FULL TERMS AND CONDITIONS1.Instructions on how to enter, mechanics of entry and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each Entrant.
2. Entry is only open to residents of Australia aged 18 years or older who (Entrants). The Promoter is Nationwide News Pty Limited (ABN 98 008 438 828) of 2 Holt Street, Surry Hills NSW 2010. The directors, management and employees (and their immediate families) of the Promoter and Virgin Australia Airlines Pty Ltd (ABN 36 090 670 965) (Virgin), their related bodies corporate and the Promoter’s participating outlets, newsagents, printers, suppliers, providers and agencies associated with this promotion, and registered travel companions of employees of Virgin and its related bodies corporate, are ineligible to enter the promotion. On each day during the Promotional Period on which the Promoter publishes The Australian (including The Weekend Australian) (Promotional Day), the Promoter will print a unique code in The Australian for entry into that Promotional Day’s prize draw (Unique Code). There will be twelve (12) Unique Codes in total and each Unique Code will correspond to a specific Promotional Day and prize as set out in Conditions 16 and 17. Unique Codes will not be included in The Australian on any other day and are not available through any other means.
3.The promotion commences at 12:01am (AEST) on Saturday 29/9/2012 and ends at 11:59pm (AEST) on Friday 19/10/2012 (Promotional Period) and will run over twelve (12) Promotional Days as set out in Condition 16 below. Entries for a given Promotional Day must be received by the Promoter by the applicable final entries date set out in Condition 16. To enter into the prize draw for a given Promotional Day, Entrants must either:

Limit of one (1) entry per person per day per email or phone number. 5.Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries.
6.SMS entries must be sent from a mobile phone handset and be identified by a MSISDN (unique mobile SIM number) for security reasons to be eligible. Some service providers and call plans may not provide access to premium SMS. Entrants must check with their service provider if unsure. SMS is not a guaranteed delivery communication tool. The Promoter and the service provider cannot accept responsibility for any SMS messages not received. Entrants must have the bill payer’s permission to enter the promotion or their entry will be deemed invalid. Maximum SMS cost $0.55 (including GST) per message sent. 7.A free reply SMS will be sent to an Entrant submitting an entry via SMS immediately after their entry has been received confirming their entry has been successfully received and advising that their entry has been entered into a draw. If a SMS entry is not successful because it is not in the required SMS format or the Unique Code submitted is not recognised by the Promoter as an eligible Unique Code for the promotion, an “invalid code” message will be sent to the originating mobile telephone number. The “invalid code” message will prompt the Entrant to re-enter the Unique Code and resubmit their SMS entry in the required form. If an Entrant elects to resubmit their SMS entry via premium SMS, the Entrant will be charged again at a maximum SMS cost of $0.55 (including GST) per message sent.
8.If an online entry is not successful because the Unique Code submitted is not recognised by the Promoter as an eligible Unique Code for the promotion, the Entrant will be prompted to “try again”. The “try again” message will prompt the Entrant to check their Unique Code and resubmit their online entry in the required manner.
9.Costs associated with accessing the Promotional Website remain an Entrant’s responsibility and may vary depending on the Internet service provider used.
10.The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
11.Some telephone handsets may not provide the necessary functionality. Entrants must check with their service provider if unsure. Entrants must have the bill payer’s permission to enter the promotion or their entry will be deemed invalid. Maximum call cost $0.55 (including GST) per call from a standard land line. Higher costs may apply when making a call from a mobile telephone or pay telephone. Any telephone entries submitted after the Promotional Period has closed will not be included in the promotion and will incur the call costs per call made. 12.Entries for a given Promotional Day are not eligible to enter the prize draw(s) for any previous or subsequent Promotional Day. The Promoter accepts no responsibility for late, lost or misdirected Entry Forms or entries.
13.The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
14.
Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. Contact details entered incorrectly will deem an entry invalid. The Promoter reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Entrant’s identity, age, residential or email address, eligibility to enter and claim a prize, that the Entrant obtain the bill payer’s consent to enter by SMS or telephone call before submitting their entry (if applicable), that the Entrant has a clear relationship with the end mobile device used to enter via SMS (if applicable) and any information submitted by the Entrant in entering the promotion, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s satisfaction within the time requested, then all entries of that Entrant will be ineligible and deemed invalid.
15.The draw for each Promotional Day will take place on the draw date set out in Condition 16. All draws will be drawn consecutively from 2:00 pm (Sydney time) at Salmat Digital, Level 2, 116 Miller Street, North Sydney, NSW, 2060. Winners will be notified in writing and their names and localities will be published in The Australian on 7/11/2012. All reasonable steps to notify the winners of the results of the draws will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.

18.Total maximum prize pool value is up to $96,054.20. The prizes are not exchangeable and cannot be taken as cash. The prizes are not transferable, unless the transfer by a winner to a third party is for no monetary value and the Promoter has agreed to the transfer in advance and in writing at its sole discretion. Without limiting the above, no prize or any component of a prize can be sold on e-Bay or any other online auction site. If a prize is transferred in accordance with these Conditions of Entry, it is subject to the transferee being bound by these terms and conditions as they apply to the winner transferor. Prizes must be taken as offered and cannot be varied. The Promoter and Virgin accept no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter and Virgin accept no responsibility for any variation in prize value. All prize values are based on the recommended retail price including GST, depending on point of departure.
