ENTRY INTO THE COMPETITION
MAX “MIDNIGHT OIL” COMPETITION TERMS AND CONDITIONS
1. Entry into the MAX “Midnight Oil” competition (the “Competition”) is open to all residents of Australia. The Promoter is FOXTEL Management Pty Ltd (ABN: 65 068 671 938) of 5 Thomas Holt Drive, North Ryde NSW 2113, Australia (the “Promoter”). It is a condition of entry that all entrants under the age of 18 must have their parent or legal guardian’s express permission to enter this Competition in accordance with these Terms and Conditions. Entry into the Competition is deemed acceptance of these Terms and Conditions.
2. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, FOXTEL, Telstra, Optus TV and their related bodies corporate are not eligible to enter.
3. The Competition begins at 5:00pm (AEDT) on Thursday 18 October 2012 and closes at 11:59pm (AEDT) on Sunday 4 November 2012 (the “Competition Period”).
4. To enter the Competition and be eligible to win, entrants must:
(a) register for membership online at
www.maxtv.com.au; (b) complete the online entry form;
(c) indicate which show you would like to attend; and
(d) in 25 words or less answer the following question “What is your favourite Midnight Oil song and why?” (the “Competition Question”)
5. All entries must include all mandatory information as indicated on the form, which includes (not limited to the entrant’s name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth. All entries must be original and must not incorporate material which has been previously published. Incomplete entries or those which, in the opinion of the Promoter, infringe the intellectual property rights of any third party, contain any objectionable content, profanity or is potentially insulting, inflammatory or defamatory will be ineligible to win the Prize. It is each entrant’s responsibility to inform the Promoter if his/her residential address, email address or phone number changes during the Competition Period.
6. Only one entry per membership per day is permitted during the Competition Period, however, the answer to the Competition Question in each entry by the same entrant must be unique and original. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify that entrant without notice.
PRIZE

There are twenty-one (21) prizes in total, consisting of o1 Major Prize and 20 Minor Prizes:
a) The Major Prize includes:
A "Diesel and Dust" era poster, block mounted and signed by Peter Garrett, Rob Hirst, Jim Moginie & Martin Rotsey;
An "Essential Oils" fan-pack consisting of the "Essential Oils" album on CD, a large-size T-Shirt and a tote bag, valued at a maximum total of $60; and
A CD pack consisting of Midnight Oil’s eleven studio albums and 2 EP's on CD, valued at $ 220 in total
b) Each Minor Prize consists of a copy of “Essential Oils” album on CD, valued at $ 20
The Major Prize and the Minor Prizes are together referred to as the Prizes.
8. The total maximum Prize pool value is $480. The Prize values are the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prizes occurring between publishing date and date the Prizes are claimed. All Prize values are in Australian dollars.
9. All ancillary costs and expenses incurred in taking and using the Prizes (including but not limited to, transport to and from the concerts, spending money, food, accommodation and travel insurance) are the sole responsibility of the Prize winners and their guests, unless otherwise expressly stated as included in the Prizes.
10. Entrants are advised that the use of the Prizes may be subject to prevailing terms and conditions of the venues, prize suppliers and/or event organisers. It is a condition of accepting the Prizes that the Prize winners and guests comply with all such terms and conditions and it is the Prize winners’ responsibility to first check the tickets and with the venues and/or event organisers regarding any such applicable terms and conditions before use. The Promoter takes no responsibility for any cancellations, postponements or any other changes to the events and will not offer a substitute prize under any circumstances. The Promoter accepts no other liability or responsibility for any loss incurred by the winner or any other party if the Prize is unavailable for any reason.
11. The Prizes are not transferable or redeemable for cash. The Prizes or any element of the Prizes cannot be exchanged for any other prize or cash. The contents of the Prizes will be at the Promoter’s sole discretion.
12. Only one Prize per person will be awarded.
JUDGING AND AWARD OF PRIZE
13. The Competition will be judged on the basis of originality and creativity at MAX, Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 on Monday 5 November 2012 at 10:00am (AEDT). Chance plays no part in the selection of the Prize winners. The Prize winners will be notified via email or phone on Monday 5 November 2012 and their names published on the MAX website from Monday 5 November 2012. The Prizes must be claimed within 5 days of the publication of the Prize winners’ names.
14. If the Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize.
GENERAL
15. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that a Prize winner cannot provide suitable proof, That Prize winner will forfeit the Prize in whole and no substitute will be offered.
16. By entering the Competition, each entrant warrants that their entry is their own original work, and that they own all rights, including copyright in their entry. Each entrant indemnifies the Promoter in the event that this warranty is false.
17. No responsibility will be taken by the Promoter, MAX, FOXTEL, Telstra or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winners from winning the Prizes.
18. The Promoter reserves the right, in its absolute discretion, to disqualify:
a) any entry which, in the opinion of the Promoter, includes any objectionable content, profanity or
is potentially insulting, inflammatory or defamatory; or
b) any individual who tampers with the entry process, submits an entry that is not in accordance
with these Terms and Conditions or who has in the opinion of the Promoter, engaged in unlawful or improper conduct that is designed to jeopardise the fair and proper conduct of the
