TERMS AND CONDITIONS
 
CONDITIONS OF ENTRY
1.Entry is only open to NSW, ACT, VIC and QLD residents. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
2.Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3.To be eligible to enter the promotion, individuals must visit any 7-Eleven store in NSW, ACT, VIC or QLD during the store trading hours on the BYO CUP Day (being 5/09/2012) and fill their own cup with Slurpee for $2.90.

All cups must be clean, watertight, safe to consume from (in the opinion of the Promoter’s representatives) and must fit within the following size dimensions: 230mm (width) x 260mm (height). 
4.Entries open 7:00am AEDST 05/09/2012 and close 11.59pm AEDST on 12/09/2012. 
5.To enter, individuals must complete the following steps:
a.Take an original photo of their BYO cup (containing the Slurpee product as filled at the 7-Eleven store). The photograph can also include the entrant, however the BYO cup  must be clearly visible;
b.Visit http://www.facebook.com/SlurpeeAustralia and follow the prompts to “like” the http://www.facebook.com/SlurpeeAustralia  page (if they do not already “like” the page); and
c.Follow the prompts on the page to access the promotional application (and allow access to the application to their profile in the manner required), folly complete the entry form by providing all of the requested details, including first and last name, valid email address, date of birth and state of residence, upload the photograph of their BYO cup, tick all of the mandatory tick boxes and submit the folly completed entry form.
6.Uploaded files must be submitted in JPEG, GIF or PNG format and must not exceed 2 MB file size. Photographs submitted must be in compliance with clause 26.
7.Moltiple entries are permitted, subject to the following: a.only one entry permitted per BYO cup; 
b. each BYO cup entry must be substantially different to an entrant’s  other  BYO cup entry; and
c. each entry must be submitted separately and in accordance with entry   requirements.

8.Photographs will be reviewed when made publicly available; however, such review does not relieve the entrant from responsibility and compliance with these Terms and Conditions. Entries that do not comply with these Terms and Conditions or that otherwise contain prohibited or questionable material, or inappropriate content, or do not contain the Slurpee Product, as determined by the Promoter, will not be eligible  and will be disregarded and removed.  Chance plays no part in determining the winning entrants.  All final determinations as to which Entries are eligible to take part in this promotion are at the Promoter’s sole discretion and no correspondence will be entered into.
9.The winners will be selected by a panel of Judges appointed by the Promoter who at their discretion will select the winning entries.
10.First Winning Entry:  The Judges will decide on the Best Cup of 2012.  The winning cup will be judged on originality and creativity.  Second Winning Entries:  The Judges will also decide on three secondary awards: Best Use Of A Household Item, So Wrong But So Right and Proud As Punch.
11.The Judges’ decision on the winning entries will be final and binding on every entrant.  No correspondence will be entered into. 
12.All winners will be announced on www.slurpee.com.au and on Slurpee’s Facebook page on 24/09/2012.  All winners will be notified by email and Facebook Private Message.
13.The Best Cup of 2012 winner will receive a year’s supply of free medium Slurpees valued at $949, awarded in the form of a VIP Slurper Card (with an expiry date of one year from the date of first use) and the BYO Cup Day trophy. A year’s free supply equates to 365 free medium Slurpees. Slurpees are redeemable at participating 7-Eleven stores. 
14.The winners of the secondary prizes will each receive one month’s supply of free medium Slurpees valued at $78, awarded in the form of a Serial Slurper Card (with an expiry date of one month from the date of first use).  A month’s free supply equates to 30 free medium Slurpees.   Slurpees are redeemable at participating 7-Eleven stores.
15.Prizes will be posted to the physical address nominated by each winner details of which will be supplied to the Promoter.  No responsibility will be accepted by the Promoter for any lost or misdirected mail.
 

GENERAL

16.Information on eligibility requirements, how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
17.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
18.Incomplete or indecipherable entries will be deemed invalid.  No responsibility is taken for late or misdirected entries.
19.If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
20.Any ancillary costs associated with redeeming the Slurpee vouchers (if applicable) are not included. Any unused balance of the Slurpee voucher will not be awarded as cash. Redemption of the Slurpee voucher is subject to any terms and conditions of the issuer including those specified on the Slurpee voucher.
21.If a winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
22.If for any reason a winner does not take a prize (or an element of the prize) by the time stipolated by the Promoter, then the prize (or that element of the prize) will be forfeited and may be used by the Promoter at the discretion of the Promoter.
23.If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regolatory authority.
24.Total prize pool value is $1,433 (Best Cup Trophy valued at $250, year’s supply of Slurpee valued at $949, three prizes of one month’s supply of Slurpee valued at $78 each).
25.Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash or for resale.
26.When an entrant submits any materials via the promotion including comments, recordings and images (“Content”), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the foll authority to grant these rights.

 Entrants agree that they are folly responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the foll extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawfol or fraudolent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain foll prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regolations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

 Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
27.Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
28.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated, or the promotion does not run for its duration,  due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficolties or failure, computer virus, unauthorised intervention or fraud, tampering,  or any other cause beyond the control of the Promoter, the Promoter reserves the right, in its sole discretion, to the follest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regolatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
29.The Promoter will not be responsible for any: a.malfunction, delay, or traffic congestion on any telephone network or line, computer on line system, servers or providers, computer equipment software or website;
b.failure of any entry to be received by the Promoter;
c.injury or damage to entrants or any other person related to or from participation in the competition or downloading any materials in the competition.

30.Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
31.The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries/ submitted by that entrant invalid.
32.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Competition and Consumer Act 2010 (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
33.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,  the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficolties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
34.As a condition of accepting a prize, the Promoter may require each winner to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
35.The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regolatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants shoold direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
36.Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
37.This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained  by an entrant, as a resolt of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
