Terms and Conditions –Australia’s Money Confidence Survey
General
1. Information on how to enter and prizes form part of the Terms and Conditions. Entry into this competition deems acceptance of these Terms and Conditions.
2. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.
3. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. You are providing your information to the Promoter and not to Facebook.
4. Any entrant found to have posted duplicate, or near duplicate tweets, or to have used multiple Twitter accounts to enter will be ineligible. Entries must comply with the Twitter Rules (http://support.twitter.com/articles/18311-the-twitter-rules).
Who can enter
5. Entry is open to all residents of Australia (over the age of 18) except employees and immediate families of the Promoter, associated companies and agencies and participating outlets. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin. The Promoter is Pacific Magazines Pty Ltd, 8 Central Ave, Eveleigh NSW 2015 (ABN 16 097 410 896).
6. Entrants into this competition must be 18 years of age or older as at the date of entry.
How to enter
7. Entrants may enter the competition by submitting their original entry, including their full name and other details, at www.moneyconfidence.com.au . Entrants must enter the ANZ survey page and complete the consumer survey. Entrants can then provide their answer in 25 words or less to the question posed after the survey. Entrants that complete the survey and the 25 words or less answer will be eligible for the major prize and minor prizes. Entrants that only complete the survey will only be eligible for the minor prizes.
The major prize winner will be judged based on their 25 words or less answer in accordance with clause 10.
The minor prize winners will be drawn in accordance with clause 11.
8. All entrants may enter as many times as they like but only one prize will be awarded per person, however minor prize winners will also have a chance at winning the major prize.
Open, Close, Dra w and Publish dates
9. The competition commences 1/10/2012 at 00:01 AEST and closes 23/11/2012at 23:59 AEDT. Entries must be received by the Promoter prior to the competition close date and time.
10. The major prize winner will be the best valid entry as judged by the judging panel, having regard to skill, creativity and originality of the 25 words or less answer to the question described in clause 7, at the Promoter’s premises on 30/11/12 at 11:00 AEDT. The Promoter may select additional entries to be used as replacements in the event that the first entrant chosen as a winner cannot satisfy these Terms and Conditions or take a prize.
11. The minor prize winners will be the first valid entries randomly drawn by computer program at the premises of MNET Group Ltd Level 1, 16 Anster Street, Adelaide SA 5000 on 30/11/12 at 11:00 AEDT. The first 3 valid entries randomly drawn will be eligible to receive a first level minor prize (described in clause 14). The following 50 valid entries randomly drawn will be eligible to receive a second level minor prize (described in clause 14). The winners will be notified by mail and names of winners of prizes over $250 in value will be published in The Australian newspaper on 4/12/12.
12. Prizes will be sent within 28 days, subject to clause 18.
13. The Promoter may conduct such further draws on 4/3/13 at the same time and place as the original draw in order to distribute any prizes unclaimed by this date, subject to State and Territory legislation. Winners of any further draws will be notified by mail and their names will be published in The Australian newspaper on 8/3/13.
Prize on offer
14. Total prize value is up to $20,000.00 (including GST), as at 24/8/12 The major prize is:
1 x $10,000 cash prize; and
1 x Full personal financial plan with an ANZ financial planner, valued at up to $2,000
The minor prizes are:
3 First Level Minor Prizes of: $1000 ANZ Visa pre-paid gift cards
50 Second Level Minor Prizes of: $100 ANZ Visa pre-paid gift cards
15. All prize values are in Australian dollars. The prizes are not exchangeable or transferrable and non- cash prizes are not redeemable for cash.
16. Any cash prize will be paid by cheque made payable to the entrant, using the name provided by the entrant when entering the competition. The entrant will require an eligible bank account into which a cheque can be deposited. All prize values are in Australian dollars. The Promoter makes all reasonable efforts to send cheques in the names as specified in the original entry, but the Promoter is not responsible for ensuring that the names provided by an entrant are sufficient to satisfy the requirements for banking a prize paid by cheque.
17. Visa Gift Cards can be redeemed for goods and services at any retail outlet that accepts Visa prepaid cards electronically. The card may be declined by some merchants (for exampe gambling merchants). Australia and New Zealand Banking Group Limited ABN 11 005 357 522 (“ANZ”) is the issuerof the ANZ Visa Gift Card (‘Card’) but ANZ does not necessarily support or approve of, and is not and cannot be taken to be in any way responsible for, the content, nature, conduct or promotion of the competition nor any term or condition of the competition itself. The Card remains the property of ANZ, is not for resale and is subject to the Terms and Conditions provided with the Card which can also be found at www.anz.com/prepaidcards.
18. The major prize winner’s financial planning session will be held in person with an ANZ financial planner. The financial planning session can be provided by telephone or other medium if the session cannot reasonably be held in person due to geopgraphical distance. The promoter will make all reasonable efforts to arrange for the financial planning session to occur within 28 days of the major prize winner being notified of winning the prize, or as soon as practicable thereafter. If the major prize winner chooses not to attend a financial planning session, the major prize winner is not entitled to redeem the value of that session in cash. The financial planning session will be provided by ANZ, but ANZ does not necessarily support or approve of, and is not and cannot be taken to be in any way responsible for, the content, nature, conduct or promotion of the competition nor any term or condition of the competition itself.
Further Terms and Conditions
19. The Promoter (subject to State and Territory Legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.
20. The Promoter and their associated agencies and companies is not liable or responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems of the phone or of any phone network, or any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur during the draw; whilst undertaking any travel won on or connected with their entry into the draw; in the participation in any prize; as a consequence of late, lost or misdirected mail, email SMS or phone call; due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person; any injury or damage to entrant's or any other person's computer software or phone; or any combination thereof, related to or resulting from participation or sending or receiving of any communication or of any materials in this competition.
21. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
Copyright, Statutory guarantees, Waiver and liability
22. All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received. Pacific Magazines Pty Ltd (“Pacific”) and its related entities collects entrants’ personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners) and for related purposes which would reasonably be expected without your permission. For example, we may from time to time use your personal information to provide you with information about products and services which we expect may be of interest to you. However, we do respect your right to direct us not to do this if and when any future communication is sent to you by the Promoter. We do not sell personal information to other organisations. We may disclose personal information to essential service providers who provide services in connection with our products and services. You may request access to your personal information by writing to The Privacy Officer, Legal Compliance Department, Pacific Magazines Pty Ltd, 8 Central Ave, Eveleigh NSW 2015.
23. In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to granting the promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use.
24. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.
25. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize.
