You must be 14 years of age or older and residing in Australia only to become a member in the FreeGroceries program. Corporations, partnerships, or any other business entities are not eligible for membership.
The Program is available via access to the FreeGroceries Website: FreeGroceries.com.au. You must have Internet access and a valid email address to be eligible to receive the privileges and benefits of membership. FreeGroceries is not responsible for your inability to connect to the Internet, log onto the FreeGroceries Website or access your FreeGroceries Account.
FreeGroceries may refuse any application for membership.
Privacy Policy
FreeGroceries recognises the importance of protecting your privacy. We also recognise that when you choose to provide information about yourself, you trust us to act in a responsible manner. We believe this information should only be used to help us provide our Members with better service. That is why we have put a privacy policy in place that guides how we collect, store and use personal information about our Members. Our online privacy policy can be found at our Website:
www.FreeGroceries.com.au and we urge you to review our privacy policy before enrolling in the FreeGroceries Program as it forms part of the Program Terms and Conditions of this Agreement.
Accrual of Grocery Cash
1. Grocery Cash is the rewards currency of the FreeGroceries Program. As a Member, you will have the opportunity to earn Grocery Cash by purchasing products and/or services offered as Approved Promotions on our Offer Partners Websites from time to time, and/or by participating in questionnaires, surveys or contests. It is your responsibility to comply with the rules specified by each Promotion. Your eligibility to participate in any given Promotion and your compliance with the rules for fulfilment of any given Promotion, will be determined solely by FreeGroceries and the Offer Partner sponsoring such Promotion.
2. In order for your Grocery Cash to be credited to your member account, members MUST have their cookies enabled for us to record their actions. FreeGroceries accepts no responsibility if at the time of action you did not have your cookies enabled for transactions NOT being recorded.
3. Prior to participating in any Promotion, you should note the product shipping policy of the Offer Partner sponsoring such Promotion to determine whether the Offer Partner is able to fulfil its obligations to you (i.e., shipping merchandise to your residence).
4. FreeGroceries reserves the right to invalidate Grocery Cash posted to your Account upon notice by the Offer Partner that you did not fulfil your obligation under the applicable Promotion rules. This includes signing up for a FreeGroceries offer, survey or competition more than once.
5. Once you fulfil all applicable requirements for a Promotion, the designated number of Grocery Cash specified by that Promotion will be transferred into your Account. In some cases, there may be some delay in the crediting of Grocery Cash to your Account. For example, delays may be caused by the Offer Partner's failure to forward the proper information to FreeGroceries, technical difficulties, or otherwise.
6. FreeGroceries will not be responsible for any delay or failure to credit Grocery Cash to your Account. It is your responsibility to regularly check you're Account to ensure that Grocery Cash transfers have been properly credited and that your Account balance is accurate.
7. FreeGroceries is not responsible for changes to, or discontinuance of any Promotion, Offer Partner withdrawals from the Program, or for any effect on accrual of Grocery Cash caused by such changes, discontinuance, or withdrawal.
8. FreeGroceries is under no obligation to provide Members with a guaranteed amount of Grocery Cash opportunities or advise them of promotional offers.

11. A member must claim an award within 12 months from the time the points were initially credited or points will expire and be deducted from the members account balance.
Spamming
The Spam Act 2003 (Cth) refers to spam as 'unsolicited commercial electronic messaging'. Electronic messaging covers emails, instant messaging, SMS and other mobile phone messaging. An unsolicited commercial electronic message is considered to be spam if it is sent without the prior consent of the recipient. Thus, when you sign up as a member of FreeGroceries, you must explicitly agree to allow us to send you commercial advertising emails. As a rule, commercial electronic messages must contain accurate information about the goods or services advertised, offered or promoted by the sender of the message and an unsubscribe option allowing members to stop receiving messages. FreeGroceries complies with these rules. Termination of Membership
A Member may terminate membership in the Program at any time and is effective upon submitting a termination request via the account area and receiving on page confirmation of termination from FreeGroceries.