19.The travel component of a prize must be travelled in full by 31/3/2013, otherwise this prize component will be forfeited. Bookings must be made by 28/2/2013. Redemption of a prize is subject to availability at time of booking and may be dependent on travel class availability, specific room category availability and travel ‘blackout’ periods applying (including school holidays and public holidays). All components of a prize must be taken together and when offered or are forfeited. A winner and their travel companion (if any) must travel together and depart from and return to the same departure point. A winner or their travel companion (if any) may extend or vary their travel arrangements at their own cost and subject to availability, provided the return flight is booked by 28/2/2013 and travelled in full by 31/3/2013. All costs associated with extending the holiday, including but not limited to any booking fees, will be at the sole expense of the winner or their travel companion (if any) (as applicable). There may be no changes made to travel arrangements by a winner or their travel companion (if any) once tickets are issued.
20.The Promoter reserves the right to request a winner and their travel companion (if any) produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the winner’s and travel companion’s (if any) identity, age and residential address before issuing a prize. In the event of a dispute as to the identity of the winner, a prize will be awarded to the account holder of entry mechanism used to submit the entry.
21.It is a condition of accepting a prize that a winner and their travel companion (if any) may be required to sign a legal release or releases in a form determined by the Promoter in its absolute discretion.
22.All additional costs not expressly stated, but which may be incurred in acceptance and use of a prize, are the responsibility of the winner and their travel companion (if any). Such additional costs include, but are not limited to, meals, beverages, room service, telephone calls, laundry services, spending money, transport to and from airport departure point, other transfers, taxes including arrival and departure taxes (if applicable) but excluding airfare related taxes and charges included in the prizes, insurance, travel insurance, passports and visas (if applicable).
23.A winner and their travel companion (if any) will not accrue any Virgin Velocity points on any part of the prize and cannot use Virgin Velocity points to upgrade on any travel during the prize. If a winner and/or their travel companion (if any) elects to extend their trip or amend their trip by purchasing additional airfares, the winner and/or their travel companion will not accrue any Virgin Velocity points on such additional airfares. All prize travel on Virgin flights is subject to Virgin’s Conditions of Carriage.
24.A winner is solely responsible for their entry and the entry of their travel companion (if any) into the applicable destination, at their own expense, including ensuring all necessary passports, visas, travel authorisations, medical advice and recommended vaccinations and immunisations have been obtained prior to travel and, if required, on or by a date nominated by the Promoter. Compliance with any health or other government requirements is the responsibility of a winner and their travel companion (if any). Failure to do so may result in this component of the prize being forfeited.
25.Taking the travel component of a prize is subject to any prevailing terms and conditions of any accommodation/transport/services/transfers or tour providers (where applicable) and in particular, health, behaviour, age and safety requirements. No compensation will be payable if a winner, or their travel companion (if any), are unable to use any element of the prize as stated for whatever reason, including refusal of entry or departure into or out of the applicable destination or participation in certain activities for health, behaviour, age or safety reasons. Any part of a prize that is not taken for any reason is forfeited.
26.Use of a prize and any passes, tickets or vouchers issued as part of a prize are subject to prevailing prize supplier terms and conditions of use. Any passes, tickets or vouchers are only valid for use within the duration of a prize or the specified duration of the pass, ticket or voucher, whichever is shorter.
27.The Promoter may instruct Salmat Digital to conduct further draws at the same time and place as the original draws as are necessary on 4/2/2013 in order to distribute any prizes (if any) unclaimed by that date, subject to any written directions given under applicable State and Territory legislation. In the event of any winner in an unclaimed prize draw, the winner will be notified by telephone and in writing (mail) and their name and locality will be published in The Australian on 11/2/2013.
28.If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter’s or Virgin’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu (including to an alternative travel destination as nominated by the Promoter in its sole discretion), subject to any written directions made under applicable State or Territory legislation.
29.If this promotion is not capable of running as planned for any reason, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or, if necessary, to provide an alternative prize or prizes (including to an alternative travel destination as nominated by the Promoter in its sole discretion) to the same value as an original prize or prizes, subject to any written directions made under applicable State or Territory legislation.
30.The Promoter and Virgin, their associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), for any direct, indirect or consequential injury, loss and/or damage arising in any way out of the promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prizes; and/or (iv) acceptance and/or use of any prize (including but not limited to any component of a winner’s or their travel companion’s trip). Applicable manufacturers and/or distributors should be contacted in regards to all prize warranty claims.
31.As a condition of entering this promotion, an Entrant consents to, in the event they are a winner, the Promoter using the Entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter and/or any prize suppliers. The Entrant agrees that, in the event they are a winner, the Entrant will participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its agents.
32.An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. The Promoter collects personal information about an Entrant to include the Entrant in the promotion and, where appropriate, award prizes. If the personal information requested is not provided, the Entrant cannot participate in the promotion and is deemed ineligible.
