“MCDONALD’S® MADAGASCAR 3 HAPPY MEAL COMPETITION”
1. Information on how to enter, mechanics of entry and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each Entrant. Entry is via mail or Internet only.
ELIGIBILITY
2. Entry is only open to Eligible Entrants. An "Eligible Entrant" is an individual who: (i) is a resident of Australia aged 13 years, or younger, as at the time of entry; (ii) is not an employee of the Promoter or any of its related corporations or franchisees, printers, suppliers, providers or any of their agencies associated with the Competition; and (iii) is not a spouse, defacto spouse, parent, ward, child or sibling (whether full, half, step or by adoption) of such an employee.
3. Eligible Entrants must obtain the permission of a parent or legal guardian to enter and submit their personal information.
4. Entries of entrants who enter the promotion without disclosing (or who attempt to conceal) their age (as and where required) and/or do not provide proof of the required parental/guardian consent (as and where required) will be deemed invalid.
5. These conditions bind entrants and any parent or guardian who gives their consent.
ENTRY PERIOD
6. Entry commences at 12:01 am on 16/08/2012 and closes at 11.59pm on 19/09/2012 (Entry Period).
7. All times and dates are times and dates in Sydney which may be AEST or AEDT depending on the date.
HOW TO ENTER
8. To enter the promotion, Eligible Entrants must, during the Entry Period, enter by post or online as follows:
(i) Postal Entry (Purchase required)
a) Purchase any one (1) specially marked McDonald’s Madagascar 3 Happy Meal box (Box) from any participating McDonald’s restaurant;
b) Cut out and fully and correctly complete the entry form printed on the Box in the manner required, including filling out the Eligible Entrant’s full name, residential address, contact telephone number and date of birth; and

c) Post the completed entry form in a stamped envelope to:

All entry forms submitted by post: (i) must be received by the Promoter during the Entry Period; (ii) must each have a separate, original entry form from a Box to be eligible - photocopies or images of entry forms will not be accepted

d) Visit
www.happymeal.com.au (Promotional Website) and navigate to the Madagascar 3 Competition page; and
e) Fully and correctly complete and successfully submit the online entry form in the manner required, including filling in the Eligible Entrant’s full name, residential address, contact telephone number and date of birth.
All entries submitted at the Promotional Website must be received by the Promoter during the Entry Period; the time of transmission is irrelevant.
9. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, illegible or incomprehensible entries will be deemed invalid. Entries missing any of the Entrant’s details will be deemed invalid. Any contact details provided incorrectly in an entry will invalidate that entry. The Promoter accepts no responsibility for late, lost or misdirected entries.
10. Multiple entries are permitted. However, each entry: (i) submitted by post requires the purchase of a separate Box; (ii) must be submitted separately and must independently comply with these Conditions of Entry.
11. Any costs associated with accessing the Promotional Website remain the responsibility of an Entrant and are dependent on the Internet service provider used.
12. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
DRAW
13. The prize draw to determine the winners will take place at 3:00pm on 3/10/2012 at Suite 205, 22 Mountain Street, Ultimo NSW 2007. Winners will be notified by telephone and in writing and the Major Prize winners’ names and locality will be published in The Australian on 17/10/2012. All reasonable steps to notify the winners of the results of the draw will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
PRIZES OVERVIEW

