INSUREMYRIDE ULTIMATE RIDER COMPETITION TERMS AND CONDITIONS

PARTICIPATION
1. This competition ("Competition") is conducted by InsureMyRide Pty Limited ABN 75 121 676 293 ("Promoter"), c/o Suncorp Group, Level 11, 447 Collins Street, Melbourne VIC, 3001.
2. Entry to the Competition constitutes acceptance of these terms and conditions. All entry instructions and prize information published by the Promoter form part of these terms and conditions of the Competition.
3. The Competition is only open to individuals who: (i) are residents of Australia aged 18 years or older as at time of entry; and (ii) are not employees of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iii) are not a spouse, de-facto partner, child or sibling (whether natural or by adoption) or parent of such an employee ("Eligible Entrant"); and (v) agree to accept marketing and promotional material from the Promoter, at a minimum, for the duration of the promotion.
4. Competition entry commences at 00:01 hrs on 24 October 2012 and closes at 17:00 hrs on 18 December 2012 ("Entry Period"). Except as otherwise stated, all times are Australian Eastern Daylight Saving time.
5. Except as otherwise indicated, all amounts stated in these conditions are stated in Australian dollars.
ENTRY
6. To enter the Competition, an Eligible Entrant must, during the Entry Period:
(a) Use a compatible browser to visit www.theultimaterider.com.au (“Competition Website”) and must fully complete the entry form including first name, last name, email address, phone number, age, and tick the box agreeing to the Competition’s terms and conditions and to receive marketing communications from the Promoter and not opt out during the Entry Period. To be a valid entry, the Eligible Entrant must, during the Entry Period, provide all the details required by the Promoter. An Eligible Entrant can only enter once via this method and there is no facility for the Promoter to withdraw or amend their single entry; or
(b) Use a compatible browser to Log onto their Facebook account and visit www.facebook.com/insuremyride (“Facebook Page”) and “Like” the Facebook Page (if they do not already “Like” the page). Click on the Competition tab (“Competition Tab”) on the Facebook Page and fully complete the entry form including first name, last name, email address, phone number, age, and tick the box agreeing to the Competition’s terms and conditions and to receive marketing communications from the Promoter and not opt out during the Entry Period. To be a valid entry, the Eligible Entrant must, during the Entry Period, provide all the details required by the Promoter. An Eligible Entrant can only enter once via this method and there is no facility for the Promoter to withdraw or amend their single entry.
7. An Eligible Entrant can send details of the competition to a number of friends using their unique share URL from the Competition Website or Competition Tab on Facebook. The unique share URL can be shared via direct link, email, Facebook, Twitter or Google+. That friend must during the Entry Period via the Eligible Entrant's unique share URL enter the Competition. The Eligible Entrant will receive one entry into the competition for each person they referred who entered the Competition via the Eligible Entrants unique share URL. The referral mechanism described is subject to the Spam Act 2003. Eligible Entrants who have already entered the promotion cannot be referred as friends by a subsequent entrant. Each person referred friend must be an Australian resident aged 18 years or older. Each Eligible Entrant warrants that each friend they refer is known to them personally, and that they have their consent to send email and send electronic communications to such persons.
8. All Eligible Entrants must ensure that the Promoter receives their entries during the Entry Period. Entries will be deemed accepted at the time that the Promoter is satisfied that the relevant requirements under condition 6 have been met and not at the time of submission by the Eligible Entrant. The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or delays or failures in any telecommunications service or equipment.
9. The Promoter may, in its absolute discretion, declare any or all entries made by an Eligible Entrant invalid if the Eligible Entrant tampers with the entry process, benefits from such tampering or submits an entry that is illegible, incomplete or not in accordance with these conditions.
INTERNET ENTRIES
10. Eligible Entrants must submit their internet entries manually. The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service.
11. Cost of entry via the internet is free, but internet connection and usage rates may apply. Eligible Entrants should obtain details of such costs from their service providers.
DRAW AND PRIZE
12. The draw for the prize will be held at 12:00 pm on 19 December 2012 at 5th Finger Pty Ltd, Level 7, Tower Building, Australia Square, 264 George Street, Sydney, NSW, 2000.
