3. Entry is only open to Victorian residents aged 18 years and older. Directors, management and employees of the Promoter (and their immediate families) or of the agencies or companies associated with this promotion are ineligible to enter.

4. To enter, and be eligible to win, consumers must during the Promotional Period, complete the following Entry Requirements:

• Complete the competition entry form;
• Agree to the V/Line Privacy Policy and Privacy Notice;
• Agree to the competition Terms and Conditions.

5. Only one entry is permitted per person.

6. The prize consists of:
a. one (1) Westpac Mastercard ® Gift Card valued at $200.00 and;
b. one (1) V/Line Family (two adults and up to four children) ticket for off-peak, return economy travel to anywhere in Victoria, valued at up to $201.20.
There is one prize to be won, worth up to $401.20. The total prize value is up to $401.20 (inc GST).
7. The Promoter will award the prize to the most creative entry, as judged by a panel appointed by the Promoter, at 11am on Wednesday 11 January 2012 at the Promoter’s offices, Level 23 570 Bourke Street, Melbourne VIC 3000.
8. This is a game of skill. Chance plays no part in determining the winner. Each entry will be individually judged based on creative merit. The Promoter’s decision in relation to any aspects of the competition is final and no correspondence will be entered into. Prizes are not exchangeable or refundable and cannot be redeemed for cash.

9. Winners will be notified by telephone and in writing and prizes will be sent by registered post. Winners’ names will be published on www.vline.com.au and on www.facebook.com/vlinevictoria on Friday 13 January 2012. By entering this competition, entrants request that their full address not be published.

10. If the winner of any prize is under the age of 18 years at the closing date of the promotion, the relevant prize will be awarded to the winner’s parent or guardian (at the Promoter’s discretion).

11. If a winning entry is deemed not to comply with these Terms and Conditions of entry, the entry will be discarded and a new winner of that prize will be determined by judging a further valid entry in accordance with paragraph 7. The judges’ decision is final and no correspondence will be entered into.

12. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

13. Prizes must be claimed by Friday 16 February 2012.

14. V/Line’s privacy policy and privacy notice may be viewed at www.vline.com.au/privacy. Personal data collected from entrants by the Promoter as part of this competition will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants, to the Director of Public Transport or its nominee, if required by the Director of Public Transport or if disclosure is required or permitted by law. Personal information from entrants will not be used for any other purpose unless permission is provided by the entrant. Where permission is provided by the entrant, the entrant’s personal information will be stored in accordance with V/Line’s privacy policy. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter.

15. V/Line travel tickets are valid for use until 30 June 2012 and cannot be used on peak services (as determined by the Promoter). All other costs associated with prizes, including but not limited to any costs associated in getting to and from the relevant Victorian train station or V/Line coach stop to start and complete their travel journey (to redeem the V/Line tickets) and other ancillary costs are the responsibility of each winner, as incurred.

16. The Promoter and its associated agencies and companies will not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss or loss of profits), or for any expense, death or personal injury suffered or sustained, (whether or not arising from any person’s negligence) in connection with this competition or as a result of taking or using any prize, except for any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

17. In the event for any reason a winner does not take an element of a prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize. The Promoter accepts no responsibility for any variation in prize value. Where a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter.

18. If for any reason any aspect of this competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries.

19. The Promoter and its associated agencies and companies will not be liable for any damage in transit to prizes nor be liable for failure of Australia Post to deliver the prize to the winner’s nominated address.

20. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications, the Internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.

21. The prize winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.

22. The Promoter may require winners to provide proof of identity, proof of age and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the Promoter’s discretion.
