TERMS AND CONDITIONS
1.Information on how to claim and the gifts form part of these Terms and Conditions. Participation in this offer is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer.
2.Offer is only open to NSW, ACT, VIC and QLD residents. Claimants under 18 years old must have parental/guardian approval to claim and further, the parent/guardian of the claimant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor claiming in this offer.
3.Employees (and their immediate families) of the Promoter and agencies associated with this offer are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4.Offer commences on 2/4/2012 and closes at midnight AEST on 27/5/2012, or once all vouchers have been awarded, whichever occurs earliest (Offer Period)
OBTAIN A VOUCHER
5.To obtain a voucher, individuals must, during the Offer Period: 1.visit the 7-Eleven Australia Facebook Page (
www.facebook.com/7ElevenAustralia) (Page) and "Like" the Page when promoted;
2.Accept the '7-Eleven Kit Kat application (Application)" by clicking "Allow" when prompted;
3.complete the requested details on the claim form including their name, email and mobile phone number and agree to the Terms and Conditions;
4.specify if they would like to receive their voucher via MMS (as well as via email; note this will be the same voucher). There is no cost for an individual to receive a voucher via MMS;
5.select at least one (1) Facebook friend (50 maximum – Facebook restriction) they would like to send a voucher to; and
6.submit their claim form.
CLAIM A VOUCHER
6.To claim a voucher which has been sent to an individual, the individual must, during the Offer Period: 1.click on the link in their Facebook notification;

3.Accept the '7-Eleven Kit Kat application (Application)" by clicking "Allow" when prompted;
4.complete the requested details on the claim form including their name, email and mobile phone number and agree to the Terms and Conditions;
5.specify if they would like to receive their voucher via MMS (as well as via email: note this will be the same voucher). There is no cost for an individual to receive a voucher via MMS; and
6.submit their claim form.
Individuals will then be provided with the opportunity to obtain another voucher by sending a voucher to at least 1 Facebook friend and only if they have not already sent vouchers to other Facebook friends on that day.
7.Maximum of two (2) vouchers permitted per claimant per day, subject to the following: 1.maximum one (1) voucher permitted for completing instructions in clause 5 above;
2.maximum one (1) voucher permitted for completing instructions in clause 6 above;
3.indivduals are only permitted to send a voucher to a Facebook friend who has not already received a voucher for that day;
4.if an individual has a voucher waiting for them to claim, their Facebook friends will not be able to send them another voucher until they have claimed the pending voucher; and
5.each claim must be submitted in accordance with claim requirements.
8.Claimants are strongly advised to only send vouchers to Facebook friends who are NSW, ACT, VIC and QLD residents, so they are able to claim their vouchers.
9.The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimant's identity and place of residence) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
10.The Promoter reserves the right, at any time, to invalidate any claims which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or claims that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to Facebook accounts.
11.Incomplete, indecipherable or illegible claims will be deemed invalid.
12.If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
13.The Promoter's decision is final and no correspondence will be entered into.
14.Offer is strictly limited to the first 100,000 valid claims received. Each valid claim will receive one (1) gift of one (1) free Kit Kat voucher, which entitles the claimant to receive one (1) free Kit Kat from a participating 7-Eleven store in NSW, ACT, VIC and QLD, valued at $2.60. Successful claimants will be notified in writing. Vouchers will be sent to successful claimants' email addresses and (if requested at the time of completing the claim form) to their mobile phone numbers via MMS.
15.Vouchers expire at 11:59 AEST on 31/5/2012. Any ancillary costs associated with redeeming the voucher are not included. Any unused balance of the voucher will not be awarded as cash. Redemption of the voucher is subject to any terms and conditions of the issuer including those specified on the voucher.
16.If any gift (or part of any gift) is unavailable, the Promoter, in its discretion, reserves the right to substitute the gift (or that part of the gift) with a gift to the equal value and/or specification, as appropriate.
17.Total gift pool value is up to $260,000. Gifts are not transferable or exchangeable and cannot be taken as cash.
18.Claimants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this offer (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
19.If this offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the offer, as appropriate.
20.Any cost associated with accessing the offer website is the claimant's responsibility and is dependent on the Internet service provider used.
21.The use of any automated claim software or any other mechanical or electronic means that allows a claimant to automatically claim repeatedly, or send vouchers to Facebook Friends repeatedly, is prohibited and will render all claims, vouchers received and vouchers sent by that claimant invalid.
22.Printing and other quality control errors will not invalidate an otherwise valid gift claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all gift claims in excess of the advertised gift pool will be honoured.
23.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the offer.
24.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any claim or gift claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of a gift.
25.The Promoter collects personal information in order to conduct the offer and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, gift suppliers and, as required, to Australian regulatory authorities. Claiming is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. Claimant should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
26.Claiming and continued participation in the offer is dependent on claimants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at
www.facebook.com/terms.php27.This offer is in no way sponsored, endorsed or administered by, or associated with, Facebook. Claimants understand that they are providing their information to the Promoter and not to Facebook. The information a claimant provides will only be used for the purposes outlined in these Terms and Conditions.
