‘ANNIE THE MUSICAL’ COMPETITION
TERMS & CONDITIONS

DEFINITIONS

1.The following definitions apply to these Terms and Conditions:

a)“Closing Date” means 23:59hrs on Thursday 5 April 2012.
b)“Commencement Date” means 12:00hrs on Monday 26 March 2012.
c)“Determination Date” means 12:00hrs on Friday 6 April 2012.
d)“Entrant” means a person who enters the Promotion.
e)“Newsletter” means the March issue of The Bio Channel e-newsletter, which can be registered for at http://www.biochannel.com.au/.
f)“Prize” means a prize offered in the Promotion. “Prizes” means all the prizes offered in the Promotion.
g)“Promoter” means FOXTEL Management (FOXTEL) Pty Ltd ABN 65 068 671 938, of 5 Thomas Holt Drive, North Ryde, NSW, 2113.
h)“Promotion” means this competition.
i)“Promotion Period” means the period between the Commencement Date and the Closing Date.
j)“Relevant Parties” means the Promoter and the agencies and companies that are associated with the Promoter or the Promotion.
k) “Supplier” means the supplier of the Prizes.
l)“Website” means The Bio Channel website, located at http://www.biochannel.com.au/.
m)“Winner” means an Entrant who wins a Prize, including in the Unclaimed Prize Determination.
n)“Unclaimed Prize Determination” has the meaning set out in Condition 27.
o)“Unclaimed Prize Determination Date” means Wednesday 11 April 2012.

2.All times and dates are times and dates in Sydney, which may be AEST or AEDT depending on the date. All times are stated using the 24-hour clock. 00:00hrs is the start of a day and 24:00hrs is the end of a day.

PARTICIPATION

3.The Promotion is conducted by the Promoter.

4.The Promotion is a game of skill, and chance plays no part in determining the Winners.

5.Entry to the Promotion constitutes acceptance of these Terms and Conditions. By entering the Promotion, Entrants accept and acknowledge full responsibility for their decision to participate in the Promotion and to take a Prize if they are a Winner.

6.All entry instructions and prize information published by the Promoter form part of these Terms and Conditions.

7.This Promotion will be advertised in the Newsletter and on the Website.

8. An  Entrant is eligible to win a Prize if they:

a)are a FOXTEL, AUSTAR, Optus TV featuring FOXTEL, FOXTEL from Telstra subscriber, or live in a household with a FOXTEL, AUSTAR, Optus TV featuring FOXTEL, FOXTEL from Telstra subscriber and have the subscriber’s permission to enter the Promotion, and the subscription account is not in arrears from the Commencement Date until the Unclaimed Prize Determination Date
  and

b)are over the age of 18, or, if under the age of 18, have their parent’s or guardian’s permission before entering the Promotion; 

and are not:

c)employees of:
i.the Promoter, AUSTAR, Optus, or Telstra;
ii.the Supplier or the Relevant Parties;
iii.any corporations or agencies related to the entities in paragraphs (i) and (ii) above; or
iv.any of the Relevant Parties; or
d)a spouse, de facto spouse, parent, child or sibling (whether natural or by marriage or adoption) of a person who is an employee of any of the entities listed in paragraph (c) above. 

9.Entry to the Promotion commences on the Commencement Date and closes on the Closing Date.

ENTRY

10.To enter the Promotion, an Entrant must, during the Promotion Period:

a)log on to the Website; and
b)click on the ‘Annie the Musical Competition’ link; and
c)complete all of the required data entry fields on the entry form; and
d)answer both of the following questions in a total of 25 words or less:

1.“Would you prefer to see ‘Annie the Musical’ in Melbourne or Brisbane?”; (the “Entry Question 1”); and
2.“What is your favourite song from Annie and why?”                               (the “Entry Question 2”).


11.Entrants who nominate Melbourne as their preferred location in Entry Question 1 will be entered into the Melbourne entry pool (the “Melbourne Entry Pool”). Entrants who nominate Brisbane as they preferred location in Entry Question 1 will be entered into the Brisbane entry pool (the “Brisbane Entry Pool”).

