Terms & Conditions
The promoter
1. The beyondblue Cup competition is being held and promoted by Beyond Blue Ltd ABN 87 093 865 840, 40 Burwood Road, Hawthorn, Victoria 3122 (the Promoter).
Who may enter
2. The only persons who may enter and be awarded prizes are Australian residents who are not employees of the Promoter or the immediate family of such employees. ‘Immediate family’ means spouse, parent, child or sibling, whether or not they live in the same household as the employee.
Conditions of entry
3. By entering the competition, participants agree to be bound by these Terms and Conditions.
Limitations on entry
4. Participants may only enter the competition once. However, an entrant may receive up to five bonus entries for each friend that enters the competition from their referral.
How to enter and selection of winners
5. Entry to the competition is by registering entrant name, email and choosing one name from the ‘Hawthorn’ or ‘Geelong’ option.
6. The competition opens at 5pm on Friday, 20 July 2012 (EST) and concludes at midnight on Sunday, 19 August 2012 (EST) (the Draw Period). The draw will be conducted by a random selection of all valid entries for each prize. The first valid entry for each prize will win that prize: a framed and signed Hawthorn Football Club jumper or a framed and signed Geelong Football Club jumper respectively, with each prize valued at $300.
7. Each valid entry that is entered during the Draw Period will be entered into the draw. The draw to determine the winners will take place at 10am (EST) on Monday, 20 August 2012 at the offices of the Promoter, located at Level 1, 40 Burwood Road, Hawthorn, Victoria 3122.
8. Any entry deemed incomplete or incomprehensible by the Promoter will be considered invalid. Any entry that is entered outside of the Draw Period will be invalid.
9. The winners will be notified by email within 10 days of the draw.
10. The names of the two winners will be published on
www.facebook.com/beyondblue on Monday, 20 August 2012 and in The Australian newspaper’s Public Notices of Friday, 24 August 2012.
The prizes
11. There are 2 prizes in total:
(i) the first valid entry drawn by entrants choosing ‘Hawthorn’ in the competition registration will receive a signed Hawthorn Football Club jersey valued at $300.
(ii) the first valid entry drawn by entrants choosing ‘Geelong’ in the competition registration will receive a signed Geelong Football Club jersey valued at $300.
12. The total value of all prizes is $600.
13. If any aspect of the prize cannot be provided to the winner for any reason, the Promoter reserves the right to substitute to the winner a prize of equal or greater value (subject to law).
14. Prizes must be taken as offered and are not exchangeable, transferable, or redeemable for cash.
15. The promoter reserves the right to substitute a prize of equal or greater value.
16. Prizes unclaimed after one month from date of notification of the winner may be forfeited and used by the Promoter at the discretion of the Promoter.
Privacy
17. The personal information collected as part of your entry is collected to enable identification of the winner and for future marketing and promotional purposes by the Promoter. It will be stored and used in accordance with the Promoter's Privacy Policy which is available on its website (
www.beyondblue.org.au). The personal information will not be made available or sold to third parties.
18. The Promoter may ask winners to participate in a promotion related to the draw, which may include taking the winner's photograph. The winner agrees to participate in such promotion and is not entitled to any fee for their participation.
Internet
19. If for any reason a competition does not run for its duration due to a computer virus, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter that corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition or disqualify any individual who tampers with the entry process. The promoter is not responsible for:
a. Malfunction, delay or traffic congestion on any network or line, computer on-line system, servers or providers, computer equipment, software or website; or
b. Failure of any email or entry to be received by the promoter.
Limitation of liability
20. The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods by any person to the prize winner and, where applicable, to any persons accompanying the prize winner. This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law. To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any such rights is limited to the payment of the costs of having the prize supplied again.
