GREEN’S Grins - TERMS AND CONDITIONS
1. Information on how to enter & prizes form part of these Terms & Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions. Any entry not complying with these Terms and Conditions is invalid.
2. Entry is open to residents of Australia (“Eligible Entrant”). Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this competition and their immediate families are ineligible to enter.
3. The competition commences from 10:00am the 24th July 2012 Australian Eastern Standard Time (“AEST”) and closes at 9:59am AEST on the 18th September 2012 (“Competition Period”).
4. To enter, Eligible Entrants must, during the Competition Period, register their participation via the Greens Foods Grins application (“Application”) on the Facebook Platform (which can be located on the Greens Grins Tab on the Greens Foods Baking Facebook Page (
www.facebook.com/greensbakingaustralia), upload a photo they have taken showing a “baking moment” and then submit the fully completed online entry form. Eligible Entrants must “Like” the Greens Foods Baking Facebook Page and agree to allow the Application, prior to being able to submit an entry.
5. Without limiting the generality of the above, entries must not contain any material determined by the Promoter in its absolute discretion to be obscene, offensive or inappropriate. The Promoter will review each entry for suitability for entry into the competition. The Promoter reserves the right, at any time, to refuse to accept any entry or remove any entry from display that it deems, in its absolute discretion, to be obscene, offensive or inappropriate, or infringing upon the rights of any third party.
6. Once vetted by the Promoter in accordance with the above, entries that are deemed suitable, in the Promoter’s absolute discretion, will be uploaded on to the Application gallery for the purposes of public viewing.
7. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process, including but not limited to making multiple entries, or for otherwise submitting an entry that is not in accordance with these Terms and Conditions. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. Eligible Entrants must own the rights to the entry image to enter the competition. Images belonging to a third party (i.e. Google images, stock photos or third party sites, etc.) will be deemed invalid and the entry will not be eligible for the competition.
9. Entry and participation in the competition is dependent on Eligible Entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at
www.facebook.com/terms.php 10. This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Eligible Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an Eligible Entrants provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this competition must be directed to the Promoter and not to Facebook.
11. Incomplete or indecipherable entries will be deemed invalid.

Entries are limited to one (1) entry per Facebook ID per Round. 13. There will be eight (
rounds for this competition (“Rounds”). Entries close for each Round at 11:59pm AEST on the dates specified in the below table. The judging will take place for each Round at Green’s General Foods Pty Ltd, 29 Glendenning Road, Glendenning, NSW 2761 on the dates specified in the below table. Non-winning entries in each Round will NOT be entered into any subsequent Rounds.

14. This competition is a game of skill and chance plays no part in determining the identity of the winners. All valid entries received during the Competition Period will be judged to determine the most memorable baking moments.
15. Winners will be notified by email within 48 hours of the judging.

The best valid entry in each Round, as determined by the judges, will each win a baking prize pack valued at $1,008.86. Each baking prize pack includes:

■Fry Pan $99.00 17. Total prize pool value is $8,070.88. Prizes are not transferable, exchangeable and cannot be taken as cash unless otherwise stipulated.
18. Judge’s and Promoter’s decision is final and no correspondence will be entered into.
19. In the event that a prize item is unavailable despite the Promoter’s reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value, in their sole discretion.
20. By entering the competition, each Eligible Entrant agrees to the use of their entry for printing, broadcast, publicity and promotional purposes, including but not limited to the Greens Baking Australia Facebook Fan Page (
http://www.facebook.com/greensbakingaustralia) and the Promoter’s website/s without compensation or prior notification, and agrees that the Promoter will own all intellectual property rights, including copyright, in any such material. It is a condition of accepting any prize that the winner acknowledges that the Promoter acquires the entry for use for its commercial purposes and agrees not to object to any such use on the basis of any moral right.
21. Prizes will only be delivered in Australia and each winner should allow 28 days from the conclusion of judging for delivery of their prize. The Promoter strongly recommends a current residential street address be provided when requested for ease of correspondence and prize delivery. Method of prize delivery will be via courier post and the Promoter makes all reasonable efforts to deliver prizes to the addresses provided by the winners.
22. Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an Eligible Entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this competition.
23. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
24. Eligible Entrants consent to the Promoter using the Eligible Entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
25. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to: (a) disqualify any Eligible Entrant; or (b) to modify, suspend, terminate or cancel the competition, as appropriate.
26. Any cost associated with accessing the competition website is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Eligible Entrant invalid.
27. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.
28. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use/taking of a prize.
29. The Promoter collects personal information in order to conduct the competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The details of persons making online entries will be held in accordance with the Greens General Foods Privacy Policy which can be accessed by visiting
http://greensbaking.com.au/privacy. All entries will become the property of the Promoter. Eligible Entrants should direct any request to access, update or correct information to the Promoter. Each Eligible Entrants submitted entries will be stored by the Promoter for further research purposes.