13. There is only one Prize. The first valid entry drawn will win the Prize (“Prize Winner”). The Prize is a 2012 model Honda CBR1000RR Fireblade Motorcycle, which has been ridden in the Ultimate Rider TV Series. The total prize value is up to $17,700 including 12 months* registration, 12 months* compulsory third party insurance, transfer stamp duty and 12 months* InsureMyRide comprehensive insurance cover^ including up to $2,000 riding gear cover.
*Actual period may be less than 365 days depending on the winner’s location and pick up date, but won’t be less than 11 months residual benefit.
^The issue of InsureMyRide Insurance is subject to InsureMyRides’ normal underwriting acceptance criteria. Value of prize is approximate only, given differing on road costs nationally.
14. The Prize motorcycle will be provided in an “as is” condition, that is, the same state of repair and condition, both mechanically and body work, (including any advertising or branding features and artwork appearing on the Prize motorcycle – that would identify it as a motorcycle ridden in the InsureMyRide Ultimate Rider TV series) that it is in at the end of the TV Series. For the avoidance of doubt, the Prize motorcycle will not be brand new.
PROVISIONS APPLICABLE TO THE PRIZE GENERALLY
15. The Prize is valued at up to $17,700 including GST. See condition 13. The Prize is valued as at 17 September 2012. The Promoter takes no responsibility for any variations in the Prize’s value due to exchange rate changes or otherwise.
16. The winner must arrange their own collection of the prize(s) from their closest Australian Honda dealership. The winner will be advised of the dealership location, and the time and date at which the prize can be collected. The Promoter will organise the prize to be delivered to the winner’s nearest Honda dealership at Honda’s expense. The Promoter is not liable for any costs associated with the collection of the prize. Any costs will be at the winner’s expense. If the winner is unable to collect the Prize motorcycle from the nearest Honda dealership, the winner may elect to incur the cost of transporting it, if needed, from their nearest Honda dealership to an alternate claim point as nominated by the winner and deemed acceptable by the Promoter.
17. If the eligible winner is, through any legal incapacity or otherwise, unable to register or insure the motorcycle in their own name, they may assign the Prize motorcycle to another person with legal capacity (who consents to the assignment). Such consent must be in writing and be signed by both the winner and the assignee. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The assignee and/or the winner must in these circumstances cooperate with the Promoter by providing certified copies of all the documentation required by the Promoter for the purposes of transfer of ownership, registration and insurance** before the motorcycle is awarded.
**The issue of InsureMyRide Insurance to the assignee is subject to InsureMyRides’ normal underwriting acceptance criteria.
18. To register the bike, the winner must provide the Promoter with the necessary signed documents and identification to satisfy the state or territory government vehicle registration authority. Once it is provided by this authority, the Promoter will transfer registration into the winner’s name.
19. If the Prize (or part of the Prize) is unavailable for any reason, the Promoter may, in its absolute discretion, substitute an alternative motorcycle of no lesser retail value and/or specification, or equivalent cash value, subject to the approval of the authorities that have issued permits for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by the Prize winner or any other party if the Prize (or part of the Prize) is unavailable for any reason.
20. Other than as stated in condition 19, the Prize is non-transferable, non-refundable, non-exchangeable, non-replaceable, and non-redeemable for cash. Any tax on the prize is the responsibility of the winner. Independent financial advice should be sought by any person participating in this promotion.
21. The Promoter shall not be liable for any costs associated with the prize before or after the delivery.
22. The Prize winner accepts the Prize at his or her own risk. The Promoter, its associated companies and agencies and their personnel shall not be liable for any death, injury, loss or damage (including any claim, costs or expenses) whatsoever that is suffered by any entrant, prize winner or assignee of the prize (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of taking and/or using any prize, except for any liability that cannot be excluded by law. The Promoter shall not be responsible for any entries that are not received or are otherwise interfered with due to problems with the Internet or telecommunications services. No responsibility will be taken by the Promoter for any incomplete, late, lost or misdirected entries. The Promoter may require that the Prize winner sign and return a deed of release to this effect as a condition of the Prize being awarded. If the Prize winner fails to sign and return such release, the Prize winner may forfeit the Prize.
