1. Information on how to enter and prize details form part of these terms and conditions. Entry into the competition is taken to mean your acceptance of these terms and conditions.
2. The competition commences at 9am Australian Eastern Daylight Saving Time (“AEDST”) on 2 January 2012. Entries close on 30 April 2012 at the below email address by 5pm Australian Eastern Standard Time (“AEST”) (“Promotion Period”).
3. The promoter is TRUenergy Pty Ltd (ABN 99 086 014 968) of Level 33, 385 Bourke Street, Melbourne VIC 3000 (“Promoter”).
4. Entry is open to residents of New South Wales, the Australian Capital Territory, Victoria and Queensland.
5. To enter, you must, during the Promotion Period, email
energywise@energyaustralia.com.au your favourite summer activity in 25 words or less and include your details (including your name, mailing address and contact phone number).
6. You may only enter once.
7. Competition winners will be chosen on 6/02/2012 at 2pm Australian Eastern Standard Daylight Savings Time (“AESDT”), 9/03/2012 at 2pm Australia Eastern Standard Daylight Savings Time (“AESDT”) and 11/5/2012 at 2pm Australian Eastern Standard Time (“AEST”) and will take place at Level 23, 535 Bourke Street St, Melbourne VIC 3000. The judging panel will consist of at least two (2) Sales & Marketing representatives from TRUenergy or their nominees.
8. This competition is a game of skill.
9. Entries will be chosen based on favourite summer activities. The judges’ decision is final. No correspondence will be entered into.
10. Fifteen (15) winners will be chosen, a total of 15 prize packs to be won. Each winner will receive: A sun shelter, a 30+ sunscreen and a 30+ zinc valued at over $100.
11. The winners will be notified by telephone and by mail.
12. If any prize remains unclaimed after 30 June 2012, EnergyAustralia will award the prize to a runner up. Unclaimed prize winners will be notified by telephone and by mail.
13. The total maximum prize value for the Competition is RRP $111.
14. All other costs associated with taking and using the prize is the responsibility of the winner.
15. A prize is not negotiable, exchangeable or redeemable for cash.
16. The Promoter takes no responsibility for any variation in the value of a prize.
17. If the nominated prize is unavailable due to circumstances outside the control of the Promoter, the Promoter reserves the right to supply an alternative prize of similar monetary value, subject to any written direction from State and Territory lottery authorities.
18. The Promoter accepts no responsibility for late, lost or misdirected entries or for any technical difficulties including periods of unavailability of the entry documentation during the Promotion Period which are outside the Promoter’s control.
19. Entries which are incomplete, incorrect, offensive, non-serious or incomprehensible are not eligible to win.
20. No responsibility is accepted for entries not received by the Promoter. Entries will not be accepted if they are illegitimate, forged, manipulated or tampered with in any way. The Promoter reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this promotion.
21. The Promoter will not be held liable for any loss, damage or injury which results directly or indirectly from acceptance of the prize, except where such loss cannot be excluded by law or for wilful or negligent acts or omissions of the Promoter.
22. All entries become the property of the Promoter and entries will not be returned. Entrants consent to the Promoter modifying, adapting and/or publishing the entry in whole or in part without royalty, payment or other compensation to the entrant. The entrant unconditionally and irrevocably consents to any act or omission that would otherwise infringe any of the entrant’s moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given (“Moral Rights”). The entrant waives all Moral Rights in the Materials that arise outside Australia.
23. By accepting the prize, winners agree to be contacted by the Promoter about the Competition and to participate in publicity activities as reasonably requested, including being interviewed and photographed by the Promoter for use by the Promoter in future marketing and promotional activities including future editions of EnergyWise, without requiring payment by the Promoter or further consent from the winner.
24. Details from entries will be collected and used for the purpose of conducting this Competition (including delivery of the prize), which may include disclosure to third parties (including TRUenergy contractors, suppliers or agents). By entering this Competition, entrants consent to the use of this information as described, and agree that the Promoter, may use this information for promotional, marketing and publicity purposes (including sending the EnergyWise newsletter electronically). Entrants should direct any request to access, update or correct information to the Promoter.
