Terms and Conditions
Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.
Entry is open to residents of Australia who are 18 years and over. Employees and their immediate families of the Promoter and its agencies and outlets associated with this promotion are ineligible to enter.
The promotion commences at 09.00 ADST on 03/12/12 and closes at 10.00 ADST on 20/02/13 ("Promotional Period").
There are two components to this promotion: 1. TOOHEYS EXTRA DRY On Premise Instant Scratch & Win; and 2. TOOHEYS EXTRA DRY Prize Draw Promotion.
TOOHEYS EXTRA DRY ON PREMISE INSTANT SCRATCH & WIN:
To enter the TOOHEYS EXTRA DRY On Premise Instant Scratch & Win Promotion, purchase any TOOHEYS EXTRA DRY product from a participating venue during the Promotional Period to receive a game card. Scratch the game panel on the game card to reveal if you have won an instant prize. Present your winning game card to bar staff at the participating venue of purchase during the Promotional Period to redeem your prize. You will be required to surrender your winning card at the time of redemption.

Limit of 1 game card per person per day applies, while stocks last.
Each game card has a 1 in 5 chance of winning an instant win prize. The maximum number of game cards to be randomly distributed for this promotion is 635,205. The game cards will be distributed to 808 participating venues.
Prize consists of a TOOHEYS EXTRA DRY wallet (RRP $14.95). Total RRP value of prizes = $1, 899, 262.95. The total prize pool RRP in each state/Territory is: NSW/ACT: $785,996.25; VIC: $29,032.90; SA: $257,154.95; TAS: $17,700.80; WA: $238,871.10; NT: $34,504.60 and QLD: $536,002.35. Each participating venue will be provided with either a Tier 1 kit consisting of 1320 game cards and 264 TOOHEYS EXTRA DRY Wallets; or a Tier 2 kit consisting of 575 game cards and 115 TOOHEYS EXTRA DRY Wallets. Total number of TOOHEYS EXTRA DRY Wallets to be won is 127,041. Each state will consist of: NSW/ACT x 75 Tier 1 and x 285 Tier 2 Venues; VIC x 3 Tier 1 and x 10 Tier 2 Venues; SA x 29 Tier 1 and x 83 Tier 2 Venues; TAS x 1 Tier 1 and x 8 Tier 2 Venues; WA x 37 Tier 1 and x 54 Tier 2 Venues; QLD x 77 Tier 1 and x 135 Tier 2 Venues; NT x 7 Tier 1 and x 4 Tier 2 Venues.
All taxes (excluding GST) which may be payable as a consequence of receiving an instant prize are the sole responsibility of the winner.
Any unclaimed instant prizes remaining at the close of the Promotional Period will be disposed of by the Promoter by random distribution at their sole discretion to any customers who purchase a TOOHEYS EXTRA DRY product.
All TOOHEYS EXTRA DRY On Premise Instant Scratch & Win entrants will also be eligible to enter the Minor and Major Prize Draw component of the TOOHEYS EXTRA DRY Prize Draw Promotion. For more details, see the terms and conditions relating to the TOOHEYS EXTRA DRY PRIZE DRAW PROMOTION below.
All valid claims for prizes will be met notwithstanding that the advertised prize pool has been exceeded. Printing errors or other quality control matters will not be used as the sole basis for refusing to award a prize. All instant prizes must be redeemed during the Promotional Period.
The Promoter shall not be liable for any loss, damage or injury suffered by any winner as a result of the winner accepting and/or using a prize, except for any loss, damage or injury which is due to the negligence or wilful misconduct of the Promoter or which otherwise cannot be excluded by law.
TOOHEYS EXTRA DRY PRIZE DRAW PROMOTION:
To enter the TOOHEYS EXTRA DRY Prize Draw promotion,
EITHER:
Purchase a specially marked promotional carton of TOOHEYS EXTRA DRY containing a code from any participating outlet during the Promotional Period;
OR:
Purchase any TOOHEYS EXTRA DRY product from a participating venue during the promotional period to receive a game card with a unique code,
THEN:
submit your entry during the Promotional Period via one of the following methods:
EITHER:
enter online at www.tooheysextradry.com.au and access the promotional entry form. Complete all sections of the online entry form including first name, last name, address, postcode, email, mobile number and the code found on the promotional carton of TOOHEYS EXTRA DRY or the unique code found on the Scratch & Win game card.. Confirmation of your entry will be communicated to you via the website once successful entry has been completed. Entrants must retain a clear copy of their original receipt as proof of a valid purchase during the Promotional Period;
OR:
enter via SMS, by texting the code found on the promotional carton of TOOHEYS EXTRA DRY, or the unique code found on game cards from the Scratch & Win game card. SMS entry is only open to consumers with a compatible mobile phone connected to a service provider which permits premium text messaging to the promotional SMS number. SMS entries submitted via the Internet are not valid and will not be accepted. A return SMS will be sent to each entrant who submits a valid SMS entry to confirm receipt of their entry. Entrants should keep the reply SMS and clear copy of their receipt(s) showing an eligible purchase(s), as proof of purchase to claim the prize in the event they are the winner.

