Term and Conditions

1. Information on how to enter the "Win a iPAd" Agricom Promotion (Promotion) and the Prize(s) (defined below in Clause 21) form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions. The Promotion is not valid in conjunction with any other offer or promotion.
2. Entry is only open to Australian residents. Entrants under 18 years old must have parental/legal guardian approval to enter the Promotion and further, the parent/legal guardian of the entrant must read and consent to these Terms and Conditions. Parents/legal guardians may be required by Agricom Australia Pty Ltd (ABN 7909 3174 415) (Promoter) to enter into a further agreement as evidence of their consent to the minor entering this Promotion.
3. Employees (and their immediate families) of the Promoter, and agencies associated with this Promotion, are ineligible to enter. In these Terms and Conditions 'Immediate families' means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
4. The Promotion commences at 12.01 am (AEST) on 20th July, 2012 and will close at 11:59pm (AEST) on 1 November 2012 (Promotional Period).
5. To participate in the Promotion and to be entered into a respective draw, entrants must, during the Promotional Period:
a. enter as an entrant in accordance with the instructions set out in Clauses 6 to 10 of these Terms and Conditions (Entrants' Draw)
Entry
6. To be eligible to enter as an entrant in the Entrants' Draw, individuals must, during the Promotional Period:
a. visit the Agricom website (www.agricom.com.au);
b. provide the required details to complete their entry and submit the entry form online.
7. An entrant will receive one (1) entry into the draw (as detailed in Clause 6 above).

Verification
8. Incomplete, indecipherable or illegible entries or votes will be deemed invalid.
9. The Promoter reserves the right, at any time, to verify the validity of entries, entrants, voters and votes (including an entrant's or voter's identity, age and place of residence) and to disqualify any entrant or voter who submits an entry or vote that is not in accordance with these Terms and Conditions or who tampers with the entry or voting process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
10. The Promoter reserves the right, at any time, to invalidate any votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to, personal details and contact information and/or votes that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to, social networking accounts.
11. The use of any automated entry or voting software or any other mechanical or electronic means that allows an entrant or voter to automatically enter or vote repeatedly is prohibited and will render all entries/votes submitted by that entrant/voter invalid.
12. If there is a dispute as to the identity of an entrant or voter, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or voter.
13. The Promoter's decision is final and no correspondence will be entered into.
Draws and Prizes
The winners will be drawn at Agricom Australia Pty Ltd 7-9 Distribution Drive, Truganina, VIC, 3028, on the 15/11/2012 – drawn at 2pm
20. The winners of the Promotion will be notified in writing by email within two (2) days of the respective draw to the email address nominated to promotional staff at the time of entry into the Promotion or at the time of registration to vote (as the case may be). The winners of the Promotion will also be published:
a. at www.agricom.com.au  on 17 November 2012
14. A total of three (3) black Apple iPad 2 – 16GB with Wi-fi, valued at $426 each (Prizes), will be awarded in the Promotion. The total Prize pool is $1278. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST).
15. Prizes are subject to the standard terms and conditions of individual Prize and service providers. Prizes are for the iPads only. The winners will be responsible for making all arrangements for connection with any relevant service providers and payment of all associated connection, access and internet/data charges.
16. A maximum of one (1) Prize may be awarded to an individual
17. The Prize will be delivered to each of the winners within twenty-eight (28) business days of the respective draw. The Prize will be delivered to the address provided by the winner to the Promoter in response to the winner notification email. It is the responsibility of the winner to be available to receive the delivery as organised by the Promoter and notified to the winner. The Promoter accepts no responsibility should an entrant or voter fail to receive their Prize because of a failure to provide the correct address details.
General
18. If a winner of any Prize is under the age of 18 years, the Prize will be awarded to the winner's nominated parent or legal guardian on the winner's behalf.
19. If any Prize (or part of any Prize) is unavailable, the Promoter, in its absolute discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to equal or greater value and/or specification, subject to any written directions from a regulatory authority.
20. Prizes, or any unused portion of a Prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
21. A draw for any unclaimed Prizes may take place on 1 December 2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing by email within two (2) business days of the draw and will be published at www.agricom.com.au on 5th of December 2010.
22. Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
23. Without limiting any other terms in these Terms and Conditions, the entrant agrees to indemnify the Promoter against all claims, losses, damages and costs by third parties arising from a breach of the warranties set out in these Terms and Conditions.
24. Entrants and voters consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
25. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant or voter; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
26. Any cost associated with accessing the promotional website is the entrant's and voter's responsibility and is dependent on the Internet service provider used. The Promoter makes no guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with the ability to participate in the Promotion.
27. Nothing in these Terms and Conditions is intended to exclude, restrict or modify any consumer rights under the Competition and Consumer Act 2010 (Cth) (CCA) or any other legislation which may not be excluded, restricted or modified by agreement. If the CCA or any other legislation implies a condition, warranty or term into the Terms and Conditions or provides statutory guarantees in connection with these Terms and Conditions, in respect of goods and services supplied (if any), the Promoter's liability for breach of such a condition, warranty, other term or guarantee is limited to (at the Promoter's election) to the extent it is able to do so: (1) in the case of supply of goods, the Promoter doing any one or more of the following: (a) replacing the goods or supplying equivalent goods (b) repairing the goods (c) paying the cost of replacing the goods or of acquiring equivalent goods; and/or (d) paying the cost of having the goods repaired; or (2) in the case of supply of services, the Promoter doing either or both of the following; (a) supply the services again; and/or (b) paying the cost of having the services supplied again. To the extent the Promoter is unable to limit its liability as set out in this Clause, the Promoter limits its liability to the extent such liability is lawfully able to be limited.
28. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry, vote or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) if a Stand is cancelled or delayed for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner, voter or entrant; or (g) use of a Prize.
29. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants and voters should direct any request to opt out, access, update or correct information to the Promoter. All entries and votes become the property of the Promoter.
30. The laws of Australia apply to this Promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