12.An Entrant’s entry must not be:

a)late;
b)delayed;
c)incomplete;
d)incomprehensible;
e)unlawful;
f)obscene;
g)defamatory;
h)libellous;
i)threatening;
j)pornographic;
k)harassing;
l)hateful;
m)racially or ethnically offensive;
n)capable of encouraging conduct that would be considered a criminal offence;
o)capable of violating any law; and/or
p)capable of giving rise to civil liability.

13.Entry to the Promotion is limited to 1 entry per Entrant.

14.Only 1 Prize will be awarded per person over the entire Promotion Period.

15.Entrants must ensure that their entries are received by the Promoter during the Promotion Period. All entries are deemed to be received at the time of receipt by the Promoter, not the time of transmission by the Entrant. The Promoter takes no responsibility for late, lost or misdirected entries or for any delays or failures in any telecommunications services or equipment.

16.Entry via the Website is free. However, any costs associated with accessing the Website are the responsibility of the person seeking access and are dependent on the internet service provider used. 

17.Entrants must make their Website entries manually using an internet browser. The Promoter may reject an entry if it reasonably forms the opinion that the entry has been made using automated entry means or by use of a computer entry service.

18.Should an Entrant’s contact details change at any time between the date on which they enter the Promotion and the Unclaimed Prize Determination Date, that Entrant must notify the Promoter of their correct contact details immediately.

19.All entries to the Promotion may be subject to verification by the Promoter. An Entrant must, within 7 days of being asked, at the Promoter’s cost:

a)allow the Promoter to inspect and copy any documents the Promoter may request establishing eligibility to enter the Promotion, including but not limited to evidence of age, residence and/or identity.

20.The Promoter may decide in its sole discretion which documents are considered suitable for establishing eligibility to enter or win. In the event that a Winner cannot provide suitable proof of eligibility, that Winner will forfeit their Prize in whole and no substitute or compensation will be offered.

21.Any entry that is made on behalf of an Entrant by a third party, or otherwise by proxy, will be invalid.

22.The Promoter may, at its absolute discretion, declare any or all entries made by an Entrant to be invalid if the Entrant:

a)fails to establish their entitlement to win the Promotion to the Promoter’s satisfaction; or
b)fails to produce items as required by Condition 19 or produces items that appear to be illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or
c)appears, to the Promoter, to have tampered with, or benefited from tampering with, the entry process; or
d)has submitted an entry that is not in accordance with these Terms and Conditions.

WINNERS

23.There will be a total of 10 Winners determined during the Promotion Period. There will be 5 Winners determined from all entries received in the Melbourne Entry Pool and there will be 5 Winners determined from all entries received in the Brisbane Entry Pool. Each Winner will receive 1 Prize.

24.The Winners will be determined on the Determination Date by the Promoter at 5 Thomas Holt Drive, North Ryde NSW 2113. The Winners will be the Entrants who, in the sole opinion of the judges, have most creatively answered the Entry Question.

25.The Promoter’s decisions are final and no correspondence will be entered into. 

26.The Winners will be notified by phone and email within 2 days of the Determination Date.

27.All reasonable attempts will be made to contact the Winners. Subject, where relevant, to any directions given under the legislation regulating the Promotion, if a Prize is:
a)not claimed by the Winner by 9:00hrs on the Unclaimed Prize Determination Date; or
b)forfeited for any reason,
the Prize will be awarded to another Entrant in an unclaimed prize determination (the “Unclaimed Prize Determination”), which will take place at 10:00hrs on the Unclaimed Prize Determination Date and will be conducted by the Promoter at 5 Thomas Holt Drive, North Ryde, NSW 2113. The Winner/s of the Unclaimed Prize Determination will be notified by email within 2 days of the Unclaimed Prize Determination Date.

