Ultimate Etihad Adventure Terms and Conditions.
1. Information on how to enter this competition forms part of the conditions of entry. Entry into the promotion is deemed acceptance of these conditions.
2. The promoter is Radio 3AW Melbourne Pty Limited (ABN 47 006 962 358) of Level 7, 655 Collins Street, Docklands VIC 3008 (telephone number (03) 8667 3600) (Promoter).
3. On occasion, prizes are provided to the Promoter by a third party. In this promotion, the major prize has been provided by Etihad Airways. The major prize winner acknowledges and agrees that the provision of the major prize is the sole responsibility of Etihad Airways, not the Promoter. The major prize winner agrees that the Promoter accepts no responsibility or liability for any delay or failure to deliver the major prize. Provided the Promoter provides Etihad Airways with the name and all contact details of the major prize winner, Etihad Airways releases from and indemnifies the Promoter from and against all liability, cost, loss or expense arising out of a claim by the major prize winner (or his or her successors or representatives) in respect of delivery of the major prize.
4. The promotion period begins on Monday 13th August 2012 and finishes on Monday 3rd September 2012 (Promotion Period).
5. The promotion will feature on 3AW’s Sports Today Program (Monday – Thursday, 6pm until 8pm) (The Program)
6. Entry is only open to residents of Australia who are 18 years and older (Eligible Entrants), excluding directors, management, employees and their immediate families of the Promoter, Etihad Airways or Fairfax Radio and each of their related bodies corporate.
7. There is a limit of one entry per Eligible Entrant.
8. The Promoter is not responsible for any lost, late or misdirected entries.
9. The major prize winner will be selected by Etihad Airways in conjunction with the program and announced during the program on Monday 3rd September 2012
10. There is one (1) major prize. The major prize consists of 1 x return economy class flight for 2 people departing Melbourne 6th of March 2013 and departing Manchester on 12th of March 2013, a double pass to see Manchester City V Wigan at Etihad Stadium in Manchester on 9th March 2012 with accommodation for 5 nights staying at The Lowry Hotel, in a classic room, in Manchester.
11. 3AW listeners to ‘Sports Today’ will be encouraged to visit 3aw.com.au and tell 3AW about the best Etihad experience they have ever had, either at Etihad Stadium in Melbourne or Manchester or when flying with Etihad Airways. . 8 Minor prizes will be awarded to selected entrants with the major prize winner selected and announced on Monday 3rd September 2012
12. Minor prizes are as follows; 8 x double passes to a 2012 AFL match played at Etihad Stadium during the 2012 home and away season. The matches for which the tickets will be valid will be determined by Etihad Airways.
13. The major prize winner will be notified of their win by a live announcement on 3AW, on the Etihad Airways Facebook page and in writing.
14. The maximum total major prize value is AUD $4553.48 based on the recommended retail value and the exchange rate at the time of printing. The Promoter and Etihad Airways accept no responsibility for any variation in the value of the prizes.
15. Each prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated. Each prize is non-transferable, non-refundable and non-redeemable for cash or other goods or services. All flights are subject to conditions of carriage and fare conditions.
16. The result of the prize decision is final and no correspondence will be entered into.
17. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and to disqualify any Eligible Entrant who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
18. By accepting the prize, winners agree that Fairfax Radio, Etihad Airways and the Promoter can use their name, location, photo (taken in conjunction with the prize) and audio of winning for publicity purposes, unless the winner otherwise notifies the Promoter at the time of accepting the prize.
19. The prize winner and their travel companion may be required to sign a release and indemnity form in favour of the Promoter and return the document to the Promoter prior to redeeming their prize.
20. All prize travel must be completed by 31 March 2013 with no extensions. Bookings for flights and hotels must be made by 31 January 2013 . Prize arrangements cannot be changed once they have been booked. The winner and their travel companion must travel together on all flights via the most direct routing and stay in the same hotel room. Prizes will be forfeited if they are not used within the specified timeframe.
21. The following costs are to be borne by each winner and their travel companions: transfer costs in Australia, travel insurance, excess baggage over and above the approved baggage allowance, taxes payable to third parties, ground transportation, meals and any other travel related expenses or costs which are not specifically stated. By accepting this prize each winner and their travel companions accept that these costs are their responsibility.
22. The winner and their travel companions must hold a valid passport in order to use the prize and must obtain any necessary visas to travel at their own expense. Compliance with any health or government requirements is the responsibility of the prize winner and their travel companions.
23. Prize flights and hotel stays are subject to availability and are at the discretion of the Promoter and Etihad Airways.
24. Travel insurance is the responsibility of each winner and their travel companions. Each winner and their travel companions should consider obtaining travel insurance before departure.
25. The Promoter and Etihad Airways accept no responsibility for any tax liability incurred as a result of participating in the promotion and any such tax liability must be paid by each Eligible Entrant. Eligible Entrants should obtain independent tax and financial advice.
26. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend this promotion.
27. If the Promoter or Etihad Airways are unable to provide a winner with the nominated prize, the Promoter and Etihad Airways reserve the right to supply an alternative prize of similar monetary value.
28. The Promoter or Etihad Airways shall not be liable for any part of the prize that is lost, stolen, forged, damaged or tampered with in any way before it reaches the winner.
29. All Eligible Entrants release from, and indemnify the Promoter and Fairfax Radio Network against, all liability, cost, loss or expense arising out of accepting the prize or participation in the competition including (but not limited to) loss of income and/or personal injury.
30. To the full extent permitted by law, the Promoter and Etihad Airways and their related companies and agencies and any of their respective officers, employees, contractors and agents (Relevant Parties) exclude all liability for any loss (including but not limited to any damage, claim, injury, cost or expense) which is suffered or incurred in connection with the promotion or acceptance of a prize, including but not limited to: (i) any direct, indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; and (iii) any liability for personal injury or death. Any liability of the Relevant Parties which cannot be excluded by law is limited to the minimum allowable by law.
31. The Promoter and Etihad Airways encourage consumers to enjoy alcohol responsibly and in moderation. Legal aged consumers are advised to consider the drinking guidelines recommended in the National Health and Medical Research Council’s ‘Australian Guidelines to Reduce Health Risks from Drinking Alcohol’ which states: For healthy men and women, drinking no more than two standard drinks on any day reduces the lifetime risk of harm from alcohol-related disease or injury. For healthy men and women, drinking no more than four standard drinks on a single occasion reduces the risk of alcohol-related injury arising from that occasion.
