1. Information on how to enter and prize details set out in all communications regarding the Commonwealth Bank of Australia Live and Lost Promotion (the “Promotion”) form part of these Conditions of Entry. Any entry not complying with these Conditions of Entry is invalid. Entry into this Promotion and the acceptance or receipt of a prize by a winner or the parent(s) or guardian(s) of a winner is deemed as acceptance of these Conditions of Entry. If applicable, the winner’s prize will be awarded to that winner’s parent(s) or guardian(s), on the winner’s behalf.
2. The Promoter is the Commonwealth Bank of Australia, ABN 48 123 123 124, of Level 13, 201 Sussex Street, Darling Park, Sydney 2000, Telephone: 13 2221 (the “Promoter”).
3. The Promotion commences at 12.01am AEDST on 29/10/2012 and closes at 11.59pm AEDST on 02/11/2012 (the “Promotion Period”).
4. Entry into the Promotion is open to individuals who satisfy the following eligibility requirements (“Eligibility Requirements”):
Are Australian residents and can take the prize between 01/12/2012 and 26/01/2013, on the exact dates specified by the Promoter. Individuals under 16 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. Are not members of the immediate family of employees of the Promoter or the Promoter’s related entities directly involved in the Promotion (as determined by the Promoter). Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Have a phone that is compatible with the CommBank Kaching App, which includes Apple iPhones and selected Android phones (“Participating Phone”).
Have an everyday transaction account (Complete Access, Smart Access or Youth Saver Account) with the Promoter at the time of entry and have downloaded and registered for the CommBank Kaching App. For the sake of clarity, individuals can be existing customers at the start of the Promotional Period or become customers during the Promotional Period (but prior to entry). Individuals must be registered for Netbank and NetCode SMS to be able to use the Kaching App. Eligible individuals can register for Netbank by following the prompts at

Their everyday transaction account must not be overdrawn and must be active at the time of the draw for the individual to be eligible to win.
5. To enter, individuals must satisfy the Eligibility Requirements and during the Promotion Period Kaching money (i.e. make a peer to peer payment via the CommBank Kaching App) to a friend (who has a bank account in Australia), using the code word “Lil Rockers” in the transfer description for their entry to be valid. Individuals can Kaching money to their friend, by either using email, mobile, Facebook or BUMP (if both the entrant and their friend have an iPhone running iOS 4.2 or above). Any individual that fails to include the code word “Lil Rockers” in their transfer description will not be eligible to receive an entry or win the prize.
6. Multiple entries permitted, subject to the following: (a) only (1) one entry permitted per eligible transfer (as described above); and (b) a transaction made from a joint account is eligible for (1) one entry to the promotion in the name of the person that made the transfer.
7. The computerised draw will be conducted by a representative of the Promoter at 12noon AEDST on 08/11/2012 at the Promoter’s office, Level 13, 201 Sussex Street, Darling Park, Sydney 2000. Winners will be notified by telephone within two (2) days of the date of the draw and in writing.
8. There will be one (1) prize valued at up to $4,500 (depending on the winner’s location), awarded to the first valid entry drawn in the draw. The prize includes: (a) a backstage tour (including a meet and greet) and two (2) tickets (one (1) for the winner and one (1) for their guest) to Reece Mastin’s concert taking place in the capital city nearest to the winner’s place of residence (as determined by the Promoter); (b) a merchandise pack (consisting of items selected by the Promoter in its absolute discretion) signed by Reece Mastin for the winner only; and (c) one (1) night twin share accommodation at a minimum four star hotel (as selected by the Promoter) in the city where the concert is taking place. If the winner’s nearest airport is not in the city where a Reece Mastin concert
is taking place, the prize will also include two (2) economy airfares to that city. If the winner’s nearest airport is in the city where a Reece Mastin concert is taking place, the airfare component will not form part of the prize.
9. Reece Mastin’s Australian tour will take place between 01/12/2012 and 26/01/2013, on the exact dates specified by the Promoter. The Promoter will notify the winner of the exact concert date in their nearest capital city once the winner is drawn and once all the tour dates have been confirmed. Spending money, meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. All flights and accommodation are subject to booking availability.
10. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. Where flights are included, the winner and their companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.
11. The backstage passes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
12. The total prize value is up to $4,500. The Promoter accepts no responsibility for any variation in prize value.
13. By acceptance or receipt of a prize by a winner or the winner’s parent(s) or guardian(s), that winner (or their parent(s) or guardian(s) where applicable) agrees to the name of the winner being published in the public notices section of The Australian newspaper on 15/11/2012.
14. Prize is not transferable or exchangeable and cannot be taken as cash. The winner accept the prize ‘as is’ and acknowledges that the Promoter accepts no responsibility for any tax implications that may arise from the prize. The winner should seek advice from the Australian Tax Office or their own taxation adviser or independent financial adviser.
15. The Promoter’s decision is final and no correspondence will be entered into.
16. The Promoter will use its best endeavours to provide the prize listed. If the prize is unavailable for whatever reason, the Promoter reserves the right to substitute the prize for another prize of an equivalent value, subject to any written directions given under applicable trade promotion laws and regulations.
17. In the event that for any reason whatsoever the winner does not take an element of the prize at the time specified by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
18. The Promoter reserves the right to request that the winner demonstrates their eligibility to win the prize as a condition of receipt of the prize (including to prove their identity and the eligibility to enter the promotion). Identification considered suitable for verification is at the discretion of the Promoter. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
19. If the winner fails to claim their prize by 12noon AEDST on 22/11/2012 the Promoter may select further winning entry by conducting an unclaimed prize draw on that date and time, at the same place as the original draw, subject to any written directions given under applicable trade promotion laws and regulations. By acceptance or receipt of the prize by a winner or the winner’s parent(s) or guardian(s), that winner (or their Parent(s) or guardian(s)) agrees to the name of the winner being published in the public notices section of The Australian newspaper on 27/11/2012.
20. If for any reason this Promotion is not capable of running as planned (including, but not limited due to infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion), the Promoter may take any action that may be available including cancelling, terminating, modifying or suspending the Promotion, subject to approval by the relevant regulatory authorities. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process.
21. Any cost incurred for data used to download or use the CommBank Kaching App is dependent on the Internet Service Provider used and is the responsibility of the entrant.
22. The Promoter accepts no responsibility for late, lost or misdirected entries. Incomplete, ineligible or incomprehensible entries/transactions will be deemed invalid. The Promoter reserves the right, at any time, to verify the validity of entries and to disqualify any entry that is not in accordance with these Conditions of Entry. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
23. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website, or any combination thereof (including, but not limited to) any injury or damage to participants or any other person’s computer related to or related to or resulting from participation in or downloading any materials in this Promotion.
24. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; (e) if the Reece Mastin performance is cancelled or postponed for any reason beyond the reasonable control of the Promoter; or (f) taking of the prize.
26. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
27. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter in its absolute discretion, including but not limited to a legal release and indemnity form.
28. All entries become the sole property of the Promoter.