PRIZES

28.Each Prize is valued at a total maximum of $643.60 and consists of the following:

•1 x copy of the programme for Australia’s ‘Annie the Musical’ signed by various lead actors, valued at a maximum of $100.00; and
•1 x copy of the soundtrack of ‘Annie the Musical’ on CD signed by various lead actors, valued at a maximum of $100.00; and
•4 x ‘A’ reserve tickets to see ‘Annie the Musical’, in either Brisbane or Melbourne (the “Musical”), valued at a maximum of $443.60.


               THE TOTAL PRIZE POOL FOR THIS PROMOTION IS VALUED AT A MAXIMUM OF $6,436.00

29.All Prize values are correct as at 13 March 2012 and are reflective of the recommended retail price and are in Australian dollars. The Promoter takes no responsibility for any variations in the Prize values.

30.Winners selected from the Brisbane Entry Pool will win tickets to attend the Musical at the Lyric Theatre, Qpac, Southbank, Brisbane. Subject to availability, the Winners will be able to nominate to attend one of the following sessions:

•19:30hrs on Tuesday 17/04/12, 24/04/12, 1/05/12 or 8/05/12;
•19:30hrs on Wednesday 18/04/12, 25/04/12, 2/05/12 or 9/05/12;
•19:30hrs on Thursday 19/04/12, 26/04/12, 3/05/12 or 10/05/12.

31.Winners selected from the Melbourne Entry Pool will win tickets to attend the Musical at the Regent Theatre, Melbourne. Subject to availability, the Winners will be able to nominate to attend one of the following sessions:

•19:30hrs on any Tuesday between 29/05/12 and 7/08/12;
•19:30hrs on  any Wednesday between 30/05/12 and 8/08/12; or
•19:30hrs on any Thursday between 31/05/12 and 09/08/12.

32.Where a Winner is under the age of 18, they must be accompanied on the Prize by a parent or guardian as one of their guests.

33.A Winner and their guests must attend the same session of the Musical.

34.If any Prize is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Promotion. The Promoter accepts no other liability or responsibility for any loss incurred by any Winner or any other party if any Prize is unavailable for any reason.

35.Prizes cannot be refunded or exchanged and, except as expressly permitted by these Terms and Conditions, cannot be taken as a monetary payment.

36.Prizes may be transferred at the Promoter’s sole discretion. In the event that the Promoter exercises its discretion to allow a Winner to transfer a Prize, the transfer will be on the condition that the transferee accepts all terms and conditions set out in these Terms and Conditions and the Promoter may require such acceptance in writing at its absolute discretion.

37.Winners are advised that tax implications may arise from them winning a Prize and they should seek independent financial advice prior to accepting a Prize.

38.Once a Prize has left the Promoter’s/Supplier’s premises, the Promoter and the Relevant Parties will not be responsible for any delay in delivery or loss or damage to the Prize.

39.If the Determination Date or Unclaimed Prize Determination Date is a public holiday, the determination will be conducted on the following business day.

40.Prizes will be awarded to the people named in the winning entries.

41.Winners will be responsible for all transportation costs to and from the Musical.

GENERAL

42.The Promoter reserves the right to take any action necessary in its sole discretion at any time, subject to any direction given under State permit regulations.

43.To the full extent permitted by the law, the Relevant Parties will not be liable for any loss, damage, claim, cost, expense or personal injury suffered or sustained (including, but not limited to, that caused by any person’s negligence) by any Entrant in connection with the Promotion or the Prizes, including:

a)any indirect, economic or consequential loss or loss of profits;
b)any loss arising from the negligence of a Relevant Party; and
c)any liability for personal injury or death.

44.If, for any reason, the Promotion is not capable of running as planned, including, without limitation, due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of the Promoter that corrupt or affect the administration, security, fairness or integrity, or proper conduct of the Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or take any other action, including to cancel, terminate, modify, or suspend the Promotion subject to any direction given under the relevant State/Territory permit regulations.

45.The Winners acknowledge that the Prizes may be subject to additional terms and conditions imposed by third parties. The Winners must become acquainted with any such additional terms and conditions prior to taking a Prize. The Promoter does not accept any responsibility and is not liable for any additional conditions imposed on the taking of the Prizes, or for the breach of those conditions by any person.

