Conditions of entry
Information on how to enter and prizes forms part of these Conditions of Entry. Entry into the Kleenex® Cottonelle® Toilet Tissue 'Giant Puppy' Promotion (Promotion) is deemed to be an acceptance of these Conditions of Entry.
Entries can be received from 27 November 2012 at 14:00 AEST
until 8 December 2012 at 23:59 (Promotion Period).
Entry is only open to Australian residents. Employees (and their immediate families) of the Promoter, or agencies or companies associated with the conduct of this Promotion, are ineligible to enter.
To be eligible to enter, entrants must, during the Promotion Period, go to:
(1) the official Australian Kleenex® Cottonelle® website
www.kleenex-cottonelle.com.au and submit an entry by clicking on the box which states "Win a Giant Plush Puppy".
Entrants must submit an entry via the relevant entry form with all requested details including an answer in
25 words or less to the following question: 'Tell us in 25 words or less where would you take your puppy this festive season?'Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.
Multiple entries, per person, per day will be accepted, however note that there is a limit of one prize per person. Entrants may not submit the same or similar entries as multiple entries.
This is a game of skill and chance plays no part in the determination of the winners. Entries will be judged solely on originality, creativity and entertainment value.
There will be twenty (20) winners. The judging will be conducted at 52 Alfred Street, Milsons Point NSW 2061 on Monday 10 December 2012. The winners will be announced at 9:00am on Tuesday 11th December 2012 via the Kleenex® Cottonelle® website. Winners will also be notified via email and phone on that same day.
The twenty (20) best entries, as judged by the Promoter will win one (1) Kleenex® Brand plush puppy valued at approximately $150. The Total prize pool value is up to a maximum of $3,000. There is a limit of one prize per person.
The plush puppy is a 60 cm tall Kleenex® Brand plush puppy.
The value of the prize is accurate and based upon the recommended retail price(s) at the date of commencement of the promotion. The Promoter accepts no responsibility for any variation in the prize value. Prizes or any unused portion of a prize are not transferable or exchangeable and cannot be taken as cash.
The Promoter's decision is final, and no correspondence will be entered into, including in the event of a dispute. The prizes must be taken as offered and cannot be varied.
The Promoter and its associated agencies or companies accept no responsibility for lost, late, stolen, damaged or misdirected entries.
In the event that a prize, or an element of a prize, is/are not available, the Promoter reserves the right to substitute prize(s) in its discretion to the same and equal recommended retail value.
If for any reason this promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, to cancel, terminate, modify or suspend the promotion as appropriate.
The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in this promotion.
Any costs associated with accessing the Kleenex® Cottonelle® website is the entrant's responsibility and is dependent on the Internet service provider used. Any tax liability arising as a result of accepting any prize is the responsibility of the winner.
The Promoter and its agents will not be liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with receiving, taking or using any prize except for any liability which cannot be excluded by law.
The Promoter collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. A request to access, update or correct any information should be directed to the Promoter at their address set out below.
Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
All entries become the property of the Promoter and may be displayed on the Kleenex® Cottonelle® website. By entering the promotion, each entrant:
(1) declares that their entry (including any artwork and other material, and any parts thereof) (Work) is their own original work and not copied in whole or in part from any other person, and does not infringe the intellectual property rights of any third party. "Intellectual property rights" means all copyright, trade secrets, confidential information, trademark, design, patent, trade name or other proprietary rights or any rights to registration of such rights;
(2) agrees that the Promoter and its agents, licensees and assigns are entitled to use and reproduce the Work for any purpose whatsoever worldwide, including display in television commercials or online at the Australian Kleenex® Cottonelle® website and uses which, in Promoter's opinion, are in connection with the promotion and sale of its products and services in any geographic region worldwide without restriction;
(3) waives any right to inspect or approve any use or reproduction by or on behalf of the Promoter of any part of the Work, including any written copy or proofs that may be created in connection with the Work (including any photograph);
(4) consents to Promoter and the Promoter's agents, licensees and assigns using the Work for promoting our products and services without attributing the authorship of the Work, without the entrant inspecting or approving the Work, and also to the extent that our use of the Work materially alters or distorts the Work (whether by changing, adding to or deleting/removing any part of the Work);
(5) acknowledges that Promoter may choose not to use or display the Work, and may not reproduce the Work on the Australian Kleenex® Cottonelle® website or any other medium.
Each entrant acknowledges that the Promoter or its related companies may currently or in the future be developing information internally, or receiving information from other parties, that is similar to the entrant's ideas. For example, the Promoter and its related companies has a large research and marketing staff that is devoted to continually creating new products and improving the products it offers to consumers. It is not unusual for the Promoter or its related companies to receive ideas that are similar to products or concepts that are already known to the Promoter or under development somewhere within the Promoter's or its related companies research efforts around the world.
Accordingly, nothing in these Conditions of Entry will be construed as a representation or agreement that the Promoter will refrain from developing or authorizing another to develop any products, designs, concepts or product features that are similar to those contemplated in in the entrant's entry or other confidential information provided that Promoter does not violate any of its obligations set forth in these Conditions of Entry.
All claims and entries become the property of the Promoter. By entering the Promotion the entrant consents to the Promoter's privacy policy available on the

The Promoter collects the Entrant's personal information for the purpose of administering the Promotion, notifying and announcing the winners and of marketing the Promoters products and services, including direct marketing techniques. The Promoter may disclose the entrant's personal information to other parties including those involved in administering the Promotion, notifying and announcing the winners, the supply of prizes, fulfilment houses and advertising and PR agencies. If the entrant does not provide the required personal information to the Promoter, the entrant cannot enter the Promotion. The entrant may access and correct the personal information about the entrant held by the Promoter by writing to the Promoter at the address below. By entering this Promotion the entrant consents to the collection, use and disclosure of his or her personal information as set out in this paragraph.
