Kenwood Mother’s Day Cashback Promotion 2012
Terms and Conditions
1. Information on how to claim forms part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these Terms and Conditions. The Kenwood cashback offer is not valid in conjunction with any other offer.
2. Offer is only open to Australian residents (“Claimant”). Employees (and their immediate families) of the Promoter, participating retailers and their employees, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
3. To be eligible to claim, Claimants must purchase an Eligible Kenwood Product(s) from any participating Australian retail store during the Promotional Period. Claimants will be eligible to receive the cashback amount that corresponds to the model number of the Eligible Kenwood Product(s) purchased. Purchases apply to:
a. FP980, FP950, FP920, MG700, JE850 or BL760 and receive $50 cashback;
b. FP270, FP250, KM270C, KM270R, KM270W, KM270B, KM270Y or KM270P and receive $30 cashback.
4. Promotion commences on March 12, 2012 (12:00am) and concludes May 31, 2012 (11:59pm). All times indicated are AEST. Purchases made outside these dates will be deemed outside the promotional period and declared as void.
5. Customers must either complete the Online Redemption Form by visiting www.kenwood-australia.com/redemptions/ or complete the Printed Redemption Form available from selected retailers and provide a copy of their purchase receipt and send it to: Kenwood Mother’s Day Cashback Offer, PO Box 4540 Casula Mall NSW 2170.
6. Online redemptions close on May 31, 2012 (11:59pm AEST). Postal entries and redemption claims must be received by June 15, 2012 (5:00pm AEST); otherwise claims will be deemed invalid.
7. This cashback offer is not redeemable in store.
8. Entrants must retain their original purchase receipt(s) as proof of purchase. Failure to provide an original (or copy of) purchase receipt(s) to the Promoter upon request will result in an invalid entry and forfeiture of any right to the cashback. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was and during the promotional period, but prior to claim/entry.
9. If a product is returned or refunded, the claim on the cashback amount will be null and void. Any amounts claimed and redeemed will need to be refunded to the Promoter.
10. Multiple claims are permitted, subject to the following: (a) only one claim permitted per specified purchase; and (b) each claim must be submitted separately and in accordance with the claim requirements. The Promoter’s decision is final and no correspondence will be entered into.
11. Offer is valid on retail purchases only. Internet sales, commercial sales, second-hand purchases and trade seconds products are excluded.
12. Payment of the cashback amount will be honoured by money order (not cheque, cash or direct bank transfer). Please allow 14 weeks for processing and delivery of the money order. The Claimant must ensure that all details provided for the payment of the cashback amount are correct. Delivery of the money order will be to one address only. No re-direction of cashback will be accepted. The Claimant is responsible for providing full and accurate details and the Promoter will not be responsible for a banking institution rejecting a money order or any costs associated in locating these monies.
13. This offer is not transferable or exchangeable for cash.
14. Claims will be deemed to be accepted at the time of receipt and not at the time of transmission. The Promoter accepts no responsibility for any claims not received by the Promoter or delays in the delivery of the claims that may interfere with the Claimant’s ability to participate in the promotion due to technical disruptions, network congestion or for any other reason.
15. Any costs incurred by the Claimant associated with claiming the cashback offer including accessing the Kenwood website, telephone enquiries in relation to the offer are the sole responsibility of the Claimant.
16. Claims must be complete, decipherable and legible. The Promoter reserves the right at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
17. Nothing in these Terms and Conditions limits, excludes or modifies, or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to interference; (d) any way out of the promotion, any claim or gift that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (e) any variation in gift value to that stated in these Terms and Conditions; (f) any tax liability incurred by a Claimant or (g) use of the cashback offer.
18. By making a claim, unless otherwise advised by the Claimant, the Claimant consents to the information they submit with their claim being entered into the Promoter’s database and this information may be used in any media for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the Claimant. All personal details of the Claimant will be stored and becomes the property of the Promoter, and is subject to Kenwood’s Privacy Policy, see http://www.kenwood-australia.com/legal/privacy.asp. A request to access, update or correct any information can be made by contacting the Promoter on 1800 126 659.
19. The Promoter is De’Longhi Australia Pty Ltd (ABN 49 104 012 857) of Nexus Industry Park, Building 3A, 43 Lyn Parade, Prestons NSW 2170.
