, address, a day time contact number and an email address. Entrants must tell the Promoter “InOne sentence what you’ll do with the time you’ll save” in 50 words or less. All entries must be submitted by 5pm (AEST) 2/11/2011.
Multiple entries are permitted, however each competition answer as part of an entry must be substantially unique and each entry must be submitted separately and in accordance with entry requirements.
NON-ELIGIBILITY
Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this Competition are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity and address) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Offensive, abusive or any entry deemed inappropriate by the Promoter will be an invalid entry. Furthermore, incomplete, indecipherable, and any entry which has incorrectly entered personal information or contact details shall be deemed an invalid entry.
JUDGING
Judging will commence at 9.00 am AEDST on 5 December 2011 at the Promoters premises located at 1956 Dandenong Road, Clayton 3168, Victoria. The Competition will be judged by the Promoter. A representative of the Promoter will review and assess all of the entries and one (1) winner will be selected (Prize Winner).
The Prize Winner will be announced by 5.00 pm AEDST on 16 December 2011 and once determined will be contacted by telephone and published online at www.britishpaints.com.au
This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on originality, humour and creative merit of their entry. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in the case an invalid entry or ineligible entrant is selected as the winner.
The judges’ decision is final and no correspondence will be entered into.
PRIZE
One Prize Winner will be selected from each State segmentation: VIC/TAS, QLD, WA, SA/NT, NSW/ACT. There will be five Prize Winners in total. Each Prize Winner will be awarded a pre paid $5,000 credit card (Prize).
The Prize may be subject to terms and conditions available from the credit suppliers website, www.ichoosecard.com.au. The Promoter takes no responsibly for pre paid credit cards that are lost, void or non-redeemable as a result of a Prize Winner failing to comply with the any relevant terms and conditions.
The prize can only be redeemed by the Prize Winner as nominated on their entry form.
The prize is not transferable or exchangeable.
Unless otherwise determined by the Promoter, at the Promoters sole discretion, the Prize cannot be taken as cash under any circumstance.
PRIZE WINNER
The Promoter will contact each Prize Winner on 16 December 2011 to confirm his/her eligibility under these terms and conditions and to confirm whether the Prize Winners wishes to claim his/her Prize.
If a Prize Winner wishes to claim their Prize, the Prize Winner must confirm this fact and his/her eligibility to win under these terms and conditions by 5pm on 23 December 2011. If a prize winner fails to do either or both of these things by the deadline, the Prize Winner will be deemed to have forfeited the Prize and the Promoter reserves the right to select a new prize winner from reserve entries from that Prize Winner’s territory.
The Prize is not transferable or exchangeable.
GENERAL CONDITIONS
If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
The Promoter collects personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties required for the provision of the Prize. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
