Participation in this promotion is deemed acceptance of these Terms and Conditions. Entry is only open to individuals who meet the eligibility requirements and comply with the entry instructions below.
To enter you must be a member of facebook. You must then “like” our facebook page (
www.facebook.com/surfingaustraliainc) in order to
submit a photo and complete all mandatory fields on the competition form including a 25 characters or less comment. Once you have submitted your photo you will be deemed to have accepted these Terms and Conditions.
Upon clicking the “submit” button your photo will be submitted for approval to the Administrator. This will happen within 2 business days of the time your photo is submitted. Photos submitted between the hours 5PM Friday and 8 AM Monday will be approved or rejected by 5PM that Monday. The approval process ensures the photos meet all the photo requirements. Once approved, your photo will be entered into the Contest.
Employees (and their immediate families) of the Promoter, participating dealers and agencies associated with this Promotion are ineligible to enter.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is fraudulent or not otherwise in accordance with these Terms and Conditions or any relevant law, or who tampers with the entry process. Each entrant consents to the promoter exercising its rights under this clause by their entry into the Promotion.
Incomplete, indecipherable, or illegible entries may be deemed invalid. Photos should have a minimum resolution of 1024 by 768 pixels and a maximum size of 2MB. Photos may not contain any offensive material, nudity, profanity, racial slurs, etc. You must have the rights to use the photo. Any photo that does not meet this specification will be disqualified. Photos will be approved at the sole discretion of the Administrator.
This competition is open to Australian residents only.
Multiple (3 images maximum) entry permitted per person.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its absolute discretion, to determine the identity of the entrant.
The Nikon ‘My Break’ competition commences from 9.00am (AEST) on the 1st August 2012 and closes at 5pm (AEST) on the 30th September 2012.
This is a game of skill and chance plays no part in determining the winner. Voting will begin on the 15th August.
The winner will be determined by number of votes. Participants are encouraged to share their photo with friends and family to increase their number of votes.
One vote per day per user will be allowed. The winner will achieve the most votes. If there are two photos with the exact same highest number of votes the winner will be determined by whichever photo was entered in the contest first.
The top 5 voted photos at the end of the competition period will receive the following prizes. The winner will receive a Nikon COOLPIX AW100 digital camera, custom Channel Islands surfboard and a Nikon rashie (Total RRP of $1500). 2nd-5th place photographers will receive a Nikon COOLPIX AW100 digital camera and a Nikon rashie. (Total RRP of $2500). Overall prizes RRP of $4000 ($AUS).All Winners (1st-5th) will be notified by email, phone and/or mail on October 4, 2012
The Promoter will make all reasonable efforts to contact the winners. However, if the Promoter has not been able to contact a winner after making three attempts or by the 11th of October the prize will be deemed unclaimed. In this event or in the event of an invalid entry or ineligible entrant the judges will determine the next best entry and award the relevant prize to that entrant.
If any prize is unavailable, the Promoter, in its absolute discretion, may substitute the prize with a prize of equal value and/or specification, subject to any written directions from a regulatory authority. If the monthly prize winner is under 18 years of age, the prize will be awarded to the winner's parent or guardian on the winner’s behalf. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate. When an entrant submits any materials via the promotion including comments, recordings and images (Content), the entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.