14. There are 2 Major Prizes and 50 Minor Prizes to be won (fifty-two (52) prizes in total). Total maximum prize pool value $23,500.
15. The Eligible Entrants whose entries are: (i) the first two valid entries drawn, will each win each one Major Prize; (ii) the next fifty valid entries drawn, will each win one Minor Prize.
16. Prizes are not transferable or exchangeable and cannot be taken as cash. Prizes must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any variation in prize values. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. All prize values are the recommended retail price including GST (depending on point of departure for the Major Prize). Minor Prizes will be sent to the winners’ nominated addresses within a reasonable time of the winners being notified and their eligibility verified.
MAJOR PRIZES
17. Each Major Prize is valued at a maximum of $11,000 as at 9/3/2012 and comprises for its winner and, subject to condition 20, 3 guests of his/her choice:
i. except where Brisbane is the Australian State or Territory capital city closest to the winner’s place of residence, return economy flights on an airline of the Promoter’s choice to the Promoter’s choice of either Brisbane or Coolangatta airport (“Flights”);
ii. four nights quad share accommodation in a 3 star hotel of the Promoter’s choice at Surfers Paradise ("Accommodation");
iii. if Flights are provided, return transfers between the arrival airport and the Accommodation;
iv. two days unlimited entry to Dreamworld and WhiteWater World;
v. two return transfers between the Accommodation and Dreamworld / WhiteWater World; and
vi. on one of the two days of unlimited entry to Dreamworld and WhiteWater World, entry to Dreamworld prior to the public opening and a “meet and greet” with the Madagascar characters.
18. Prize travel must be completed no later than 2/10/2013 and cannot be taken during public school holidays in any Australian State or Territory or between 19-21 October 2012 (inclusive). Major Prize Flights and Accommodation will be arranged by the Promoter and no frequent flyer points may be earned. The winner of a Major Prize must give at least 21 days notice of proposed commencement of travel.
19. The Accommodation and related travel is subject to availability at the time of booking and, if any component of a Major Prize is unavailable on the dates proposed by the winner, the Promoter will consult with the winner to determine alternative dates on which their Major Prize will be booked.

20. All aspects of a Major Prize’s Flights and Accommodation are for the winner and his/her three guests travelling and staying together. The winner of a Major Prize is free to select any person as a guest, provided that: (a) at least one of the guests is a parent or guardian of the winner; and (b) at the time that the Major Prize travel commences: (i) one of the guests is 21 years of age, or older, and (ii) at least one of the other two guests is 13 years of age, or younger. The Promoter may require the guests to confirm in writing that they agree to comply with the provisions of these conditions relating to guests (see condition 31).
21. Once Major Prize tickets/bookings have been arranged by the Promoter, changes to a Major Prize’s Flights and Accommodation arrangements are at the expense of the Major Prize winner.
22. All components of a Major Prize must be taken together as a single trip to be booked by the Promoter. Any part of a Major Prize that is not taken for any reason is forfeited.
23. A Major Prize does not (except as expressly stated) include:
i. any transport between a traveller's residence and: (a) the departure airport (if Flights are provided); or (b) the Accommodation (if Fights are not provided);
ii. any overnight accommodation while travelling to the departure airport or destination;
iii. any other travel or accommodation;
iv. any meals;
v. any incidental accommodation charges (such as, telephone calls and video rentals);
vi. any spending money;
vii. any insurance (such as travel or health cover);
viii. any vaccinations or other medical or health related services;
ix. any other ancillary costs which may be incurred by the winner or his/her guests in relation to the Major Prize.
24. A Major Prize cannot be exchanged for other travel or accommodation at other destinations.
MINOR PRIZES
25. Each Minor Prize comprises one (1) Madagascar DVD & one (1) Madagascar: Escape 2 Africa DVD. Each Minor Prize is valued at $30.00.
GENERAL
26. The Promoter may conduct a further draw at the same time and place as the original draw as is necessary on 23/1/2013 in order to distribute any prizes (if any) unclaimed by that date, subject to any written directions given under