46.Except for any liability which cannot be excluded by law, the Promoter is not responsible for:

a)any problems or technical malfunction with any telephone network or lines, computer online systems, servers or providers, computer equipment, or software, or any technical problems or traffic congestion on any computer system or at any website, or any combination thereof, including (but not limited to) any injury or damage to participants or any other person’s property related to or resulting from participation in the Promotion;

b)any incorrect or inaccurate information, caused either by users, by any of the equipment or programming associated with or used in connection with the Promotion, or by any technical error that may occur in the course of the Promotion; or

c)any error; omission; interruption; deletion; defect; delay in operation or transmission; communications line failure; theft; or destruction or unauthorised access to, or alteration of, entries or Entrants’ details.

47.Any attempt to cause damage to any website or the information on any website associated with this Promotion or to otherwise undermine the fair and legitimate operation of this Promotion may be a violation of criminal and civil laws. The Promoter reserves the right to seek damages in the fullest extent permitted by law in the event that any such attempt is made, whether or not that attempt results in any such damage, interference or undermining.

48.These Terms and Conditions are governed by the laws of New South Wales.

49.These rules are Terms and Conditions and constitute the entire terms and conditions between the Entrant and the Promoter with respect to the Promotion and cannot be altered, modified, or amended.

50.All entries become the property of the Promoter.


PRIVACY

51.Your privacy is important to us. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants’ personal information will be collected by or on behalf of the Promoter to enable it to administer the Promotion, publicise its Winners, and send Entrants marketing information where Entrants have consented.  Entrants’ personal information may be disclosed to marketing and communications agencies, Prize suppliers and Prize deliverers in order to conduct this Promotion. Personal information about Entrants may also be disclosed to the authorities responsible for the regulation of gaming and lotteries. Winners’ names will be published and retained as required by relevant legislation and as specified in these Terms and Conditions. Entrants can contact the Promoter by mail at PO Box 612, Moonee Ponds, Victoria, 3039 or by telephone on 131999 to request access to, or corrections of, any of the personal information that the Promoter holds about them. TERMS & CONDITIONS

DEFINITIONS

1.   The following definitions apply to these Terms and Conditions:

a)   “Closing Date” means 23:59hrs on Thursday 5 April 2012.
b)   “Commencement Date” means 12:00hrs on Monday 26 March 2012.
c)   “Determination Date” means 12:00hrs on Friday 6 April 2012.
d)   “Entrant” means a person who enters the Promotion.
e)   “Newsletter” means the March issue of The Bio Channel e-newsletter, which can be registered for at http://www.biochannel.com.au/.
f)   “Prize” means a prize offered in the Promotion. “Prizes” means all the prizes offered in the Promotion.
g)   “Promoter” means FOXTEL Management (FOXTEL) Pty Ltd ABN 65 068 671 938, of 5 Thomas Holt Drive, North Ryde, NSW, 2113.
h)   “Promotion” means this competition.
i)   “Promotion Period” means the period between the Commencement Date and the Closing Date.
j)   “Relevant Parties” means the Promoter and the agencies and companies that are associated with the Promoter or the Promotion.
k)    “Supplier” means the supplier of the Prizes.
l)   “Website” means The Bio Channel website, located at http://www.biochannel.com.au/.
m)   “Winner” means an Entrant who wins a Prize, including in the Unclaimed Prize Determination.
n)   “Unclaimed Prize Determination” has the meaning set out in Condition 27.
o)   “Unclaimed Prize Determination Date” means Wednesday 11 April 2012.

2.   All times and dates are times and dates in Sydney, which may be AEST or AEDT depending on the date. All times are stated using the 24-hour clock. 00:00hrs is the start of a day and 24:00hrs is the end of a day.

PARTICIPATION

3.   The Promotion is conducted by the Promoter.

4.   The Promotion is a game of skill, and chance plays no part in determining the Winners.

5.   Entry to the Promotion constitutes acceptance of these Terms and Conditions. By entering the Promotion, Entrants accept and acknowledge full responsibility for their decision to participate in the Promotion and to take a Prize if they are a Winner.

