Terms and Conditions: Win a Babies"R"Us Out & About Pack (Win a Babies"R"Us Travel Kit)

1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.

2. Entry is open to all Australian residents. However, employees and their immediate families of Toys”R”Us (Australia) Pty Ltd, Salmat IDR Pty Limited and their associated agencies and companies are not eligible to enter.

3. The competition commences on 1 February 2012 at 9:00 (AEDT) and concludes on 30 March 2012 at 23:00 (AEDT) (“Promotional Period”).

4. The competition will be advertised in store at Toys”R”Us and online at the website http://www.toysrus.com.au .

5. To enter the competition, participants must either:

    I. visit any Toys”R”Us store in Australia, complete a Win a Babies”R”Us Travel Kit Competition entry form including all relevant fields, and drop it in the entry box. This entitles participant to one entry into the competition.

    II. log on to http://www.toysrus.com.au, follow the Win a Babies”R”Us Travel Kit Competition links and complete the online registration form including all relevant fields. This entitles participant to one entry into the competition.

6. All entries will be automatically subscribed to the Toys”R”Us VIP email database.

7. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.

8. Incomplete, incomprehensible and illegible entries will be deemed invalid.

9. Entrants in the Win a Babies”R”Us Travel Kit Competition may enter as many times as they like.

10. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill if phone call/SMS/MMS is required for entry) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

11. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any Entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of the Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to Entrants and households using multiple email addresses, postal addresses, PO Box addresses. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

12. Entries must be received by 23:00 (AEDT) on 30 March 2012. All entries are deemed to be received at the time of receipt into the Toys”R”Us competition database and NOT at the time of transmission or submission by the Entrant. The Promoter accepts no responsibility for any late, lost or misdirected entries including online registrations not received by the Promoter or delays in the delivery of the online registration due to technical disruptions, network congestion or for any other reason.

13. Any entry that is made on behalf of an Entrant by a third party will be invalid.

14. There is no cost to enter the competition via the store entry form or the website.

15. The cost of accessing the promotion website is dependent on the Entrant’s internet service provider.

16. There is a total of one (1) major prize to be won which consists of:

    I. 1 x Quinny Buzz Stroller (valued at $699.00)

    II. 1 x Maxi-Cosi Mico Infant Carrier (valued at $399.00)

    III. 1 x Maxi-Cosi Complete Air Car Seat (valued at $399.00)

17. Total prize value is $1,497.00 (including GST)

18. Prizes are not transferable, exchangeable or redeemable for cash.

19. One unique major prize winner will be randomly drawn from the entries.

20. Prizes will be awarded at the end of the Promotional Period.

21. Unless expressly stated in these terms and conditions all other expenses (including installation costs, travel to and from the event/departure point etc) become the responsibility of the winner.

22. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.

23. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

24. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

25. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.

26. In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.

27. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.

28. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

29. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

30. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

31. If the prize winner is under 18 years the prize will be awarded to their parent or guardian on the winners’ behalf.

32. Each valid Entrant who has entered the competition over the duration of the Promotional Period will be entered into the draw. One (1) valid entrant will be drawn at random to become the winner. The draw will take place at Salmat IDR, Level 2, 116 Miller Street, North Sydney, NSW 2060, on 11 April 2012 at 10:00 (10am) (AEST). The first valid entry drawn will be awarded as the winner of the major prize.

33. If any particular draw is scheduled on a public holiday, the draw will be conducted on the following business day.

34. The winners will be notified within 2 days of the draw. The winners will be notified of their prize by phone and in writing. Winners of prizes valued over $250 will have their details published in the Public Notices section of The Australian newspaper on 18 April 2012 and all winners will be published on the website http://www.toysrus.com.au.

35. Prizes will be awarded to person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder).

36. Should an Entrant’s contact details change during the promotional period, it is the Entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

37. If any prizes remain unclaimed by 18 July 2012 on 17:00 (AEST), the Promoter may conduct an unclaimed prize draw at Salmat IDR, Level 2, 116 Miller Street, North Sydney, NSW 2060 on 19 July 2012 at 10:00 (AEST) to award the unclaimed prizes, subject to any written directions from any regulatory authority. The winners of any unclaimed prize will be notified by phone and in writing and winners of prizes valued over $250 will have their details published in the Public Notices section of The Australian newspaper on 26 July 2012. All winners will be published on the website http://www.toysrus.com.au within 2 days of being drawn.

38. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the competition result.

39. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.

40. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

41. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.

42. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including without limitation direct, indirect and consequential loss and damages) or for personal injury suffered or sustained as a result of entering or trying to enter the competition or accepting any prize offered as part of the competition, except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by you or for any of the equipment or programming associated with or utilised in the competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

43. The law implies various conditions and warranties which might apply to the Promoter supplying goods or services to the Entrant. The Promoter excludes all of those conditions and warranties to the fullest extent permitted by law, including without limitation implied warranties of merchantability and fitness for a particular purpose.

44. Provisions of the Trade Practices Act 1974 and other statutes in some cases either cannot be excluded, restricted or modified; or can only be restricted or modified to a limited extent. If any of those provisions apply, then to the extent permitted the Promoter’s liability under those provisions is limited as set out below. The Promoter’s liability in relation to goods supplied is limited at the Promoter’s option to: I. replace the goods or the supply of equivalent goods; II. repair of the goods; III. pay the cost of replacing the goods or of acquiring equivalent goods; IV. pay the cost of having the goods repaired; and the Promoter’s liability in relation to services supplied, is limited at the Promoter’s option to: I. supply the services again; II. pay of the cost of having the services supplied again.

45. In entering the competition, the Entrant assumes the risks and responsibility for any loss, damage or consequence resulting directly or indirectly from viruses, damage or other defects.

46. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.

47. As a result of an Entrant entering the competition, the Promoter will collect certain personal information such as email addresses and mobile telephone numbers. Unless an Entrant objects, this information may be used to: I. send news, information about the Promoter’s other promotions or products and/or general marketing material which the Promoter believes may be of interest to the Entrant; II. provide the Entrant with news, information and material in relation to the competition; III. monitor who is entering the competition; IV. profile Entrants.

48. All entries become the property of the Promoter. By entering the competition, the Entrants agree to receive further information from the Promoter delivered via email to the email address registered when entering the competition. If an Entrant wishes to stop receiving this information, the Entrant may unsubscribe by using the unsubscribe facility on each email communication sent.

49. The Promoter is collecting the Entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The Entrant's personal information may be disclosed to Salmat IDR Pty Limited for this purpose. If the Entrant is not willing for this to occur the Entrant cannot participate in the competition.

50. The Promoter may use this information for the purposes of the conduct of the competition and the compilation of survey results and evidence. The Promoter may disclose this information to third parties who provide the Promoter with administrative services. This information will be stored at the office of the promoter. Details of the personal information the Promoter holds can be viewed at http://www.toysrus.com.au/privacy-policy/.

51. By entering the competition, an Entrant consents to the Promoter using and disclosing the Entrant’s personal information outlined in the terms and conditions. The Promoter will not otherwise disclose an Entrant’s personal information to third parties. If an Entrant advises the Promoter that they do not wish the Promoter to use the Entrant’s personal information for any particular purpose, the Promoter will endeavour to take the necessary measures to meet the Entrant’s request. Exceptions to this are: I. where the Promoter is required to disclose information by law; II. where the Promoter believes that the use or disclosure is reasonably necessary to assist a law enforcement agency or an agency responsible for government or public security as a necessary part of their business; III. if the Promoter notifies an Entrant of an intended use or disclosure of the Entrant’s information and they do not object to that use or disclosure.

52. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.

53. The Entrant is responsible for ensuring that they have online access required to enter the competition if the Entrant wishes to enter online. The Entrant indemnifies the Promoter of this requirement.

54. The Entrant releases and agrees to keep the Promoter indemnified from any claim, cost, demand, tax, liability or damage (including legal costs on a full indemnity basis) suffered or incurred by the Promoter, our directors, employees, agents and representatives arising out of an Entrant’s entry in the competition or any claim by a third party arising from an act or omission by the Entrant.

55. The Promoter is not liable for any failure to comply with these conditions. If any part or provision in these conditions is found to be invalid, unenforceable or illegal for any reason, that part or provision shall be severed and the remaining provisions shall continue in full force.

56. These conditions constitute the entire agreement between the Entrant and the Promoter as to its subject matter. By entering the competition, the Entrant accepts that this agreement is to be interpreted, and any disputes are to be determined by the courts having jurisdiction in New South Wales and Australia, in accordance with the laws in force in New South Wales and Australia from time to time.