applicable State or Territory legislation. In the event of any winner or winners in the unclaimed prize draw, the winner or winners will be notified by telephone and in writing. If a Major Prize is awarded in the unclaimed prize draw, the name(s) and locality /localities of the winner(s) of Major Prize(s) will be published in The Australian on 6/2/2013. All reasonable steps to notify the winners of the results of the draw will be taken by the Promoter. The Promoter’s decisions are final and no correspondence will be entered into.
27. Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request an Entrant to produce (within the requested time) appropriate photo identification or any other documentation (to the Promoter’s satisfaction at its sole discretion) in order to confirm the Entrant’s identity, age, residential address and email address, eligibility to enter the promotion and claim a prize, and any information submitted by the Entrant in entering the promotion (including confirming consent of an Entrant’s parent or legal guardian and also the name, age and address of the parent or legal guardian that gave their consent) before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agents) or an Entrant or entry (including Box, if applicable) has not been verified or validated to the Promoter’s satisfaction within the time requested, then all the entries of that Entrant will be ineligible and deemed invalid.
28. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any Entrant for: a) tampering with the entry process; or b) for submitting an entry which is not in accordance with these Conditions of Entry; or c) if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
29. A prize will only be awarded following any winner validation and verification that the Promoter (or its nominated agents) requires in its sole discretion.
30. The Promoter reserves the right to request the Major Prize winner’s companion(s) produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the companion(s)’ (if any) identity and age before booking the Major Prize.
31. In order to be entitled to any prize, the winner (and, if he/she wins a Major Prize, a parent or guardian of the winner and each person aged 18 years or older accompanying the winner on the Major Prize travel) must, if requested by the Promoter, agree to and sign and return:
i. an eligibility form confirming their compliance with the Conditions and eligibility to accept the prize and/or participate in the prize; and
ii. a liability release, waiver and/or indemnity in a form determined by the Promoter in favour of the Promoter and/or any person or other entity associated with this Competition.

The winner of a Major Prize must also ensure that a parent or guardian of any guest under 18 years of age agrees to and signs the documents referred to above (if requested by the Promoter). A winner will forfeit his/her prize if he/she fails to ensure that all documents relating to that prize (or participation in that prize) are signed and returned in accordance with this condition, as and when required by the Promoter.
32. The Promoter, its franchisees and its associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law, for any direct or indirect injury, loss and/or damage arising in any way out of the promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prizes; and/or (iv) acceptance and/or use of any prize. Applicable manufacturers and/or distributors should be contacted in regards to all prize warranty claims.
33. If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State or Territory legislation.
34. If this promotion is not capable of running as planned for any reason, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion and/or, if necessary, to provide an alternative prize or prizes to the same value of an original prize or prizes, subject to any written directions made under applicable State or Territory legislation.
35. Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Website or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an Entrant or the Entrant’s parent or legal guardian, the Entrant and the Entrant’s parent or legal guardian agrees to indemnify the promoter for those losses, damages and costs.
36. As a condition of entering this promotion, an Entrant and the Entrant’s parent or legal guardian consents to the Promoter using the Entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in the event they are a winner in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any

outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The Entrant and the Entrants parent or legal guardian agrees that, in the event that the Entrant is a winner, the Entrant will participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its agents, and expressly gives the Promoter permission to publish the Entrant winner’s name and locality in any media (including but not limited to on
www.happymeal.com.au and, for the Major Prize winner, in The Australian), as required under the relevant State or Territory lottery legislation.
37. An entry and any copyright subsisting in an entry irrevocably becomes, at the time of entry, the property of the Promoter. The Promoter collects personal information about an entrant to include the Entrant in the promotion and where appropriate award prizes. If the personal information requested is not provided, the Entrant cannot participate in the promotion and is deemed ineligible. Entrants can also gain access to, update or correct any personal information by contacting the McDonalds Privacy Officer by mail at PO Box 392, Pennant Hills NSW 2120. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter or by clicking on the Privacy Policy link on

38. The Promoter is committed to helping its customers make informed decisions about their food and beverage choices. The Promoter provides healthier food and beverage options for adults and children and ensures nutritional information is easily accessible to its customers. Nutritional information is available on websites, including on the Promoter’s website (
www.mcdonalds.com.au), in McDonald’s restaurants and, wherever possible, on product packaging.