WINNER OF THE PRIZE
23. The Prize winner will be notified by a phone call and a written message that will be sent by e-mail provided by them in their entry.
24. The Prize notification will state that the winner has won the Prize and will include instructions as to how the Prize winner is to claim the Prize and establish his/her entitlement to it. The person who receives the Prize notification must confirm their eligibility to be awarded the Prize by 18 March 2013, otherwise their entry will be deemed invalid. If a winning entry form is deemed invalid, the Promoter will draw another entrant in the same manner as the original draw and repeat this process until an Eligible Entrant is drawn. If the Promoter is unable to notify any entrant drawn (and obtain their confirmation), the procedures outlined in Condition 29 will apply.
25. The name of the Prize winner will be published in The Australian on the 21 December 2012.
26. The name of the Prize winner will also be published at the Competition Website within seven (7) days of the Prize being won (including if the Prize is won under any redraw in accordance with condition 29), for a period of at least one (1) week.
27. Subject, where relevant, to any directions given under the laws regulating the Competition, if the Prize is: (i) not claimed by the Prize winner or the Promoter has been unable to successfully notify the Prize winner within three (3) months of the draw for the Prize; (ii) forfeited for any reason; or (iii) the Prize winner is determined by the Promoter to be ineligible in accordance with condition 31, the Prize will be awarded to another Eligible Entrant in a redraw for the Prize. Any such redraw will be made from a pool of entries comprising all those entries that were originally eligible to win the Prize. Any such redraw will take place at 12:00 pm on 19 March 2013 at 5th Finger Pty Ltd, Level 7, Tower Building, Australia Square, 264 George Street, Sydney, NSW, 2000. If there is a redraw, the name of the winner of the redraw will be published in The Australian on 25 March 2013. The Prize winner will be notified by a phone call and a written message that will be sent by e-mail or mail to the e-mail or mailing address provided by them in their entry.
GENERAL
28. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to provide an alternate prize in accordance with condition 21 to the same value as the original prize or to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
29. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Eligible Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise); (v) any delay in delivery, or failure of safe delivery of the Prize.
30. All of the Promoter's decisions are final and no correspondence will be entered into.
31. The winner consents by entering the Competition to the Promoter using their name, likeness, image and/or voice (including a photograph, film and/or recording of them) in any media at any time or times without compensation, financial or otherwise, for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.
PRIVACY AND MARKETING CONSENT AND DISCLOSURE
32. Privacy Statement. Each Eligible Entrant agrees that they must provide and maintain their consent to receive marketing communications from the Promoter for the duration of the Entry Period following entry. This is required to ensure that Competition entries are properly recorded, processed and the winner can be drawn. By entering this Competition, the Eligible Entrant understands and agrees that the Promoter collects their personal information in order to conduct the Competition as well as obtain information about the Eligible Entrant’s potential insurance needs. The Eligible Entrant also understands and agrees that the primary purpose of collecting information about the Eligible Entrant is to enable the Promoter to contact the Eligible Entrant at a later date (by any permitted means including telephone, email, mail or SMS) to market their respective products and services. If the information requested is not provided the Entrant will not be eligible to participate in the Competition. By entering this Competition, the entrant understands and agrees that the Promoter may disclose the information provided by them to any state or territory gaming regulator (if necessary), as well as use their information for further promotional, marketing and publicity purposes. Subject to the required marketing communications consent during the Entry Period, an Eligible Entrant’s personal information is otherwise collected, used and disclosed in accordance with the Promoter’s privacy policies, which are available at www.insuremyride.com.au or by calling 13 24 53 (InsureMyRide). If the Eligible Entrant would like to access or correct the personal information that the Promoter holds about them, or if the Eligible Entrant wishes to opt out of receiving the Promoter’s marketing communications after the end of the Entry Period, the Eligible Entrant should inform the Promoter by calling 13 24 53 or sending an email to info@insuremyride.com.au.
33. The Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an Entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an Entrant, as a result of participating in the promotion (including taking/use of a Prize) except for any liability which cannot be excluded by law. The Promoter reserves the right to modify the Terms and Conditions in order to comply with changes to the Facebook Promotions Guidelines.
