TERMS AND CONDITIONS 1.This competition is conducted by FOUR SISTERS PTY LTD ACN FOUR SISTERS PTY LTD ACN 38 069 621 003 Nagambie Vic, Australia 3607 (“Four Sisters”)
2.Information regarding prizes, how to enter and other details contained within promotional advertisements form part of these terms and conditions. By entering this competition, each entrant agrees to be bound by these terms and conditions.
3.Entry is free and is open to fans of Four Sisters Wine who are residents of Australia and are aged 18 years of age or older.
4.Employees of Four Sisters and their immediate families as well as the suppliers and agencies associated with this competition are ineligible to enter.
5.The competition commences at 9.00 am AEST on 20th August 2012 and ends at 11.59 pm AEST on Sunday 2nd September 2012 (“Competition Period”).
6.To enter the competition an entrant must answer the question “Which of your friends you’d love to share a bottle of Four Sisters with and why?” challenge via the “Win with Four Sisters” Facebook application at
www.facebook.com/foursisterswine (“Facebook Application”)
7.Entrants can submit as many unique entries as they wish. Late, incomplete, incorrectly submitted, delayed, illegible, offensive, corrupted or misdirected responses will be deemed invalid and Four Sisters takes no responsibility for any entries that fail to reach the relevant closing date(s) for any reason.
8.Entry must be received by Four Sisters during the Competition Period and will be deemed to be accepted at the time of receipt and not at the time of transmission.
9.Chance plays no part in determining the outcome of this competition. Each valid entry will be judged by a panel of Four Sisters employees and agents (“Panel”). The Panel will judge each entry according to how relevant, creative, unique and inspiring the entry is in line with the requirements of the challenge. All decisions of the Panel are final and no discussions or correspondence will be entered into.
10.There will be 1 winner selected to win a $200 Gift Card from Bettina Liano and a mixed dozen of Four Sisters wine (“Prize”). The winner will be decided on the week commencing 2nd September 2012 and will be be notified by email and via the Facebook Application.
11.The total prize pool is valued at RRP AUD$367.40 + postage and handling
12.If any prize remains unclaimed after 7 days of the winner being announced, Four Sisters may deem that winner as ineligible to receive the prize. In that event, Four Sisters will reconvene the Panel to determine the next most relevant, creative, unique and inspiring response to the challenge from the relevant pool of entrants and the entrant who submitted that response will be deemed the replacement winner.
13.Prizes are not transferable or exchangeable and cannot be redeemed for cash. Four Sisters accepts no responsibility for any variation in the value of prizes. Where a prize is unavailable for any reason Four Sisters may substitute another item of equal or greater value for that prize, as determined by Four Sisters.
14.All prizes will be sent by post to the address provided at the time of entry.
15.Four Sisters takes no responsibility in the event that a prize fails to be delivered to the winner’s address if the postal address supplied at the time of entry is incorrect, or if it is damaged or lost in transit.
16.Four Sisters reserves the right, at any time, to verify the validity of entries and the identity of entrants. Proof of entry and identity will only be deemed as sufficient at the discretion of Four Sisters.
17.If this competition is not capable of being properly conducted due to any reason beyond the reasonable control of Four Sisters, Four Sisters reserves its rights to modify, suspend, terminate or cancel this competition, to the extent permitted by law. Four Sisters may in its sole discretion disqualify any entries where Four Sisters suspects any tampering with the entry process, breach of these terms and conditions or any antisocial, criminal or fraudulent activities.
18.Four Sisters and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the maximum extent permitted by law). Without limiting the foregoing, none of Four Sisters or its associated agencies or companies will be liable for any damage to any prize, which occurs in transit and winners are solely responsible for any tax implications that apply to them.
19.All entries will be the property of Four Sisters. By participating in this competition, each entrant assigns copyright (including future copyright) in and to any entry submitted by such entrant and, to the extent permitted by law, waives his or her moral rights in respect of same. Each entrant warrants to Four Sisters that his or her entry is an original work and of his or her own creation and does not infringe the intellectual property rights of any person. Note that any entry believed to be in breach of copyright laws will be refused entry and the original creator notified. Entrants must indemnify Four Sisters against any loss or damage resulting from any breach of these warranties. Four Sisters may use any entry for promotional, marketing and publicity purposes without compensation.
20.Personal information provided by entrants will be used by Four Sisters for the purpose of conducting this competition and otherwise in accordance with entrants’ consent. Four Sisters may disclose entrants’ personal information to its contractors and agents in relation to the conduct of this competition.
