These terms and conditions apply to The Upstairs Lounge Prize Draw Incentive ("Promotion"). The Promoter is Acxiom Australia Pty Ltd ABN 95 087 293 525, 151 Clarence Street, Sydney NSW 2000.
Information about the prizes and on how to enter the prize draw forms part of these terms and conditions of entry. Entry into the Promotion constitutes acceptance of these terms and conditions.
Entry is only open to persons who are:
residents of Australia
18 years of age or over; and
c.not employees of the Promoter or the Promoter's retailers, suppliers or other associated companies or agencies (as determined by the Promoter), or their family members ("Eligible Persons").
The Promotion commences 12:00am AEDT on 10/11/2011 and closes 11:59pm AEDT on 09/02/2012 ("Promotional Period").
To enter the Promotion, Eligible Persons must, within the Promotional Period, complete an eligible questionnaire or survey as published on The Upstairs Lounge website at
www.upstairslounge.com.au. All completed entries will go into the prize draw for the Promotion. No responsibility will be taken for entries lost, not received, delayed or not completed properly and such entries may not go into the prize draw for the Promotion.
There will be four (4) prize draws. All draw periods will commence at 12.00am on the applicable Draw Period Start Date and continue until 11.59pm on the Draw Period Close Date. All entries received during the applicable Draw Period will be entered in the monthly draw as set out in the table below. The prize draws for the Promotion will take place at 4pm on the applicable Draw Date at 5/15 Grosvenor Street, Neutral Bay, NSW 2089.
The first correct eligible entry drawn will receive the winner's choice of one of the following prize options;
Option 1. $2,000 credited to the winner's nominated bank account or,

Maximum retail value of each Prize is $2,000 including GST. Maximum retail value of the total Prize pool is $8,000 including GST.
Should the winner be drawn from NSW, by law they will be entitled to a maximum of 20 litres of alcohol only and the difference in value in cash. Individual prize supplier conditions apply. Unless stated otherwise, prize validity is 6 months from the date of the applicable draw. If any of the prizes are unavailable, for whatever reason, the Promoter reserves the right to substitute any of the prizes for a prize of equal or greater value, subject to state regulation and subsequent approval.

Entrants can only enter in their own name and use their own email address. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. -The Promoter reserves the right to validate and check the authenticity of any prize claim or entry before awarding a prize.
Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete or incomprehensible entries will be deemed invalid. No responsibility will be taken for lost, late or misdirected entries.
Programming and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these conditions of entry, all valid prize claims in excess of the advertised prize pool will be honoured.
In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the Prize.
The prize must be taken as offered and cannot be varied. Prize values are GST inclusive and are in Australian dollars and are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in prize value.
The Promoter's decision in relation to any aspects of the competition is final and binding on every person who enters and no correspondence will be entered into.
The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit. Once prizes have left Promoter's premises, the Promoter will not be responsible for any delay in delivery, or failure of safe delivery of prizes.
Prize winners are advised that Tax implications may arise from their prize winning and they should seek independent financial advice prior to the acceptance of the prize.
The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.
The Promoter is not responsible for any incorrect or inaccurate information or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
The Promoter reserves the right to redraw for any prize draw in the event that an entrant has not claimed a prize by 01/03/13. For any prize that remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct a further draw(s) at the same time and place as the original draw/s on 04/03/13 subject to state regulations and the winner will be notified in writing and announced by publication on

Eligible entrants consent to the use and disclosure of their information for the purposes of this Promotion by the Promoter and its agents associated with this Promotion.
