SHOP & Glue Store's "Search for Australia's Coolest Couple" Promotion Terms & Conditions

    Information on how to enter and prizes form part of these terms and conditions of entry. Participation in this promotion is deemed acceptance of these terms and conditions of entry.
    The promotion is open to all residents of Australia aged 18 years or over that: i) are in a romantic relationship with a partner who is also aged 18 years or over at the time of entry and prize fulfilment; and ii) areavailable to attend a photoshootwith their partner in Sydney, NSW sometime between 15 November, 2012 and 22 November, 2012(if selected as a Finalist) on an exact date to be determined by the Promoter. Individuals must obtain their partner’s consent to provide their partner's information and participate as outlined below.
    Employees of the Promoter (and their immediate families) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
    Promotion commences on 8 October, 2012 and closes at 11:59pm AEST on 11 November, 2012.

    To enter the Search for Australia’s Coolest Couple promotion, individuals must:

    a) log on to www.shoptilyoudrop.com.au during the promotional period;

    b) follow the prompts to the promotion entry page;

    c) upload a portrait picture of themselves with their partner demonstrating their and their partner’s persona fashionstyles. The photograph must be a full body shot of each person, with the faces of each person clearly visible and no other individuals featured in the photograph. The photograph must have been taken within six (6) months of entry submission;

    d) provide an answer to each ofthe two promotional questions: 1. "Tell us in 25 words or less: What do you love about each other's style?"; and 2. "Tell us in 25 words or less: Why are you Australia's Coolest Couple?" (each in 25 words or less);

    e) provide all of the required details (including the entrant's full name, their partner's full name, daytime phone number, and mailing address); and

    f) submit the fully completed entry form so it is received by 11:59pm AEST on 11 November, 2012.

    Uploaded files must be submitted in JPEG format, and must not exceed three (3) MB file size.


    Submissions must also comply with the content submission conditions as outlined in clause 21 below.
    It is a condition of entering the competition, entrants agree to be interviewed, photographed, filmed or that their entry to be featured during the promotional period by the Promoter or their agents for a story or feature on this promotion to be developed and featured on the Shop Til you Drop website or magazine (or any other form of media it deems suitable) without further remuneration or reference to the participant. Details may feature on a date to be determined by the Promoter. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times. An entry or entrant that is featured on the Shop Til You Drop website or magazine during the promotional period does not deem that entrant/entry as a finalist or major prize winner.
    The entrant agrees that parties involved in the entry are aware they have been entered into the competition and agree they have received consent from that party to be entered into the competition. The Promoter will not be held responsible nor liable for the entrant not receiving consent from any party involved in the entry.
    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    The Promoter will not be responsible for any incomplete or incorrect entrant contact details. Incomplete, incorrect and incomprehensible entries will be deemed invalid and will not be included in the judging.
    Entries not completed in accordance with the Terms and Conditions or received after the closing date will not be considered valid and will not be included in the judging.
    Multiple entries are not allowed. Only one (1)entry per couple allowed. For the sake of clarity, if both persons in a couple submit an entry, only the first entry received by the Promoter will be accepted.
    This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on: i) the literary and creative merit of the answers provided to the promotional questions; and ii) the creativity, originality and fashion acumen shown in creating the personal style of the couple as demonstrated in the photograph submitted.
    The judging will take place at the Promoter’s premises and will begin on November 12, 2012. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.
    The winners will be contacted by telephoneand mail using the contact details provided in their entry. Each winner will be required to confirm their full name, partner’s full name, mailing address, and telephone number to complete their prize claim. Any information required to be sent to the Promoter (for verification of winner’s identity) will be done so to a Reply Paid address as provided to the winner at the time of notification.

    The ten (1) best valid entries, as determined by the judges, will each win a professional photo shoot for themselves and their partner in Sydney, NSW sometime between the 15th and 22nd of November, 2012("Finalists"). The photo taken of each Finalist with their partner will appear in Shop Til You Drop's January 2013 issue. The prize includes:
        full hair and make-up stylingprepared by a professional stylist selected by the Promoter;
        the opportunity to select their own outfit from Glue Store clothing wardrobe options provided;
        styling advice from a SHOP fashion editor selected by the Promoter; and
        if the winner is from VIC, TAS, SA, WA, NT, QLD or ACT, return economy airfares from the winners nearest capital city to Sydney, NSW. If the winner is from NSW, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash.


    The exact time/date of the photoshootwill be determined by the Promoter in its absolute discretion. Finalists must be able to attend the photoshootwith their partner (as named on the entry and featured in the photograph submitted) on the day selected by the Promoter to be eligible.

    All spending money, insurance, service charges, taxes, transfers, transport to capital cities (if required), meals, or luggage required and any other ancillary costs incurred, are the responsibility of each Finalist.
    Each Finalist and their partner must depart from and return to the same departure point and they must travel together. Frequent flyer points will not form part of the prize.

    If for any reason a winner does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
    If any Finalist is not able to be contacted by 5:00pm AEDST on November 16, 2012 (using the contact details provided in their entry), then they will forfeit their participation in the shoot and will not receive another prize or cash in lieu of the prize.
    The best valid entry out of all Finalist entries, as determined by the judges based on the judging criteria outlined in clause 10, will also win a $10,000 Glue Store wardrobe voucher ("Major Prize Winner").
    The Glue Store wardrobe voucher will be valid for 12 months from the date of issue, and is available for usage in any Glue Store physical store or at their online store (at gluestore.com.au). Any ancillary costs associated with redeeming the voucher are not included. Any unused balance of the voucher will not be awarded as cash.
Redemption of the voucher is subject to any terms and conditions of the issuer including those specified on the voucher.
    The judge's decision in relation to any aspect of the promotion is final and binding on every person who enters. No correspondence will be entered into.
    If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

    Entries will not be returned to any entrant. Each entrant warrants to the Promoter that each entry submitted is an original artistic or literary work of the entrant that does not infringe the rights of any third party.

    When an entrant submits any materials via the promotion including comments, recordings and images ("Content"), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

    Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

    Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
    As a condition of accepting the prize, each entrant and their nominated partner consent to the Promoter using their name, likeness, image and/or voice in the event they are a Finalist or a Major Prize Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
    If for any reason this promotionis interfered with in any way or is not capable of running as planned, including but not limited due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any individual who tampers with the entry process; or (b)to cancel, terminate, modify or suspend the promotion,as appropriate.
    If the prize (or receipt of the prize) incurs a tax liability, the winner is liable for payment of such tax.
    The aircraft carrier selected for flights for Finalists (as required) to Sydney, NSW is at the discretion of the Promoter.
    Charges incurred due to changes to flights by the Finalists once booked by the Promoter (where applicable) are the responsibility of the Finalist.
    Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
    The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any entry to be received by the Promoter on account of technical problems or traffic congestion with the Service Provider, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this promotion. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
    Prizes are non exchangeable or transferable and cannot be taken as cash.
    Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Promotion and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
    Except for any liability that cannot be excluded by law, includingthe Non-Excludable Guarantees,the Promoter (including its officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of or participating in a prize.
    The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, opt-out, update or correct information to the Promoter. All entries become the property of the Promoter.The collection use and disclosure of personal information provided in connection with this promotion is governed by the Privacy Notice (see Contents Page for location in this issue).
