HERALD SUN “ART EXHIBITIONS AUSTRALIA PORTRAITS OF SPAIN” COMPETITION
TERMS AND CONDITIONS
1. The promoter is The Herald & Weekly Times Pty Ltd (ABN 49 004 113 937) of 40 City Road Southbank, Victoria 3006.
2. Instructions on how to enter form part of the conditions of entry. The judge’s decision is final and no correspondence will be entered into.
3. Entry is only open to residents of Victoria aged 18 and over. Employees of the Promoter and their immediate families, directors, management, related companies, and their agencies associated with this promotion are ineligible. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
4. To enter, readers must SMS their name, and address to 197 127 12 the sms number as printed in the Herald Sun. SMS cost 55 cents including GST.
5. The competition commences Saturday July 28 at 12:01am (AEST) and concludes at 11:59pm (AEST) Saturday August 4, 2012. (“the Competition Period”).6. Multiple entries are accepted provided that each entry is submitted separately in accordance with the entry instructions. SMS entries via internet or computer generation are invalid and will not be accepted.
7. The SMS entry mechanic is only open to readers with an SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard. For SMS help call 1300 131 276.
8. The time of entry will in each case be the time the SMS message is received by Salmat IDR, Level 2, 116 Miller Street, North Sydney, NSW 2060.
9. The promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries.
10. The draw will take place at 11.00am (AEST) on Monday August 6, 2012 at Salmat IDR, Level 2, 116 Miller Street, North Sydney, NSW 2060.
11. The winners will be notified in writing within ten days of the draw and published in the Herald Sun public notices on Saturday 11th August 2012
12. The winner will receive;
• Return economy airfares for two (2) from Melbourne (Tullarmaine) to Brisbane with Virgin Australia. Flights to be booked by the Queensland Art Gallery and tickets are non-transferrable. Queensland Art Gallery Standard Virgin Australia terms and conditions apply. (valued at $650).
• Two (2) nights accommodation at the Hilton Brisbane - valid between 1 September 2012 – 4 November 2012. To be booked by the Queensland Art Gallery (valued at $650).
• Two (2) exhibition entry tickets – can be used during Up Late (valued at $44).
• A ‘Portrait of Spain’ merchandise pack, including exhibition catalogue (valued at $150).

13. The prizes are not exchangeable and cannot be taken as cash. Any additional charges are the responsibility of the winner (including but not limited to transport and/or additional meals). The Promoter accepts no responsibility for any variation in the prize value.
14. The prize will be fulfilled by Queensland Art Gallery and managed with the prize winner directly. Prizes can be subject to change at any time by Queensland Art Gallery. Should the exhibition not go on for any reason winners cannot indemnify Queensland Art Gallery of any wrong doing or inability to provide the full prize should it be out of their control, however a best alternative prize will be provided wherever possible.
15. Queensland Art Gallery accepts no responsibility if the event is cancelled, or is re-scheduled for any reason whatsoever. If the prize or any part of the prize becomes unavailable for reasons beyond the Promoters’ control, the Promoters will endeavour to provide a substitute prize of equivalent value.
16. Should the winner not be able to accept the prize as offered, then the prize is completely forfeited and a replacement prize will not be offered.
17. Tickets are issued subject to Queensland Art Gallery conditions of sale and entry.
18. The Promoter accepts no responsibility for any lost, damaged or misdirected mail resulting in the loss of tickets.
19. Once prizes have left the promoter’s premises, the Promoter and their associated agencies take no responsibility for prizes damaged, delayed or lost in transit.
20. Subject to any written directions given by the relevant state regulation, an unclaimed prize draw will take place at Salmat IDR Level 2, 116 Miller Street, North Sydney NSW 2060 on Friday August 10, 2012 at 11:00am (AEST) and the winner will be notified in writing within two days of the draw.
21. The Promoter and its partners shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. Neither is the Promoter and it’s partners responsible for any incorrect or inaccurate information, either caused by the entrant or any of the equipment or programming associated with, or utilised in this competition, or for any technical error, or combination thereof that may occur in the course of the administration of this competition, including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite failure, theft or destruction or unauthorised access to, or alteration of, entries.
22. If for any reason, this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this
promotion, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition subject to any written directions given under State Legislation.
23. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury, loss or damage (including loss or opportunity) whether direct, indirect, special or consequential, arising in any way out of the promotion, including but not limited to, where arising out of the following:
a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
b) any theft, unauthorised access or third party interference;
c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
d) any variation in prize value to that stated in these conditions of entry;
e) any tax liability incurred by a winner or entrant;
f) the broadcast of any program relating to the competition or the publication of any material, including statements made by any compere, staff member, journalist, other entrants or any other person; and/or
g) participation in the prize.
24. The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
25. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions of entry, or who has, in the opinion of the Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
The Promoter collects entrants’/claimants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant/claimant may not participate in the promotion. The Promoter may share entrants’/claimants’ information with persons or entities assisting in the conduct of the promotion and with companies who are prize partners. By participating in the promotion, unless otherwise advised, each entrant/claimant also agrees that the Promoter may use this information to contact the entrant/claimant by any means (including SMS) at any time in the future to let them know about goods, services and promotions which may be of interest to them without any further reference, payment or other compensation to the entrant/claimant.
