DOMINO’S BELGIAN CHOC LAVA CAKE GIVEAWAY ON FACEBOOK
1. Information on how to enter and prizes form part of these Terms and Conditions. Submission of an entry into this Promotion is deemed acceptance of these Terms and Conditions.
2. Entry is open to all Australian permanent residents aged 18 years and over. Employees, Contractors, Directors and their immediate families of the Promoter (as defined below) and printers, suppliers, providers and agencies associated with this promotion are ineligible to enter.
3. The Promotion commences at 10am AEDT on Monday 23 January 2012 and closes 11.59pm AEDT on Sunday 29 January 2012 (“Promotional Period”).
4. To enter the Entrant must, during the Promotional Period:
(a) operate a Facebook account;
(b) enter a custom tab on the Domino’s Pizza Australia Facebook Page (address:
www.facebook.com/DominosAustralia);
(c) confirm acceptance of these Terms and Conditions and “Like” the Domino’s Pizza Australia Facebook Page (address:
www.facebook.com/DominosAustralia);
(d) provide their email address, full name and contact telephone number; and
(e) redeem the Voucher Code online only through
www.dominos.com.au to receive one (1) free Belgian Choc Lava Cake (the “Giveaway”).
5. The Entrant can redeem the Voucher Code online at any time between the commencement of the Promotional Period and 11.59pm on Sunday 12 February 2012 (“Redemption Period”).
6. The Giveaway is one (1) Voucher Code entitling the Entrant to one (1) free Domino’s Pizza Belgian Choc Lava Cake, limited to one (1) per Facebook account holder, to be redeemed online at
www.dominos.com.au only and at participating stores only. The Voucher Code cannot be presented in-store for and must be used online. Standard delivery terms and conditions apply and if the Entrant’s order is being delivered, the Voucher Code can only be used for a single delivery of $20 or more.
7. The retail value of the Giveaway is $2.95 - $3.30 per Belgian Choc Lava Cake.
8. An Entrant is permitted to enter the Promotion once only. Multiple entries on one Facebook account are not permitted.
9. The Voucher Code cannot be redeemed for cash or otherwise transferred or exchanged.
10. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant's identity) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with or does not abide by the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
11. Incomplete entries will be deemed invalid.
12. Entry in the Promotion is free.
13. If the Belgian Choc Lava Cake is unavailable, the Promoter, in its sole discretion, reserves the right to substitute the Prize Pack (or any part thereof) with a prize of equal value and/or specification.
14. The Entrant consents to the Promoter using the Entrant's name, likeness and image (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Giveaway (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
15. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.
16. The Promoter reserves the right to verify the validity of entries and to disqualify any Entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner's entry are of a type described in this clause.
17. Any costs associated with accessing the promotional website and Facebook are the Entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid. It is the Entrant’s sole responsibility to ensure they have an activate Facebook account, provide correct email address and access their email address (including spam filters) to receive the Voucher Code.
18. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees
and agents) excludes all liability (including negligence), for any personal injury or death, or any loss or
damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any
theft, unauthorised access or third party interference; (c) any entry or claim that is late, lost, altered,
damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond
the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms
and Conditions; (e) any tax liability incurred by a winner or Entrant; (f) the acceptance or use of the
Giveaway; and (g) any act or omission of the Promoter or its associated agencies.
19. As a condition of accepting the Giveaway, the winners (and any companion/s) must sign any legal documentation as and in the form required by the Promoter / Prize Supplier / organisers in their absolute discretion including but not limited to a legal release and indemnity form.
20. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers, to assist in conducting the promotion. Entry is conditional on providing this information. If an Entrant accepts these Terms and Conditions by entering the Promotion, each Entrant agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the Entrant, including sending the Entrant electronic messages. An Entrant should direct any request to access, update or correct information to the Promoter.
