Terms and Conditions:

1.Information on how to enter and the prizes form part of these terms and conditions. Submission of an entry in the "Flickerfest and ING DIRECT Flick Pick Award” promotion ("Promotion") is deemed acceptance of these terms and conditions.
2.The Promotion commences 12:01am, (AEDT) on 7 January 2012, and closes at 11:59pm (AEDT) 31 May 2012 (unless extended at the Promoters discretion) ("Promotion Period").
3.The Promotion is conducted by ING Bank (Australia) Limited (ABN 24 000 893 292) of 140 Sussex Street, Sydney, New South Wales, Australia (“ING DIRECT”) and Flickerfest Pty Limited (ABN 59 084 773 400) of Bondi Pavilion, Queen Elizabeth Drive, Bondi Beach New South Wales, Australia (“FLiCKERFEST”) (jointly, the “Promoters”).
4.The Promoters reserves their rights, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who participates in the Promotion not in accordance with these terms and conditions or who tampers with the entry process.  Failure by the Promoters to enforce any of their rights at any stage does not constitute a waiver of those rights.
5.“Audience Entrant” means a member of the Audience of the FLiCKERFEST International Short Film Festival 2012 (“FLiCKERFEST Festival”) during the Promotion Period who is an Australian resident aged 18 years or over.
6.“Filmmaker” means a Filmmaker that has submitted a short film that is being shown at the FLiCKERFEST Festival and has complied with the FLiCKERFEST 2012 Festival – Entry Rules and Regulations (“FLiCKERFEST Rules”) available at flickerfest.com.au/entryform_2012.aspx and is an Australian resident aged 18 years or over.
7.The Promotion consists of two prize components being an Audience Prize and a Filmmaker Prize as outlined in clauses 24 and 25.
8.Entry to the Promotion is not open to directors and employees of the Promoters, and each of their immediate family members (including de-facto partners and children of those partners), and the retailers, suppliers, associated companies and associated agencies of the Promoters.



Eligibility
Audience Prizes9.An “Eligible Audience Entrant” in regard to the “Audience Prizes” specified in clause 24, is an Audience Entrant who:
a.has viewed a short film at the FLiCKERFEST Festival; and
b.Is not a Filmmaker, director or employee of a Filmmaker, and of their immediate family member (including de-facto partners and children of those partners), and any retailers, suppliers, associated companies or associated agencies of a Filmmaker.

Filmmaker Prizes10.An “Eligible Filmmaker Entrant” in regard to the “Filmmaker Prize” specified in clause 25, is a Filmmaker who:
a.has submitted a short film that is being shown at the FLiCKERFEST Festival; and
b.complies with the FLiCKERFEST Rules.



How to Enter
Audience Prizes11.To enter the Promotion for the Audience Prizes, an Eligible Audience Entrant must:
a.Either:
i.log-on to ingdirect.com.au/flickerfest; Or
ii.obtain a paper entry form available at a FLiCKERFEST screening; and
b.complete their personal details and vote for their favourite short film; and
c.state in 25 words or less, why the film chosen is their favourite (“Entry”).

Filmmaker Prizes12.To enter the Promotion for the Filmmaker Prize, an Eligible Filmmaker Entrant must:
a.have submitted a short film that is being shown as part of the FLiCKERFEST Festival;
b.comply with the FLiCKERFEST 2012 Festival – Entry Rules and Regulations; and
c.receive the highest number of votes by Audience Entrants in accordance with clause 11.



Entries
13.By submitting an entry, you consent and grant the Promoters, a non-exclusive, royalty-free, sub-licensable, irrevocable and transferable licence to use, reproduce, and/or display and use your Entry (together with your name or State or Territory) on the ING DIRECT website, ‘Flickerfest’ Facebook page and use for other lawful promotional purposes in any way that the Promoters sees fit.  In addition, winners may be required by the Promoters to take part in publicity associated with the Promotion.
14.Multiple entries are not permitted. Only one entry per person is permitted.
15.Entrants are prohibited from submitting Entries that (i) infringe, or will cause the Promoter to infringe, the intellectual property rights (or other rights) of any third party, or which include the personal information of any third party;  (ii) contains material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive; (iii) encourages conduct that would be considered a criminal offence, give rise to civil liability, breach any law; or (iv) is otherwise inappropriate. The Promoters reserve the right to automatically disqualify any such entries.
16.Entrants agree that the Promoters shall have the right to immediately remove any entry and disqualify any entrant who has or is suspected of violating the terms and conditions of the Promotion.
17.Entries shall be free from any viruses, locking devices or other disruptive or potentially damaging programs or devices ("Viruses"). Entrants shall be liable for any loss or damage caused to the Promoters from any viruses in any entry.
18.All entries become and remain the property of the Promoters.



Judging
Audience Prize19.There will be 38 Audience Prizes.  Each Audience Prize winner will be selected by a panel of judges. This is a game of skill. Chance plays no part in determining a winner. 
20.Prize judging for the Audience Prize will take place at 140 Sussex Street, Sydney NSW 2000 on Thursday 7 June 2012 at 11.00 am (AEDT), subject to any extension of the Promotion Period.

