4.The promotion commences at 6 November 2011 and closes at 11.59pm AEDST (for online entries), 4.00pm AEDST (for phone entries) and close of business (for entries submitted in person) on 17 December 2011 (“Promotional Period”).
5.The promotion is being conducted by Medibank Private Limited ABN 47 080 890 259 of Level 17, 700 Collins Street, Docklands, Victoria 3008, Ph: 132 331 (“Promoter”).
6.Entry into this promotion is only open to Australian residents aged 18 years and over.
7.Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
8.To enter, eligible individuals must hold a Qualifying Pet Insurance Policy at 1 January 2012 A Qualifying Pet Insurance Policy is:
a.A Medibank Pet Insurance Policy purchased during the Promotional Period and which is active as at 1 January 2012.
OR
b.An active Medibank Pet Insurance Policy as at 5 November 2011 and which remains active as at 1 January 2012.
9.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrants who tamper with the entry process or who submit an entry that is not in accordance with these Terms and Conditions of Entry. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
10.If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
11.Valid and eligible entrants will automatically be entered into the prize draw. Valid and eligible entrants will receive one entry to the prize draw for each Medibank Pet Insurance Policy purchased in line with the entry criteria during the promotional period. Multiple entries are permitted subject to the following: (a) only one entry permitted per Medibank Pet Insurance Policy; and (b) each entry must be made in accordance with entry requirements. 12.Eligible individuals can purchase Medibank Pet Insurance for entry via one of the following ways:
a.Phone: call 132 331 and follow the prompts to purchase any Medibank Pet Insurance policy between 6 November 2011 and 4.00pm AEDST on 17 December 2011. Maximum cost of call is 55c (including GST). Calls from mobile and pay phones may attract a higher rate. Service provider: Telstra; or
b.Internet: visit
www.medibank.com.au/pet-insurance and follow the prompts to purchase any Medibank Pet Insurance Policy, input the requested details and submit the fully completed purchase of any Medibank Pet Insurance Policy between 6 November 2011 and 11.59pm AEDST 17 December 2011; or
c.In Person: visit their nearest Medibank Store and purchase any Medibank Pet Insurance policy between 6 November 2011 and close of business on 17 December 2011 (store opening hours vary, Entrants can check store opening hours at

13.The prize draw will be conducted on behalf of Medibank Private by Anisimoff Legal, Level 4, 448 St Kilda Road, Melbourne VIC 3004 at 10:00am AEDST on 11 January 2012. The Promoter’s decision is final and no correspondence will be entered into concerning any aspect of this promotion.
14.The first valid entry drawn will be the Major Prize Winner (“the Winner”), who will win:
a.1 x House Call from Dr Chris Brown “The House Call” valued at up to $1700 depending on the location of the House Call and the number of pets examined during the House Call.
Dr Chris Brown will visit the Winner’s home (or other suitable location reasonably agreed by the Winner and the Promoter) and examine up to 4 domestic pets for a combined maximum of 2 hours (excluding any travel time Dr Chris Brown has spent in transporting himself to the Winner’s home or other suitable location). The House Call will include Dr Chris providing veterinary related services in the form of pet examination(s), answering the Winner’s pet related questions and providing pet health and wellbeing advice. The House Call does not include the cost of tests, treatments, procedures and medicines. If the Winner’s residential address is over 100kms from a metropolitan or regional airport, the Promoter reserves the right to nominate an alternative location to hold the House Call and will cover all reasonable expenses of transportation for the Winner and their pet(s) to the House Call location.
The date of the House Call is subject to the availability of Dr Chris Brown and the reasonable agreement of both the Winner and the Promoter.
The House Call must be conducted by 31 December 2012.
b.1 x $250 EFTPOS gift card. The gift card can be used in Australia anywhere that EFTPOS is accepted, the expiry date will be provided to the Winner when they receive the prize.
c.1 x Annual Medibank Pet Insurance premium valued at up to $1,275 depending on the pet to be covered by the insurance;
The premium will cover a period of 12 months from the next renewal date for the level of cover the pet has as at 1 January 2012. If the Winner has more than one Pet Insurance Policy, the Winner may nominate which of their Medibank Pet Insurance Policies they wish to redeem this prize against. If the Winner subsequently cancels or closes all Medibank Pet Insurance Policies that they hold, the Winner may redeem the prize for a new Medibank Pet Insurance Policy before 1 January 2013 up to the highest level of cover the pet can be eligible for; and
d.1 x signed copy of ‘Tales from a Bondi Vet’ by Dr Chris Brown valued at $22.95.
15.The total value of the major prize is up to $3,247.95.
16.The next ten (10) valid entries drawn (the “Runners Up”) will each win a signed copy of ‘Tales from a Bondi Vet’ by Dr Chris Brown valued at $22.95.
17.The Winner and the Runners Up of the promotion will be notified by phone and mail. The Winner’s name and state of residence will be published in ‘The Australian’ on 2 February 2012.
18.Total promotion prize pool is valued at up to $3,477.45.
19.Subject to the unclaimed prize draw clause, if for any reason the Winner or any Runners Up do not redeem a prize (or an element of a prize) by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
20.The Winner and Runners Up will be advised of the procedure to claim their prize within 14 days of the prize draw. The Runners Up will be sent their prize within 28 days of the draw.
21.The prizes, or any unused portion of a prize, are not transferable or exchangeable. The prizes may not be taken as cash. In the event that any prize, or component of a prize is unavailable for any reason, the Promoter reserves the right, in its discretion, to substitute that prize (or component of that prize) with another prize of equal value and/or specification, subject to any written directions from a regulatory authority. The Winner and/or Runners Up will be notified accordingly.
22.Any ancillary costs associated with redeeming the EFTPOS gift card are not included. Any unused balance of the EFTPOS gift card will not be awarded as cash. Redemption of the EFTPOS gift card is subject to any terms and conditions of the issuer including those specified on the EFTPOS gift card. The gift card can be used in Australia anywhere that EFTPOS is accepted, the expiry date will be provided to the Winner when they receive the prize.
23.If any of the prizes are unclaimed by 11 April 2012, the Promoter may conduct such further draws on 11 April 2012 at the same time and place as the original draw as are necessary to select a Winner and/or Runners Up, subject to any written directions from a regulatory authority. The winning entrant(s) (if any) in this unclaimed prize draw shall be notified by phone and mail and the winner of the major prize (if any) will have their name published in The Australian on 26 April 2012.
24.As a condition of accepting a prize, the Winner may be required to sign any legal documentation as and in the form required by the Promoter and/or associates in their absolute discretion, including but not limited to a legal release and indemnity form.
25.Any additional costs associated with claiming or redeeming the prizes are the sole responsibility of the Winner and Runners Up. The Promoter does not take any responsibility for the prizes being lost, damaged or destroyed in transit. The Promoter, agencies and companies associated with this promotion accept no responsibility for any taxation implications that may arise for the Winner and Runners Up in relation to the prize. The Winner and Runners Up should seek independent financial advice if concerned about tax implications.
26.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
27.Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions of Entry; (e) any tax liability incurred by the Winner or Runners Up; or (f) use of a prize.
