Terms and ConditionsThe following Terms and Conditions apply to the Trafalgar YOURLifeChoices Competition. By entering our competition you accept these Terms and Conditions.
With no previous warning, Terms and Conditions might be modified or updated at any time.
1. Entry and entrants
1.1. This competition allows all Australian residents over the age of 18 to enter the competition. Employees of Trafalgar, YOURLifeChoices and members of their direct families, as well as all of the companies within the Travel Corporation group are ineligible to enter the competition.
1.2 Trafalgar reserves the right to ask for proof of entrants’ or winner’s age and/or evidence to verify the identity at any time during or after the competition.
1.3 The competition closes at 5pm (EAST) on Tuesday 16 October 2012. Any entries received after this date will be invalid.
1.4 Entries must not come from third parties. Bulk entries cannot be accepted.
1.5 In the event of any error, mistake, misinterpretation or disagreement (technological, human or otherwise) regarding the correctness or acceptability of any entries, the decision of Trafalgar shall be final, and no correspondence will be entered into.
1.6 Trafalgar will not be liable to compensate expenses incurred in making an entry. No refund will be made for the cost of any entry.
1.7 To enter, you must invite at least one friend or relative to enter the Competition. To invite friends or relatives, entrants must submit their friends’ or relatives’ names and current and valid email addresses in the manner required and where indicated on the online entry form. You must make sure you have consent of your friends to send the referral email. For each friend/relative that they invite, the Entrant will gain one (1) additional entry into the competition, up to a maximum of 5 (five) additional entries. The operation of the referral mechanic referred to above is subject to the Spam Act 2003. An entrant may refer a particular friend or relative only once during the Promotional Period and entrants who have already entered the competition cannot be referred as friends or relatives by a subsequent entrant. Each entrant’s relative or friend nominated must be an Australian resident over the age of 18 years. Each Entrant warrants that any and each friend or relative that they nominate is known to them personally and that they have consented to receiving commercial electronic messages. For each friend or relative invited (up to a maximum of five) the winner is required to enter a new 25-word answer to the above question.
1.8 You must include your name, email, phone and state to enter the competition. Your phone number will only be used in the event of you winning the prize. Entering the competition also adds your details to the YOURLifeChoices.com.au subscriber list and you will receive regular eNewsletters from YOURLifeChoices.
2. The Prizes
2.1 Prize winner will receive a 9-day (or less) Classic China Trafalgar trip for two people based on twin share. There is no cash or other alternative to the prize stated and the prize is not transferable and no part or parts of the prize may be substituted for other benefits, items or additions. The prize will be valid for departures of Classic China between 13 April – 12 October 2013.
The selected entrant for the First prize (the ‘winner’) and his or her guest shall be responsible for all (extra) flights, insurance (including without limitation, travel and medical insurance) for the duration of the trip, transportation to and from the winner’s place of residence to the closest international airport, gratuities, all meals, applicable taxes, pre and/or post tour accommodations if applicable, optional excursions, spending money, entrance fees, flight cost, air taxes and overweight baggage fees if required, incidentals and any and all other expenses not specified in the prize description.
Winner and guest must travel together and depart from the same location. Winner and guest are responsible for ensuring that all travel papers (including but not limited to passport and travel visas) required for travel to the Destination are in good order, and are valid prior to, and for the entire duration of, the prize period. Trafalgar will not be held responsible if the prize winner is refused entry into the destination by Government or boarder security authorities and no alternative prize will be awarded. Prize redemption and trip booking must be made directly with Trafalgar, quoting the promotion code provided.
2.2 The First prize winner will be contacted on the email that the entrant used to enter the competition. The winner will have a two (2) week time period in which they have to claim his or her prize. Failure to reply or respond within this fixed time as specified may result in forfeiture of the prize. If successful contact is not made within two (2) weeks, Trafalgar reserves the right to offer the prize to the next eligible entrant and thereafter, until a contactable winner is established and confirmed.
2.3 Trafalgar may decline to supply the prize, in the event of non-entitlement under these Terms and Conditions or an entrant's breach of these terms, including fraud or dishonesty.
2.4 No cash equivalent, replacement or alternative prize will be given to the winner, and the prize is non-transferable and non-exchangeable. However, in the event of circumstances beyond its control Trafalgar reserves the right to change or amend the prize and/or to offer a substitute of comparable worth or cost.
3. Judging
Judging will apply to determine the winners of each prize. Judges will be the Head of Marketing and other members of the Trafalgar marketing team. Trafalgar’s decision in relation to all aspects of this competition is final and binding on all who enter and no correspondence will be entered into.
4. Data Protection
4.1 Trafalgar (or any third party nominated by Trafalgar) may implement its exclusive discretion to use the winner’s (and if applicable their companion’s) name and their comments relating to the prize and competition experience for future promotional, editorial, campaign, marketing, sales and publicity purposes in any media worldwide without notice or without any fee being paid.
4.2 Information and personal data which is provided by entrants when they enter will be contained and handled by Trafalgar and YOURLifeChoices in order to successfully manage the competition. Any personal data will only otherwise be used in accordance with Trafalgar’s Privacy Policy and the Promoter’s (where different).

5. Liability
5.1 Nothing in these Terms and Conditions restricts your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau or its counterpart in your province or other jurisdiction.
5.2 Nothing in these Terms and Conditions shall exclude or limit Trafalgar’s or the Travel Corporation’s liability for death or personal injury caused by their staff or supplier’s negligence or for fraud.
5.3 Subject to clause 5.2, Trafalgar does not accept responsibility for any fault, malfunction, damage, loss or disappointment suffered by any entrant which could arise from participating in the competition or of accepting any prize whether due to any error, omission or other cause by Trafalgar, its employees, agents or others to the fullest extent permitted by law.
5.4 Trafalgar is not responsible for any damage or loss caused to an entrant where such damage or loss is not reasonably foreseeable to the entrant and to Trafalgar when the entrant agrees to these Terms and Conditions (which occurs automatically when you enter the competition), including where the damage or loss results from Trafalgar’s breach of these Terms and Conditions.
5.5 Trafalgar cannot promise that the services relating to the competition will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond the control of the company. Trafalgar will not be liable to you or to any other person in the event that all or any part of the service relating to the competition is discontinued, modified or changed in any way.
5.6 You agree to reimburse Trafalgar in respect of any damages suffered by the company or any losses by the company resulting from any claim made by a third party in each case in respect of any matter arising from your use of the services relating to the competition in breach of these Terms and Conditions or from your violation of any applicable law or regulation.
6. Standard terms
6.1 In the event that any entrant does not, or is unable to, comply with and meet these Terms and Conditions, Trafalgar shall be entitled at its sole discretion to disqualify such entrant, without any further liability to such entrant. Any entrant must comply with any directions given to him or her by Trafalgar including but not limited to any and all relevant laws, rules and regulations.
6.2 These Terms and Conditions are available in English only and shall be exclusively governed by and construed in accordance with the laws of Australia, which shall have exclusive jurisdiction in the case of any dispute between the parties.