6.   All entry instructions and prize information published by the Promoter form part of these Terms and Conditions.

7.   This Promotion will be advertised in the Newsletter and on the Website.

8.   An Entrant is eligible to win a Prize if they:

a)   are a FOXTEL, AUSTAR, Optus TV featuring FOXTEL, FOXTEL from Telstra subscriber, or live in a household with a FOXTEL, AUSTAR, Optus TV featuring FOXTEL, FOXTEL from Telstra subscriber and have the subscriber’s permission to enter the Promotion, and the subscription account is not in arrears from the Commencement Date until the Unclaimed Prize Determination Date; and

b)   are over the age of 18, or, if under the age of 18, have their parent’s or guardian’s permission before entering the Promotion; 

and are not:

c)   employees of:
i.   the Promoter, AUSTAR, Optus, or Telstra;
ii.   the Supplier or the Relevant Parties;
iii.   any corporations or agencies related to the entities in paragraphs (i) and (ii) above; or
iv.   any of the Relevant Parties; or
d)   a spouse, de facto spouse, parent, child or sibling (whether natural or by marriage or adoption) of a person who is an employee of any of the entities listed in paragraph (c) above. 

9.   Entry to the Promotion commences on the Commencement Date and closes on the Closing Date.

ENTRY

10.   To enter the Promotion, an Entrant must, during the Promotion Period:

a)   log on to the Website; and
b)   click on the ‘Annie the Musical Competition’ link; and
c)   complete all of the required data entry fields on the entry form; and
d)   answer both of the following questions in a total of 25 words or less:

1.   “Would you prefer to see ‘Annie the Musical’ in Melbourne or Brisbane?”; (the “Entry Question 1”); and
2.   “What is your favourite song from Annie and why?”                               (the “Entry Question 2”).


11.   Entrants who nominate Melbourne as their preferred location in Entry Question 1 will be entered into the Melbourne entry pool (the “Melbourne Entry Pool”). Entrants who nominate Brisbane as they preferred location in Entry Question 1 will be entered into the Brisbane entry pool (the “Brisbane Entry Pool”).

12.   An Entrant’s entry must not be:

a)   late;
b)   delayed;
c)   incomplete;
d)   incomprehensible;
e)   unlawful;
f)   obscene;
g)   defamatory;
h)   libellous;
i)   threatening;
j)   pornographic;
k)   harassing;
l)   hateful;
m)   racially or ethnically offensive;
n)   capable of encouraging conduct that would be considered a criminal offence;
o)   capable of violating any law; and/or
p)   capable of giving rise to civil liability.

13.   Entry to the Promotion is limited to 1 entry per Entrant.

14.   Only 1 Prize will be awarded per person over the entire Promotion Period.

15.   Entrants must ensure that their entries are received by the Promoter during the Promotion Period. All entries are deemed to be received at the time of receipt by the Promoter, not the time of transmission by the Entrant. The Promoter takes no responsibility for late, lost or misdirected entries or for any delays or failures in any telecommunications services or equipment.

16.   Entry via the Website is free. However, any costs associated with accessing the Website are the responsibility of the person seeking access and are dependent on the internet service provider used. 

17.   Entrants must make their Website entries manually using an internet browser. The Promoter may reject an entry if it reasonably forms the opinion that the entry has been made using automated entry means or by use of a computer entry service.

18.   Should an Entrant’s contact details change at any time between the date on which they enter the Promotion and the Unclaimed Prize Determination Date, that Entrant must notify the Promoter of their correct contact details immediately.

19.   All entries to the Promotion may be subject to verification by the Promoter. An Entrant must, within 7 days of being asked, at the Promoter’s cost:

a)   allow the Promoter to inspect and copy any documents the Promoter may request establishing eligibility to enter the Promotion, including but not limited to evidence of age, residence and/or identity.

20.   The Promoter may decide in its sole discretion which documents are considered suitable for establishing eligibility to enter or win. In the event that a Winner cannot provide suitable proof of eligibility, that Winner will forfeit their Prize in whole and no substitute or compensation will be offered.

