“BEL AMI” COMPETITION
CONDITIONS OF ENTRY
Information on how to enter and prize details form part of these Conditions of Entry. Entry into the “Bel Ami” Competition is deemed to be acceptance of these Conditions of Entry.
The Competition commences on 26 September 2012. Entries close at 11.59pm 31 October 2012 (the Promotional Period).
Entry is only open to residents of Australia who are BLOCKBUSTER® members (Eligible Entrants). Employees and family members of the Promoter, agencies or companies associated with the Competition, including BLOCKBUSTER® franchisees, are ineligible to enter.
There are 2 major prizes to be won. A winner and their guest will win a luxury weekend away. The winner must rent “Bel Ami” for the opportunity to enter to win. The prize consists of:
2 nights’ accommodation for 2 adults staying in a One Bedroom apartment, including breakfast for two daily at a Medina Apartment Hotel of choice (Sydney, Melbourne, Perth, Adelaide, Brisbane, Canberra, Wollongong or Darwin) (valued at $1100 each/$2200 total)
1x Maggie Beer gourmet food showbag (valued at $24.95 each/$49.90 total)
1x Martini sparkling wine gift pack (4 bottles of Martini sparkling wine) (valued at $59.96 each/$119.92 total)
1x Blu-ray copy of Bel Ami (valued at $49.95 each/$99.90 total)
The total major prizes is valued at $2,469.72
20 runner-up winners will each win a Hopscotch Entertainment DVD movie pack valued at $129.85 each (total runner-up prizes are valued at $2597)
Total value is $5,066.72
The sharing of a Prize is not permitted and the Prizes are not transferable, not exchangeable, cannot be taken for cash and are not valid with any other offer.
All prices stated are in Australian dollars, represent the recommended retail price (“RRP”) and include GST at the time of printing. All references to times and dates are to times and dates in Melbourne.
How to enter
7. To enter the Competition, an Eligible Entrant must log on to
http://www.blockbuster.com.au/competitions, click through to the “Bel Ami” competition page, and answer this question in 35 words or less “If you could charm us to win this weekend of luxury prize, how would you do it and why?”
8. Eligible Entrant must be a member of
www.blockbuster.com.au to enter and must complete all mandatory fields of the entry form in order to be eligible to receive a prize.
Eligible Entrants can enter once during the promotional period. Eligible Entrants can only win a maximum of one prize for the duration of the competition.
How winners will be determined
This is a game of skill and chance plays no part in determining the winner.
A panel of judges will judge the creativeness of entries in answering the question.
The judges will determine the 2 most creative entries and these entries will win the major prizes based on creative merit.
The judges will then determine the next 20 most creative entries and these entries will win the runner up prizes based on creative merit.
The judges have absolute discretion in their determinations and their decisions are final. No correspondence will be entered into.
15. The winners will be notified in writing or phone call.
The Promoter may require an entrant to show that they are an Eligible Entrant. Showing that an entrant is an Eligible Entrant may (in the Promoter’s sole discretion) include the Eligible Entrant providing, or showing to, the Promoter:
Proof of Australian residency; and
The Eligible Entrant’s BLOCKBUSTER® membership card.
Proof that “Bel Ami” was rented at the entrant’s local participating BLOCKBUSTER® store.
In the event that any entrant does not claim his or her Prize or cannot show that he or she is an Eligible Entrant within 14 days of written notice being given to that entrant that his or her entry is a winner, the judges may reallocate the Prize to the next most creative entry that has not yet received a Prize.
No responsibility accepted for lost, late, stolen, damaged or misdirected mail.
If for any reason the Competition is not capable of running as planned, the Promoter reserves the right in its sole discretion to modify the terms of the Competition including the Prizes and these Conditions of Entry, subject to the approval (if required by law) of any relevant government authority.
The Promoter and the agencies and companies associated with the Competition will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of entering the Competition or receiving, accepting or using any prize except for any liability which cannot be excluded by law.
The Promoter assumes no responsibility for:
any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise;
any theft, destruction or unauthorized access to, or alteration of such communications;
any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion;
any incorrect or incomplete information which may be communicated in the course of the administering this Promotion.
CAUTION: Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.
Terms and Conditions of the major prize
Prize is for two adults for two consecutive night’s accommodation in a one bedroom apartment including breakfast daily for two at a Medina Apartment Hotel of winner’s choice.
Prize must be redeemed at a Medina Apartment Hotel in Sydney, Melbourne, Perth Adelaide, Brisbane, Canberra, Wollongong or Darwin.
Prize is not refundable, non-endorsable or non-transferable.
Bookings should be made in advance to avoid disappointment.
All prizes are subject to availability.
Additional spending money, meals, insurance, taxes, passports, visas, travel to and from the winner’s choice of Medina Apartment Hotel and all other ancillary costs are the responsibility of the winner and their accompanying guest.
Other accommodation costs (including mini-bar, room service, phone, movies, internet, spa services, laundry, restaurant and bar charges) become the responsibility of the prize winner and their accompanying guest.
The winner must provide a valid credit card at check-in to cover any incidentals incurred throughout the stay.
In the event that, for any reason whatsoever, a winner does not take an element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element.
The prize will be issued in the form of a gift voucher valid for six months from the date of issue and will not be extended.
Bookings need to be made directly with your choice of Medina Apartment Hotels.
The prize value of the accommodation is $500 a night and breakfast is $50 per day for two people. Total value for 2 major prize winners is $2200.
The Promoter and the agencies and companies associated with the Competition accept no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
If the winner of a Prize is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian.
If any Prize (or part of any Prize) is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Promotion. The Promoter accepts no other liability or responsibility for any loss incurred by any Winner or any other party if any Prize (or part of any Prize) is unavailable for any reason.
Prizes are not exchangeable and cannot be redeemed for cash (unless prize is cash prize). Prizes cannot be scalped, auctioned, raffled, pledged, or promoted as an incentive or reward, by any third party as an inducement for any person or other entity to enter into any commercial or other arrangements with that third party. If this prize is obtained through any of these methods, it will be dishonoured.
All claims and entries become the property of BLOCKBUSTER®. Each entrant agrees to do all things requested by BLOCKBUSTER® to ensure that the intellectual property rights in and to his or her entries become the property of the BLOCKBUSTER® and to provide all consents necessary or requested by the BLOCKBUSTER® in relation to moral rights.
BLOCKBUSTER® may use the information an entrant provides for the purpose of conducting the Competition and in any media for further promotional, marketing and publicity purposes unless otherwise advised by the entrant.
BLOCKBUSTER® may disclose entrants’ personal information to its contractors and agents who assist it in conducting the Competition, communicating with entrants and conducting promotional, marketing and publicity activities. BLOCKBUSTER® is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can access and correct the personal information BLOCKBUSTER® holds about them by contacting BLOCKBUSTER® on (02) 8833 2160.
