[2] Entry is open only to Australian residents aged 18 or over excluding directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter, of any participating outlets or of the agencies or companies associated with this competition.
[3] The competition begins on 18/12/2011 and closes at 12:01am (EST) on 26/01/2012 (Competition Period).
[4] To enter, consumers must, during the Competition Period visit
www.heypup.com and enter their email address. Additional entries are then given for the following actions: (a) ‘Like’ the Hey Pup Facebook page at
www.facebook.com/heypup (one additional entry); (b) Follow Hey Pup on Twitter at
www.twitter.com/hey_pup (one additional entry); (c) Share with their friends on Facebook (one additional entry); (d) Tweet a pre-loaded message on Twitter linking the promotion (two additional entries); or (e) Email a cute picture or video of your dog to

[5] All entries must be received during the Competition Period. Consumers may enter only a total of one photo and/or one video. The Promoter accepts no responsibility for (and may, in its absolute discretion, invalidate any) late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications, the Internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple mobile phone numbers/email addresses and/or aliases may be disqualified.
[6] A draw will take place at 2pm (AEST) on 27/01/2012 at Hey Pup, Swanpool Avenue, Chelsea 3196.
[7] The first valid entry randomly drawn from all entries received during the Competition Period will win a $100 voucher to the pet store of their choice. The next four entries drawn will each win a $50 voucher to the pet store of their choice.
[8] The total prize pool is valued at $300.
[9] The winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
[10] If a winning entry is deemed not to comply with these conditions of entry, that entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry in accordance with paragraph 7. The judges’ decision is final and no correspondence will be entered into.
[11] The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
[12] Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes.
[13] All winners will be notified by phone and by email.
[14] Any unclaimed prizes remaining at 1pm (AEDT) on 30/04/12 will be distributed by way of a random draw at 2pm (AEDT) on 30/04/12 at the same location as the original draw. Any winner/s in this draw will be notified by phone and by email.
[15] The Promoter may require entrants to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.
[16] The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
[17] Prizes are not transferable or exchangeable.
[18] If for any reason any aspect of this competition is not capable of running as planned, including, but not limited to, by reason of tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the relevant gaming authorities, where required.
[19] The Promoter may communicate or advertise this competition using Facebook. The competition however, is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability.
[20] The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
[21] All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. By entering this promotion, entrants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotion and marketing purposes regarding its products, including contacting the entrant via electronic messaging. By entering this competition, entrants consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.