FreeGroceries reserves the right, in its sole discretion, to terminate your membership in the Program at any time, without notice.
Membership in the Program is subject to this Member Agreement and the Privacy Policy (collectively, the "Program Terms and Conditions"). Any failure to comply with the Program Terms and Conditions, any fraud or abuse or any misrepresentation of any information supplied to FreeGroceries or its affiliates by you, or anyone acting on your behalf, may result in the termination of your membership in the Program.
Membership in the Program terminates immediately upon Member's death; or if Member does not use his or her Membership account for a period of 12 months or more; or Member supplies misleading information or makes any misrepresentation to FreeGroceries.
If at any time, you do not accept the Program Terms and Conditions, or any subsequent amendments or modifications thereto, or become dissatisfied with the FreeGroceries program; your sole remedy is to terminate your participation and membership in the Program.
Notification of Changes
If we decide to make changes to our Privacy Policy or Member Agreement, we will post those changes on our Website at: FreeGroceries so that our Members are always aware of any changes to the Program or any modifications regarding the kind of personal information we collect, how we use it and under what circumstances, if any, we disclose it. Members have a continuing obligation to check our Website on a regular basis for all Notifications and changes to the Program.
Disclaimer of Warranties
FREEGROCERIES IS BEING PROVIDED TO MEMBER "AS IS" WITH NO EXPRESS OR IMPLIED WARRANTY OR CONDITION. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREEGROCERIES EXCLUDES ALL CONDITIONS, REPRESENTATIONS, WARRANTIES AND OTHER TERMS WHICH MIGHT OTHERWISE BE IMPLIED INTO OR INCORPORATED INTO THIS AGREEMENT, WHETHER BY STATUTE, COMMON LAW OR OTHERWISE, WITH RESPECT TO THE PROGRAM, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES AND TERMS AS TO MERCHANTABILITY, SATISFACTORY QUALITY, N0N-INFRINGEMENT AND FITNESS FOR ANY PARTICULAR PURPOSE AND IMPLIED WARRANTIES AND TERMS ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE.
TO THE EXTENT PERMITTED BY LAW FREEGROCERIES DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE QUALITY OF, OR ACCURACY OF ADVERTISEMENTS OR PROMOTIONS FOR ANY MERCHANDISE, PRODUCTS, OR SERVICES OFFERED OR PROVIDED BY OFFER PARTNERS OR SUPPLIERS IN CONJUNCTION WITH THE PROGRAM NOR DOES IT ASSUME ANY RESPONSIBILITY FOR INFRINGEMENT OF THIRD PARTY INTELLECTUAL PROPERTY RIGHTS ARISING THEREFROM, OR ANY FRAUD OR OTHER CRIME FACILITAED THEREBY.
IN ADDITION, ALTHOUGH FREEGROCERIES INTENDS TO TAKE REASONABLE STEPS TO PREVENT THE INTRODUCTION OF VIRUSES OR OTHER DESTRUCTIVE MATERIALS TO THE FREEGROCERIES WEBSITE, FREEGROCERIES DOES NOT WARRANT, GUARANTEE OR MAKE ANY REPRESENTATIONS THAT THIS SITE IS FREE OF VIRUSES, TROJAN HORSES, WORMS, TIME BOMBS, CANCELBOTS OR OTHER DESTRUCTIVE MATERIALS. Limitation of Liability
IN NO EVENT WILL ANY OTHER COMPANY OR PERSON WITH WHICH FREEGROCERIES HAS A CORPORATE PARTNERING RELATIONSHIP, INCLUDING WITHOUT LIMITATION, CO-BRANDING, CO-MARKETING, JOINT DEVELOPMENT, AN OFFER PARTNER RELATIONSHIP, AN AFFILIATE OR A SUPPLIER RELATIONSHIP (EACH A "CORPORATE PARTICIPANT") BE LIABLE TO YOU FOR NON-PERFORMANCE OF FREEGROCERIES'S OBLIGATIONS. YOU AGREE NOT TO SUE ANY CORPORATE PARTICIPANT FOR NON-PERFORMANCE BY FREEGROCERIES.