Filmmaker Prize21.There will be one Filmmaker Prize for the Filmmaker that receives the highest number of votes by Audiences in accordance with clause 11.
22.Subject to clause 20, the winners will be notified by phone within 2 business days of the judging date and then by mail, with their prize and name also published on the ‘Flickerfest’ Facebook page.
23.The Promoters reserve the right to select additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.



Prizes
24.There are 38 Audience Prizes to be won.  The prize for each winner is: one $100 ING DIRECT Universal Visa Gift Card, and one Flickerfest pack comprised of Flickerfest DVD (value of $30), one Flickerfest T-Shirt (value of $30) and one double pass to a session at Flickerfest 2013 (valued at $30). Total value of each Audience Prize is $190.
25.There is one Filmmaker Prize to be won. The prize is a $1000 ING DIRECT Universal Visa Gift card.
26.Universal Visa Gift Card is issued by Heritage Bank Limited ABN 32 087 652 024 AFSL/ACL 240 984. Terms and conditions of use can be found at universalgiftcard.com.au.
27.The judging panel in regard to the Audience Prize is constituted by the following representatives of the Promoters and their chosen partners:
a.Lauren Teague - Experience Marketing & Sponsorships Manager, ING DIRECT;
b.Helen Colville – Experience Marketing Campaign Manager, ING DIRECT; and
c.Bronwyn Kidd, Director, FLiCKERFEST.
28.The Promoters reserve the right to make changes to the judging panel in their sole discretion.
29.All entries for the Audience Prizes will be judged based on the following criteria:
a.creativity; and
b.the reason why the film chosen should win.
30.The total prize pool is valued at $8,220.  All prize values are in Australian dollars.
31.A prize, or any unused portion of a prize, is not transferable, exchangeable or redeemable for cash. If for any reason a winner does not take an element of the prize at the time stipulated by the Promoters, then the prize or that element of the prize will be forfeited.



Prize Conditions
32.All unclaimed prizes will be dealt with as prescribed by the law of the State or Territory of Australia in which the prize winner resides. All prizes remain the property of The FLiCKERFEST and ING DIRECT until they are claimed by the prize winners.  If a prize remains unclaimed after 3 (three) months and either INGDIRECT or FLiCKERFEST has made reasonable efforts to locate the prize winner and has been unable to do so, or the prize winner has been located but has failed to claim the prize, FLiCKERFEST and ING DIRECT will apply to the Minister for directions as to disposal of the unclaimed prize.
33.As a condition of accepting any of prize, the winner/s must sign any legal documentation as and in the form required by the Promoters in its absolute discretion, including but not limited to a legal release and indemnity form.



Limitation of Liability
34.The Promoters are not liable for any technical error that may occur during the Promotion that is outside of the Promoters reasonable control.  This includes, but is not limited to, any omission, interruption, deletion, defect or delay in operation or transmission or failure of any telephone, mobile or satellite network.
35.The Promoters exclude all implied conditions, warranties and terms, except those that cannot be excluded in law (“Non-excludable Condition”).  The Promoters limit their liability for the breach of any Non-excludable Condition, at the Promoters option, to any one of supplying or replacing, or paying the cost of supplying or replacing the goods or supplying again, or paying the cost of supplying again, the services in respect of which the breach occurred.
36.Except in relation to the breach of any Non-excludable Condition and any liability to a winner to provide a prize or a substitute prize subject to these terms and conditions, the Promoters (including its officers, employees and agents) exclude all liability (including in negligence) for any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; (e) use of a prize for any purpose.



Personal Information
37.Promoters may use the name and photograph of the winners for promotional purposes.
38.Promoter collects personal information in order to conduct the Promotion and may use that information in accordance with its “Privacy Statement” (available on INGDIRECT’s website ingdirect.com.au) and disclose it to those Australian regulatory authorities that regulate this Promotion. Entry is conditional on providing this information.
39.Unless otherwise advised, the Promoters may also use the personal information for promotional, marketing and publicity purposes including sending electronic messages. Eligible Entrants should direct any request to access, update or correct information to the Promoters.



General
40.The Promoters decision is final and no correspondence will be entered into.
41.If there is a dispute as to the identity of an Eligible Entrant, the Promoters reserve the right, in their sole discretion, to determine the identity of the Eligible Entrant.
42.In the event of war, terrorism, state of emergency or disaster, the Promoters reserve the right to cancel, terminate, modify or suspend the Promotion.
43.If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any reason beyond the reasonable control of the Promoters, the Promoters reserve the right, in their sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
44.It is a condition of accepting any prize that, if requested by the Promoters, a prize winner must verify by statutory declaration that their winning entry complies with, and they agree to be bound by, these terms and conditions.
45.An entrant may at any time request that he or she be withdrawn from the Promotion, and the Promoters must use their reasonable efforts to withdraw the entrant as soon as practicable.
46.The agreement created under these terms and conditions is subject to the laws of New South Wales, and entrants and the Promoters submit to the non-exclusive jurisdiction of the courts of that State.
47.If a provision of these terms and conditions is invalid, illegal or unenforceable, then to the extent of the invalidity, illegality or unenforceability, that provision must be ignored in the interpretation of these terms and conditions. All other provisions of these terms and conditions remain in full force and effect.
48.The Promoters accept no responsibility for any ta implications including but not limited to tax liability assessed under section 26AJ of the Income Tax Assessment Act 1936 and capital gains tax that may arise from the prize winnings. Independent financial advice should be sought.