21.   Any entry that is made on behalf of an Entrant by a third party, or otherwise by proxy, will be invalid.

22.   The Promoter may, at its absolute discretion, declare any or all entries made by an Entrant to be invalid if the Entrant:

Where you are invited to submit any contribution to the Site (including any text, photographs, graphics, video or audio) you agree, by submitting your contribution, to grant bio. a perpetual, royalty-free, non-exclusive, sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution, and in accordance with privacy restrictions set out in bio.’s Privacy Policy. If you do not want to grant to bio the rights set out above please do not submit your contribution to the Site.


Further to the above clause, by submitting your contribution to the Site, you:

Warrant that your contribution;

1 is your own original work and that you have the right to make it available to bio. for all the purposes specified above;

2 is not defamatory; and

3 does not infringe any law; and


Indemnify bio., FOXTEL and their related bodies corporate against all legal fees, damages, loss and other expenses that may be incurred by bio. as a result of your breach of the above warranty; and


Waive any moral rights in your contribution for the purposes of its submission to and publication on the Site and the purposes specified above.


The Community Rules
You agree to use the Message Boards in accordance with the following Community Rules:

Member Names will be failed if they:

1 Contain website or email addresses

2 Contain contact information i.e. phone numbers, postcodes etc

3 Appear to impersonate someone else

4 Contain swear words or are otherwise objectionable


bio. reserves the right to fail messages which:

1 Are considered likely to disrupt, provoke, attack or offend others

2 Are racist, sexist, homophobic, sexually explicit, abusive or otherwise objectionable

3 Contain swear words or other language likely to offend

4 Break the law or condone or encourage unlawful activity. This includes breach of copyright, defamation and contempt of court.

5 Advertise products or services for profit or gain

6 Are seen to impersonate someone else

7 Include contact details such as phone numbers, postal or email addresses

8 Are written in anything other than English

9 Contain links to other websites which break our Editorial Guidelines

10 Describe or encourage activities which could endanger the safety or well-being of others

11 Are considered to be ‘spam’, that is posts containing the same, or similar, message posted multiple times

12 Are considered to be off-topic for the particular message board


bio. welcomes feedback, both positive and negative, about its programmes and services but please make sure your comments are in line with the above Community Rules. Repeatedly posting personal or offensive comments about individual members of the public or people who work for bio. may be considered harassment. We reserve the right to remove such messages and take action against those responsible.


If you use multiple logins for the purpose of disrupting the community or annoying other users you may have action taken against your accounts.


Deliberate misuse of the complaints facility is not permitted. If you persist in doing this action may be taken against your account.


Safety: We advise that you never reveal any personal information about yourself or anyone else (for example: telephone number, home address or email address), and please do not include postal addresses of any kind. If you have a helpful address to share, inform the host of the relevant Community area using the 'Contact Us' link, and they will promote it if they see fit.


About the law:

1 You may not submit any defamatory or illegal material of any nature in the Site Communities. This includes text, graphics, video, programs or audio.

2 Contributing materials with the intention of committing or promoting an illegal act is strictly prohibited.

3 You agree to only submit materials which are your own original work. You must not violate, plagiarize, or infringe the rights of third parties including copyright, trade mark, trade secrets, privacy, publicity, personal or proprietary rights.

4 The views expressed in the Site Community areas are those of members of the public and are not necessarily those of bio.


If you are under 16:

1 Please get a parent’s or guardian’s permission before taking part in any the Site discussion.

2 Never reveal any personal information about yourself or anyone else (for example, telephone number, home address or email address).


If you breach these Terms and Conditions:

If you fail to abide by these Community Rules when taking part in the Site Community service, you will be sent an e-mail which informs you why your contribution has been failed or edited. This mail will also include a warning that continuing to break the rules may result in action being taken against your account or accounts.


This action may include your relevant account or accounts being placed into pre-moderation or a temporary or permanent suspension of your ability to participate in any or all of the Site Community areas.

bio. reserves the right to delete any contribution, or take action against any account, at any time, for any reason.