TO THE EXTENT PERMITTED BY LAW, FREEGROCERIES SHALL NOT BE LIABLE FOR ANY DAMAGES, CLAIMS OR LOSSES INCURRED (INCLUDING WITHOUT LIMITATION COMPENSATORY, PECUNIARY, INCIDENTAL, DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING ANY DAMAGES FOR LOSS OF INCOME OR PROFITS), HOWEVER CAUSED AND WHETHER ARISING BY STATUTE, COMMON LAW OR OTHERWISE IN CONNECTION WITH:

ANY FAILURE, DELAY, OR DECISION BY FREEGROCERIES IN ADMINISTERING THE PROGRAM, INCLUDING RESPONDING TO CUSTOMER INQUIRIES OR RESOLVING DISPUTES;
THE USE OR INABILITY TO USE THIS WEBSITE OR THE INFORMATION CONTAINED ON THIS SITE; OR
THE PURCHASE OR USE OF ANY MERCHANDISE, PRODUCTS, OR SERVICES OF OFFER PARTNERS OR SUPPLIERS, EVEN IF FREEGROCERIES, OR REPRESENTATIVES THEREOF, ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, CLAIMS, OR LOSSES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.
FREEGROCERIES IS NOT RESPONSIBLE AND ASSUMES NO LIABILITY FOR CHANGES OR DISCONTINUANCES OF SERVICES OR MERCHANDISE FROM SUPPLIERS OR OFFER PARTNERS, WHICH MAY AFFECT PROMOTIONAL OFFERS.
TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FREEGROCERIES TOTAL LIABILITY, EITHER JOINTLY OR SEVERALLY, TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION RESULTING FROM YOUR USE OF THIS SITE AND/OR PARTICIPATION IN THE PROGRAM, WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO NEGLIGENCE) EXCEED ONE AUSTRALIAN DOLLAR (AU$1.00).
Disputes or Errors
All questions or disputes regarding the Program, including without limitation, questions or disputes regarding eligibility for the Program, must be submitted via email within 30 days of the qualifying transaction, to here. FreeGroceries shall resolve all and any disputes at its sole discretion. In the event that an error is made by FreeGroceries, such error shall not constitute a breach of this Agreement. All interpretations of Program Terms and Conditions shall be at the sole discretion of FreeGroceries.
Mediation
The parties must endeavour to settle any dispute in connection with this Agreement by mediation. Such mediation is to be conducted by a mediator who is independent of the parties and appointed by agreement of the parties or, failing agreement within 7 days of receiving any party's notice of dispute, by a person appointed by the Chair of LEADR, ACN 008 651 232, Level 9, 15-17 Young Street, Sydney; phone: 02 9251 3366, fax: 02 9251 3733, email:
leadr@leadr.com.au, or the Chair's designated representative. The LEADR Mediation Rules shall apply to the mediation. It is a condition precedent to the right of either party to commence arbitration or litigation other than for interlocutory relief, that it has first offered to submit the dispute to mediation.
Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia. If any provision of this Agreement is found invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the other provisions contained herein will remain in full force and effect. FreeGroceries's failure to insist upon or enforce strict performance of any provision of the Agreement shall not be construed as a waiver of any provision or right. Nothing in this Agreement shall be construed as creating or constituting a partnership, joint venture or agency relationship between FreeGroceries and the Offer Partners, or between FreeGroceries and the Suppliers. Neither the Offer Partners nor the Suppliers shall have the ability to create any obligation on FreeGroceries's behalf. This Agreement constitutes the entire agreement between you and FreeGroceries and supersedes all prior understandings, agreements, communications and / or advertising with respect to the Program.
Indemnification
Member agrees to indemnify and hold FreeGroceries, its affiliates, officers, and employees harmless from any and all claims, demands, damages, and / or costs incurred in connection with any transaction or activity in which you engage in connection with the FreeGroceries program that breaches any law, rule or regulation.