MINOR PRIZE:
All valid entries received from the TOOHEYS EXTRA DRY Prize Draw Promotion will be entered into all Minor Prize Draws remaining from the time of entry. The Minor Prize Draws will take place at Traction Digital, Level 1, Building 1, 85 O'Riordan Street, Alexandria, NSW, 2015, Australia. at 12.00pm, 1.00pm, 2.00pm, 3.00pm, 4.00pm, 5.00pm, 6.00pm, 7.00pm and 8.00pm every day between 11/12/12 and 19/02/13 (inclusive of these dates). The winners will be selected at random through an electronic random selection process. The first valid entry drawn in each Minor Prize Draw will receive a Minor Prize. SMS Minor Prize winners will be provided with instructions on how to claim their prize by return SMS and Online winners will be sent their prizes to the address provided in their online entry.
If a draw date falls on a Public Holiday the Minor Prize Draws for that day will be conducted on the next business day at the same time as the original draws.
Each Minor Prize consists of 1x $20 TOOHEYS EXTRA DRY Gift Card. Total RRP value of minor prizes = $12,780. Nine to be won daily. There will be 639 minor prizes in total.

MAJOR PRIZE:
18.   All entries received in the TOOHEYS EXTRA DRY Prize Draw Promotion (including the winners of Minor Prizes) will be entered into the Major Prize Draw. The Major Prize Draw will take place at Traction Digital, Level 1, Building 1, 85 O'Riordan Street, Alexandria, NSW, 2015, Australia. at 3pm on 21/02/13. The winner will be selected at random through an electronic draw process. The first valid entry drawn will win the Major Prize.
19.   The Major Prize consists of the choice between:
EITHER:
AUD$75,000 (inclusive of GST) to 'Blow' in a week:
The 'Blow' component of the Major Prize consists of debit card/s loaded to the total value AUD$75,000 (inclusive of GST). The Major Prize Winner will have exactly 1 week (168 hours) from the date and time of issue to spend as much money as they can on the debit card/s utilising any legal service that accepts debit card/s. At the end of this period the debit card/s must be returned to The Promoter along with any remaining money left on the debit card/s. At no time may the debit card/s be converted to cash.
OR:
AUD$100,000 (inclusive of GST) to 'Bank' for 12 months:
The 'Bank' component of the Major Prize consists of AUD$100,000 (inclusive of GST) payable by way of cheque or direct money transfer, which will be awarded to the winner on 21/2/2014, or if there is a second chance draw, on the date that is 12 months from the date of the second chance draw.
The Major Prize Winner will be required to confirm their choice of Major Prize in writing before the Prize can be issued.
There is one (1) Major Prize to be won in total. Max total prize pool for the Major Prize based on Option A is AUD$75,000.00 and based on Option B is AUD$100,000.00.
Minor Prize winners will be notified via SMS or Online. The Major Prize winner will be notified by telephone within 2 days of the Major Prize Draw and in writing (email or mail), within 21 days of the Major Prize Draw. The name of the Major Prize winner (and their suburb if winner is in SA) will be published in The Australian on 01/03/13.
Before the Major Prize is awarded, the winner (and, if applicable any other persons sharing the Major Prize with the winner) may be required to sign an agreement to release the Promoter from, and indemnify the Promoter against, any loss, damage or injury arising from the use of or participation in the prize, except to the extent any loss, damage or injury is due to the negligence of wilful misconduct of the Promoter.
If necessary, a second chance draw in relation to the Major Prize will be held on 23/05/13 at the same time and place as the Major Prize Draw in order to distribute any unclaimed prizes. If applicable, the second chance winner of the Major Prize will be notified by telephone within 2 days of the second chance draw in relation to the Major Prize and in writing (email or mail), within 21 days of the second chance draw in relation to the Major Prize. The name of the second chance winner (and their suburb if winner is in SA) will be published in The Australian on 30/05/13.
Total prize pool value across all aspects of the promotion (including Minor Prizes and Major Prize) is RRP $87,870 (based on Major Prize Option A) and RRP $112,780 (based on Major Prize Option B). Total prize pool value across all aspects of the promotion (including Instant Scratch & Win Prizes, Minor and Major Prizes) is RRP $1,987,132.95 (based on Major Prize Option A) and RRP $2,012, 042.95 (based on Major Prize Option B).
All taxes (excluding GST) which may be payable as a consequence of receiving a Major Prize are the sole responsibility of the winner.
Prizes are not transferable and are not redeemable for cash. The Promoter's decision is final and binding - no correspondence will be entered into. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may (where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the promotion. Entries will be deemed void if illegitimate, forged, manipulated or tampered with in any way.
If any prize becomes unavailable for reasons beyond the Promoter's control, the Promoter may substitute a prize of equal or greater value, subject to any written directions from the lottery authorities.
The Promoter reserves the right to request verification of age, identity, residential address of winners and any other information relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in interfering, manipulating or tampering with the conduct of this promotion.
The Promoter shall not be liable for any loss, damage or injury suffered by any winner as a result of accepting and/or using a prize, except for any loss, damage or injury which is due to the negligence or wilful misconduct of the Promoter or which otherwise cannot be excluded by law.
Entrants will be refused service of alcohol or provision of an alcoholic beverage prize if it would breach any relevant laws, codes or policies, including those of the relevant liquor licensee relating to the responsible service of alcohol. The Promoter supports the responsible service of alcohol.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
Details from entries will be collected and used for the purpose of conducting this promotion (which may include disclosure to third parties, including local lottery authorities, for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant.
