TERMS AND CONDITIONS
1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Eligibility to Enter
2. Entry is only open to Australian residents aged 13 years or over.
3. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotional Period
5. The promotion commences at 12.00am AEST on 3 July 2012 and ends at 11.59pm AEST on 30 July 2012 (“Promotional Period”).
How to Enter
6. To enter, eligible individuals must complete the following steps during the Promotional Period:
(a) visit
www.facebook.com/betadineAU (“Betadine Facebook Page”);
(b) ‘like’ the Betadine Facebook Page (if not done so already);
(c) click the promotional tab to be directed to the promotion entry page;
(d) watch the ‘Guess that Gargle” video on screen;
(e) input the requested details including their full name, residential address, phone number, valid email address and the correct answer to the question (relating to the ‘Guess that Gargle’ video they watched); and
(f) submit the fully completed entry form.
A new ‘Guess that Gargle’ video will be posted onto the Betadine Facebook Page each week of the Promotional Period. Only entries with the correct answer to the promotional question will be included in a draw and eligible to win.
7. Limit one (1) entry per person and Facebook account for each week of the Promotional Period. Each entry must be submitted separately and in accordance with the entry requirements.
Draws & Prizes
8. A draw will take place for each week of the Promotional Period. Entries open and close for each weekly draw on the dates and times stipulated in the table below. The weekly draws will take place at Sanofi-Aventis Healthcare Pty Ltd, 87 Yarraman Place, Virginia, Queensland 4014 at 2pm AEST on the dates stated in the table below. Non-winning entries in each weekly draw will be entered into any subsequent weekly draws.

9. The first valid and correct entry drawn in each weekly draw will win a $1,000 cheque (made payable in the name of the winner). Prizes are not transferable.
10. Winners will be notified by phone and email, and the winners’ names will be published in The Australian newspaper on 16 August 2012. Each weekly winner’s name will also be published on the Betadine Facebook Page within 14 days of the respective draw.
General
11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
12. Incomplete or indecipherable entries will be deemed invalid.
13. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
14. The Promoter’s decision is final and no correspondence will be entered into.
15. If a winner of any prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian on the winner’s behalf.
16. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize by the time stipulated by the Promoter, then the will be forfeited.
17. Total prize pool value is $4,000.
18. A draw for any unclaimed prizes may take place on 12 November 2012 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified by phone and email and their names will be published in The Australian on 23 November 2012.
19. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
21. Any cost associated with accessing the Betadine Facebook Page is the entrant’s responsibility and is dependent on the Internet service provider used.
22. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
23. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking and/or use of a prize.
25. As a condition of accepting a prize, each winner (or his/her parent/guardian, in the case the winner is under the age of 18) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
26. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
27. Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at

Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.

If you are a patient: We sometimes provide naturopathic consultations or advice,
either in person, over the phone, or via our websites. To provide this kind of advice effectively, we may need to collect information about you and your health. We retain this information in order to provide you with a professional level of care, and any personal health information provided to our naturopathic staff is used only for this purpose. Information collected by our naturopaths isn’t used for direct marketing or other purposes not related to providing you with health advice, unless you specifically consent to it.
Sometimes health information is used for statistical analysis or other management purposes. When this happens, we respect your privacy, and the results will not identify you.
If you are a consumer: Consumers who use our products are sometimes invited to enter competitions or promotions, or to subscribe to our publications. This may involve providing us with personal information. When we obtain personal information this way, we retain it in order to manage the competition, promotion or subscription. We may also retain your contact details to advise you of promotions or provide other information that may interest you in the future.
Anyone can ask to be removed from our mailing list.

Sanofi will display personal details only when the user has given prior consent. The details that will be displayed are the users name as is appears on their personal Facebook profile. When users give consent to Sanofi to use their personal details, they are also affording Sanofi permission to post on their wall on their behalf.

Sanofi will safe-guard personal information using all reasonable security measures against loss or theft, as well as unauthorized access, disclosure, copying, use or modification. Your personal information will not under any circumstances be transferred to a third party without your prior consent.
Share
The share function on the Sanofi Facebook application affords users the ability to share the Sanofi application with their Facebook friends. The share function will post content on the users wall on their behalf detailing that they have shared the application. This post will then appear in the news feeds of the users’ friends. No further personal details will be shared without prior consent from the user.
